Pulled over by the Highway Patrol: DUI for MJ?
Friday was a typical day in between my harvests, low on herb. I went to a friend's place to get the last bag of some wonderfull Bubba Kush he had saved for me. I picked him up from his work at lunch and we went for a spin. He loves blunts, so I smoked one with him in my car even though I am not a big fan of tobacco, let alone inhaling cigar smoke. Then I proceed to load a few loads into my new bubbler I got for Christmas and drop him back off at work.
So I go back to work, then head home which is a 30 minute commute. As I'm approaching the top of a hill on a highway I notice a Motorcycle Cop (CHP) on the side of the road ambushing oncoming traffic with a radar gun. I had left my car off to be repaired and was in a rental loaner car..I looked down to see the odometer marking 80 MPH. Now this is the typical flow of traffic on highways here and I always drive around this speed even in the middle lanes, but this pigster was intent on filling his quota indiscriminately. We make eye contact as I pass and sure enough, he pulls onto the highway. I am perplexed but calm as I look into the rearview mirror and almost doubt he'll put on the flashing lights, but sure enough, weeeeooooooowwwww. The horrid sound of that gay siren and sight of LED lights flashing (for a second I ponder if they are strong enough to grow plants under LOL) So far so good, as I had smoked earlier and don't think the smell is too strong. That is until I look over and still see my bud, pipe, and lighter sitting there in the center console (main mistake). I still think nothing of it as I grab it and put it under the passenger seat and hide the bud in the center glove box. Things started to take a turn for the worst, though, as soon as I stopped on the shoulder with this pig in hot pursuit. My bubbler fell over in the process and a strong smell of stale bongwater now permeated the air. Fuck, fuck, fuck, was all I could think, and this got me nervous. So cop rolls over to the passenger side and tells me he stopped me for speeding. He asks for Driver's license and registration. I acknowledge I may have been going over 65 and am embarrassed as I am a safe driver, but was in a rental car and was not accustomed to the cars handling. He asks for the insurance, confirms rental status, and I give him an insurance card out of my wallet. He then said "This card is expired!" so I proceed to search for the valid one when he blurts out in an irritated loud voice - "Stop thumbing through your wallet." "You need to tell me right now about any Marijuana and other drugs that are in your vehicle and give them to me right now." I tell him I do, and pull out the eighth bag of Bubba Kush and hand it to him. I began to tell him I had a recommendation for it by my Doctor and he started to make fun of how I was talking (asshole) and questioned why I used it. I almost said I had HIV, but didn't want to lie, since I had not so far and believed I was right. Even though I knew I didn't have to discuss my meds, I played his game and described my condition to him briefly and continued to fumble through my wallet, I handed him a MMJ card with my picture that my Doctor's clinic offers (best extra $10 I have spent in a while) and he reluctantly took it. He told me that he would have a drug dog tear through "my little rental car " LOL if I didn't tell the truth. Then he told me to give him my "pipe filled with pot", so I sadly produced my $150 heady bubbler with nothing in it and handed it over. The cop goes back to his motorcycle now and begins his set of phone calls. He must have made 20 phone calls. He kept looking up the highway, and in my mind another car would soon pull up with 2 rabid German Shepherds ready to tear me a new hole. I can see him in the rearview mirror looking like a chimp at the card, looking at both sides of the card. I believe he even called my Doctor's office. That's when I remembered that I had just gone to the growshop and had bags of soil, perlite, mix, nutes, all kinds of shit in the trunk. FUCK! He must have made me wait a good 25 minutes while he looked up the highway and made phone calls. Then he came towards me again. "Let me tell you what you're facing." were his words. "You told me you are using Marijuana." "You know that when you go down to the station and do a blood or urine test you will test positive." "That means you are under the influence and cannot safely operate a car, don't you?" Your license will be suspended by the DMV, you will be dropped from your insurance policy as soon as I report to them you have a Medical Marijuana Prescription, and if you had a passenger or minor, you would be considered a felon and would go to jail. I told him I would test positive, for sure...I use it, it is my medicine I couldn't believe this motherfucker was trying to pull this shit. He continued - "You know you're not supposed to be driving under the influence don't you?" To these questions I told him politely that I was not under the influence, as I had smoked before lunch some 5 hours beforehand for my nausea, so I could eat. He continued to yell at me telling me that I was high, and that I was so high I was going 80 and didn't even notice it. He said HE'd been in pain before and HE never used Marijuana. I shot right back and said I have had prescriptions for Vicodin, Valium, Oxycontin and all they did were fuck my stomach up. He gave me a blank stare. He said since I used it daily, that I didn't feel it affecting me, but it was. He got angrier and repeated he was concerned about my drug use and driving, and I told him not to be concerned, and that I was more embarassed for speeding. Boy did he not like that! He said pot metabolizes like alcohol. I told him I disagreed and he got mad, "Do you know the metabolic rate of your body?!" I answered, " No sir, but I do follow my doctor's recommendation." He asked me what my doctor recommended, and I commented 3 to 4 hours before I can drive. He said it was not true as it was too vague, but I told him 3 hours for smaller doses and 4 hours for larger doses. He said "That's not what it says on this card! It says you can't operate any heavy machinery while using Marijuana." "You told me you use marijuana." I told him I was not presently using marijuana while driving. "It doesn't say that here on your card, it says you can't use marijuana and drive at all, period" Once again I disagreed with him on that interpretation and followed it up by saying "I follow my doctor's recommendations.." He said I was living my life in too much of a fast pace. He said it would catch up to me and I would loose my driving privileges for good. "I'm going to ask the DMV to review your driving status and am going to sit down with your doctor to discuss what recommendations he has set forth for you to see if you are telling me the truth." (I almost jumped, but kept calm, what a liar.) "Sign here." He said "This citation is for speeding." He dropped my bud onto my passenger seat, gently placed my bubbler back on the seat and my card. I signed the speeding ticket and laughed all the way home. What an asswhipe. He obviously was certain he had me in the bag and was going to fuck me. He treated me like shit and tried to corner me into admitting I was under the influence or too intoxicated to drive. Know your rights and don't admit to anything. NOW I remember why I love California. It all started with the voters. Democracy still works, people, the states need to be strong and fight the unjust government. Legalize our herb. That's awesome that it worked out, but what an asshole. Knowing your rights and standing your ground makes such a difference, cops will intimidate people into admitting things that are false, it's disgusting.

