Well, bad news. Well, the worst news. The crop got raided by the sheriff's dept. I don't know WTF is going on right now. My roommate/partner called me today and said there was a warrant on the door, which was kicked down, our 24 plants were seized, our medical paperwork was seized, yet there were no warrants issued and there are no warrants out for our arrest. They basically just jacked us. They did have a warrant to search the premises though, which they got before contacting us to investigate the legality of our medical marijuana grow. Other then the plants there was a few grams of hash, which was confiscated, maybe 10g of herb, and a couple pipes and bongs which were left.

We had 24 plants with 4 patients. 2 of us lived in the house, while I was the caregiver for the other 2.

Do I have any legal recourse? Or did they just get away with robbing us?

I should mention this happened earlier today, and not 1 of us has been contacted yet. All our paperwork was in order, and they had to have seen it to confiscate it.

Man that really sux. Unreal! I wonder how it would of went down if someone would of been present when LEO showed up? I'm crazy and don't like my time or hard work wasted, so I'd call or show up and demand my meds and stuff back, but that is just me:smile: Did they take any lights or anything, or just meds and paraphanelia? Good luck. Time to call an attorney.

Just plants and meds. They left the "paraphanelia".

I don't just want to go over there complaining. I'm talking to a lawyer tomorrow, or my partner is at least. If I can do anything, it's done. If not, I'll just be on my way. It was in the backyard of a rental, so I'm putting in my 30 days.

Luckily, I don't put all my eggs in one basket.

If you had ALL the paperwork posted by your grow, and that includes written authorizations from the patients you were the care provider of, then you should be OK and maybe can file suit for damages. Ideally, the paperwork should be pinned to the wall of the grow or the door so it is immediately visible.

How did they find you anyway?

The paperwork was pinned to the wall of the house by the plants. The sheriffs seized the paperwork as "evidence".

So, I talked to a lawyer, the pot lawyer of my area. He said basically the sheriffs in my county do this shit all the time, and there is nothing we can do about it for now. He is going to contact the DA on Wed, which will be a week from the date the warrant was carried out. He said it may be a few weeks before they press any charges, but they most likely will. According to him, they usually press charges in this county regardless of medical. Cases which are within SB 420 limits (which ours is) are usually thrown out at the preliminary hearing. At this point, we will go back over everything and decide if a civil case would be an appropriate action.

No idea how they found us, but there are roads that sheriffs patrol within a couple hundred feet, and neighbors are within a few hundred feet. The property was only 2 acres or so.

At this point it's really a waiting game. We made the first move by growing the plants, now their move is jacking the plants and now either pressing charges or not. After all the criminal bullshit is over with, then we can pursue or not pursue civil.

my sypathy for you my fine growing friend.

i feel the cops just jacked you. i hope nothing will come of it. sometimes they just drop the charges. i had a lucky friend get this special treatment.
so-cal has some good MJ lawyers.
i used one out of the NORML directory with excelent results.
