How Do I get off proabtion early?

hello everyone, Im on 5 yrs probation for cultivation, Is it possible to get an early dissmisal? if so how do I do that?

another question can you drink alcohal on probation if your 21+? I turn 21 next month and It would be nice if I dont have to wait till im 26 to drink.

Normally, if you have been a model probationer they let you off a little over half way through.

As for the drinking, you should have been given a list of things that are prohibited. If any type of in or outpatient drug programs were part of the probation you can skip drinking.....You might better skip the booze anyways. You're twice as likely to get in some other kind of trouble while drunk. And if you do the Judge will resentence you on the original charge.....And that normally includes doing some time behind bars....

ummm you being on probation makes the system money (supervision fees.) i'd say fat chance gettin off early. unless maybe like JJ said after half way through or whatever but that is incredibly unlikely (although not absolutely unheard of) and they would make you pay them the remainder of your supervision fees in a lump sum.

and to anyone who doubts that it is about money then answer me this:
what happens if you walk the line, jump through hoops, pee in the cup, and do the time, but don't pay fees/restitution?

answer: you aren't discharged from probation until they have made their money.


i'd say tow the line and bide your time. being on probation and getting caught up WILL send you away for a while! so stay outta trouble.

well if youre in a medical friendly state, and have a pre existing condition from that time, get a lawyer and a med card and appeal the case.

unless it was specifically spelled out 'no alcohol' or a box was checked, then youre okay, if however it DOES say no drinking, regardless of you turning 21 or not it'll probably still be a condition of your probation to totally abstain, was for me :wink:

I was in drug court and one of the conditions was no drinking. The thing about it though was that I wasn't subject to randoms, only scheduled. So when I did drink I just kept my cool; i.e. never drove, didn't get into any random fights, etc.

I also got released early for "good behavior" or whatever they called it, did 9 out of 12 months. I finished my community service quickly, paid my fees, and did a outpatient thing. While I failed like 4 UA's at the beginning, I showed them who I was and they respected that person.

Sounds like it's time to move. You are only free if you live free. The goverment now has you as a slave slave. They take your money, and you give them more money to stay out of inprisonment. I hope I get to see a change in our goverment in my lifetime, but it is not going to happen without lots of chaos and discorse.

Unless you wish to be a slave slave? Move and start over. To stay where you got caught and prosecuted is stupid in my opinoin and experience. You might as well tattoo " criminal" on your forehead, because that is what you are to all of them. Just a stupid pot head.

Oh, and forget drinking. It's probation, not vacation.

Oh, and I am NOT calling anyone a stupid pothead. if I did I would be yelling at myself.

It makes sense then why my friend, a minor, po let him off halfway threw because the restitution for the light pole, didnt need to be paid so they were basically losing money the 3 or so months he was on.lol

Kali, there is a sliver lining in the yoke of probation if you can get it- is unsupervised probation. If you do everything right, i.e., no dirty pee tests, keep a job, or go to school, you may end up being put on that.

Usually every state has some form of unsupervised. And in almost all cases it means you can go back to living your life as normal. I got to go on unsupervised after a year of peeing in the cup and having steady full time employment. Once that happened I went back to being an everyday smoker.

you have a pretty distorted view of "the truth." You're advising him to bail on his probation and move where & do what? Any other place in the U.S. he won't be able to hold a real job nor have a place of his own and if he tries, prison time. Canada, not a chance. Mexico, see won't be able to hold a real job nor have a place of his own.

Like most people here, he knew what he was doing was illegal and if caught there would be consequences. You can call him a slave for having to be in the system, but personally, I'd much rather be a "slave" to the probation system than be an inmate in a state pen.

(and comparing a man on probation to a slave is outright ignorance)

i suppose it would depend on what classification of probation he was on.

i still stand by my statements 100%, but my experience was on maximum supervision felony probation, so maybe i was in deeper shit than u guys... (and all for herb lol)

FYI i served time then still had 14 months of papers left from my concurrent sentence.

whatever you do, DON'T leave state without permission. now peeps have been talking about having your probation transferred to a mmj state and then appealing the probation. this may work, although i have no experience with it.

works like this:depending the state you are in,the best you can hope for is to do half of it and get non reporting.dont call,dont report.The other choice is early termination:the probation officer,judge and prosecutor are present to make that determination.Probation officer will straight up tell you that it doesnt happen often at all.also,no drugs or drinking.

as far as splitting on probation,what happens when you get pulled over and they run your name?It sux. really it does.Hang in there.Could be worse.could be sitting on your bunk listening to 1000 people scream,eating crappy meals,waiting for commissary.Now you tell me which you prefer?Peace.

I will not be on po or in prison if I get caught, because I will leave and grow in another state. Which I'm guessing is what the OP was doing to begin with? Isn't like anyones going to hire him for more than minimum wage now anyways. He's a no good pot head.

There ARE many many ways to drop out, and tune in. Just because you have no clue of how to do this you decide to use uninteligent statements such as ignorant. To bad you didn't have anymore inteligent things to say, becvause by doing that it made your whole post childish and null and void.

You might like probation or prison, but I choose niether. Now who is ignorant?


I guess that would be me, but at least I am free and no ones slave. Pay your taxes wunderkid, and help the goverment hunt you down. That is ignorant. imo

you know, you're right, man. People on probation are just like slaves. They have to work 16 hour days for no pay, they're held against their will, I mean damn, I once saw a dude on probation get whipped because he looked at a white girl.

Good luck just moving to another state after you've been arrested for commercial production. I'm sure they'll just drop the charges once they've realized you left.

You tell your po you want to go into the armed forces. I was supposed to have 2 years of it for a dui. I got off of it after 3 months. See, you can't join the military if your on probation so if you make it seem like that's what u want to do and sell it good. He will take you off so you can do what you say you will do. having parents speak on your behalf is a good thing. After you get off probation, say fuck the military. and never join it worked for me and i guarantee it will work for you. its all about selling it though. funny thing was i was going to go, but then iraq happened and I said Fuuuuuukkkkkkkkkkk that. i'm not dying for bush's invasion.

if you try to live off the radar. how long do you think its gonna be before you roll a stop sign? have a tail light go out? come across a bored ass cop that aint got nothin better to do?

if you skip town, WHEN (not if :wink: ) you get pulled over 14 states away for a broken tail light.... you'll be going right back where you got charged and they aint gonna go easier.

I was on felony formal probation as well. I agree with that statement for sure because thats a big no no if you ever DID get picked up out of state...

I'm a tool and dont take my own advice, I left for a week while on probation.... to mexico..... for spring break......

it helps out alot

the thing i did that helped me was moved far away
i told them there was a family emergency with my mom and i had to move closer to her to help out and they slapped me with a fine instead of course
it was for fighting drunk not growin

I guess you do not know about taxis, buses, and trains. I do not own a car to get pulled over in. #1 way to get busted is rats, #2 is driving, so I keep both away from me.

I can tell this is a conversation of children that have not lived any life yet. I'll come back in a few years after you kids grow up. Have fun. I'v never been pulled over. Never will either, because I do not drive. Real simple to understand. I do not want to hear, " I live in the country, I got a job,,,,waaa waa waa.....". Bah humbug, get a horse. Or just do the stupid time and do not whine about it. Or you can just obey the stupid laws. There are more paths, but they take a backbone.

Couple of years of not fucking up is real easy ain't it? What a tool.