excellent story...never ever ever admit ANYTHING to the fucking pigs!!! me and my friends were being fucked with one time, i was wicked high, they detained us and had us split up in different cars...well this one piggie pulled off my shades and insisted i was high cause my eyes were bloodshot...he was trying the same DUI bullshit, getting me to admit that i got high that morning...i just told him i hadn't got high since the night before...i got all indignant and told him it was bullshit, the only reason my eyes were bloodshot was cause he was hassling me for no reason and i get stressed out easily...LMFAO...then he was like, 'i don't believe u, close ur eyes for 10 seconds'...i was like, 'whatever' and closed my eyes and then he was like, 'open them!' and i kind of figured he was looking for me to not be able to open them so i forced those fuckers open and bugged my eyes out at him, lol...we didn't even have an ounce of bud in the car, fucking pigs...

Outdoorgrower - Thanks! I feel proud of being a Californian. I vote and will continue to fight until the paranoia they put me to get my meds, and the humiliation they put me through ends. You are right, he invented a bunch of lies and was clearly trying to corner me into saying something incriminating on myself or just humiliate me. He made fun of the way I was talking, the scumbag.

Nugaliciou - I thoroughly enjoyed your story. The idiot was just like this scumbag, all humiliating and shit. He was my age too, I wanted to beat his ass.. I have to admit I was nervous, but I was willing to battle to the end. It's so tricky, you need to measure your words when dealing with these scum or they can make it into a headache if they want (lost time and hassles) I was polite and realistic and calm. He knew I was informed and I kept shifting my defense to my Doctor and my rights. He intimidated me to the end and tried to make me leave with the idea that I was being monitored, so I'd be paranoid later. Stand up for your rights people. hey jack i was so happy when i read the end of your story. I have a couple mj charges and they both happened towards the end of the month when the piggies will do anything for their quota. both times in posession of less than a gram. luckily both times I had decent cops; meth and crack are huge problems where I live they probably didnt think about hassling some stoner with a little herb.
good thing you're med, or else it might've gotten a little ugly i think. we are very fortunate to live in a compassionate state. peace brother |
