Austrian laws about growing and flowering cannabis ?

Hello everybody

I have a question about the austrian's laws with cannabis.

I know that some shops sell cannabis clones. So is it possible to put in flower the plants ?

What I don't understand is :
- some websites say that flowering a plant is forbidden. So why the "hemp embassy museum" of Vienna present a lot of plants in flower with cannabis buds ?
- More, maybe it's a fake, but I saw pictures about Flowery fields and Barney's farm, having plants in flower in Austria with big buds :)
- To finish, I have seen some articles saying that people had been caught by austrian police with two kilograms for one, and ten kg for the other, and they have been relaxed by the tribunal, because they had no proof it was a dealer.


So my question is :
- can I flower 30 one bud plants, and have other 30 mother plants at home ? (I smoke 100g by month :moon:)

Canabis let to flowering is forbidden in austria for Private citizen.
Hemp embassy museum is allowed from goverment to promoted canabis.

There are some seedbanks who promoted at some events with flowering plants but they are "allowed" to do this.
These guys who are busted with over 1kilo+ and more are lucky ones that they did not go in jail because most time its "the first time " for them or they "can prove" that they need it for themself or for use medical problems were some other stuff can not help.They get also a punishment from Judge dont think they will receive nothing.

Only thing what is allowed for Private citizen is to buy cbd canabis with under 0,3 thc in some shops or cuttings from shop for using as "air freshener"...

You can have some plants as air freshener but if they start flowering
and police would bust you you gona see the judge some weeks later.

30 flowering plants and 30 mother plants are "large quantity" if they bust you you gona pay a high price.:Bolt:
 
What MrPoison1 said is not entirely true. By Austrian law it is technically not illegal to flower cannabis plants, however it is illegal to flower cannabis plants to produce drugs. If they bust you with flowering plants they will automatically suppose you were doing the latter unless you can prove otherwise. The Hemp Embassy in Vienna destroys the flowers they are growing and I suppose they document everything with a notary and have good legal support. So this is how they can do what they are doing, not because they have some special permit by the government (the only ones with a special permit are AGES who are growing for medical purposes).


And to your initial question about your plants, that always depends on your personal risk affinity. I for example would say go ahead and don't get caught ;)


As far as I know what matters in the end is the total amount of THC, so your mother plants don't really count if you get in trouble with the law. And if you don't have any prior sentence and are not dealing, nothing would really happen to you. After all, 30 "one bud" plants are not a big amount of plants.


And even people who were dealing usually just get a suspended sentence if they were not in conflict with the law before. The "high price" they pay is a backpay to the fiscal authorities on their illegal drug income.

If they bust you with 30 mother plants or cuttings they can extrapolate it to higher numbers to rekt your ass.
When you have professional Equipment they are more accurate.

Police here also when they find in your car many cuttings they can take it away form you.

Evry month some one get busted here in Austria.
 
Well, there are growers and growers. I cannot remember even when I was growing less than 30 plants.

Sure, it is not legal in Austria and when you grow you take the risk of getting busted. I just was pointing out that even in the worst case nothing really serious will happen with a grow of that size for self supply.

And just because every month someone somewhere in Austria gets busted, it doesn't mean that you run a high risk of getting busted. Not at all if you are smart, don't sell and keep it not-too-big. One thing I remember a criminology professor was saying, people usually overestimate the probability of getting caught in a criminal act ;)

I got some friends that work, or worked for the Police in Austria. Basically, everyone i know was, or is a stoner. xD

Reviving... concerning breeding... if the goal is to make seeds and dispose of the THC (flowers, etc.), this seems an allowable gray area in the law (that says growing for the purpose of producing narcotics is illegal), but likely in practice flowering plants could easily draw being raided and then trying to prove only seed harvesting was planned, etc. seems tricky legally.

But perhaps having a registered business for such would cover it.

Anyone with anecdotal knowledge or better of successful (legal) breeding setups in AT?
