Court rejects medical marijuana bid

[quote] DES MOINES (AP) - A split Iowa Supreme Court on Friday rejected an effort by an AIDS patient to argue that medical necessity required him to use marijuana to ease symptoms of his disease. The majority of justices said the Legislature had asked the Iowa Board of Pharmacy Examiners to look into the medical use of marijuana. They said they won't intervene while that process is under way. Justice David Wiggins dissented, saying the court shouldn't wait for lawmakers to settle an intensely political issue. "We do not have to wait for the Legislature or the board to negotiate the political minefield regarding the medical use of marijuana," Wiggins said. AIDS patient Lloyd Bonjour, then in his 60s, was convicted of manufacturing marijuana in 1999 after police found the drug in his home. He appealed, saying the drug was medically necessary. Dr. Jeffery Meier, a medical professor from the University of Iowa, testified that Bonjour was forced to take a variety of toxic medication that had side effects including nausea, diarrhea and neuropathy. Bonjour's attorney, Theresa Wilson, said the Legislature created a method that would recognize medical use of marijuana, when used under rules established by the Board of Pharmacy Examiners. "The problem is that the board has not established any rules for the medicinal use of marijuana," she said. "This is an unfulfilled mandate." The court looked specifically at the necessity defense, generally applied in cases where lawmakers have not acted. In the past, the Iowa court has allowed a necessity defense in the case of a farmer who shot deer that were eating his crops. In such cases, the court noted, common law applies to determine the lesser of two evils "and thus avoiding a greater harm by bringing about a lesser harm." In this case, however, the Legislature has acted, recognizing the potential medical use of marijuana and asking state regulators to investigate. Courts shouldn't interfere with that process, the justices said. Wilson said Bonjour may seek another hearing. In other action, the court ruled Friday that a bar that sold alcohol to a man who later raped and killed a woman can be sued for damages by the victim's family. Randy Lee Bode raped and strangled the woman on Nov. 18, 2000, after a night of drinking at a bar in Algona. Bode later pleaded guilty to voluntary manslaughter and second-degree sexual abuse. The woman's husband and son sued the bar. This is why no young people want to live in the midwest. These states are suffering huge brain drain by all the young getting the heck out of there as soon as they can. It's called voting with your feet and the narrow minded rednecks of Iowa just don't get it. I was telling a bud of mine that I'm from Texas & there you are looked down upon if you are different, but in California just the opposite. I could go on forever, but I'm preaching to the choir.
BTW my g/f just surprised me with a medicinal card she qualified for, so I'm jazzed!

It's got to change soon, there's just to much mounting evidence that it provides medical benefits. Why would companies like GW Pharma be investing millions in Sativix or whatever it is called. That money will eventually pass through the crooked hands of goverment lobbiest <<<
spelling. Then it will be ok. How can they continue to deny it has medical benfits? I don't think they will ever let us have the way we want it. When big pharma gets ready, then they will be allowed to do what they want, but we still won't be able to grow it legally. Just like other drugs.Mo, |

Looks pretty typical to me. I think this is a perfect example of what I consider to be the moral bankruptcy of our courts, politicians and unfortunately, society in general...At least the society of the U.S.A... To say no or at the very best, "not yet" to a person who obviously has a better quality of life through the use of marijuana is absurd. Then, to have it be said in the same article that a suit could go forth against a bar that sold alcohol to a (in hindsight) obviously deranged man is in my opinion just as absurd! What happened to taking responsibility for ones own actions??? Sue the shit out of the sick bastard who committed this atrocious crime!!! Alcohol did'nt make him commit this atrocity any more than it would make me do the same! This person was clearly a murderer and rapist 'waiting for a place to happen'.
Our politicians are gutless wonders. The only way marijuana laws will be changed is through a real grass-roots campaign. Until a strong non-political leader can take charge and say enough is enough, we will continue to be persued like moral lepers. We have to have our voices heard and only We The People can make this happen!! Any ideas good people? Peace, Willie |
