A family member of mine got off lucky. They got probation instead of jailtime for being involved in an operation that got busted. The problem is that he lives with me and now im scared about the random house searches that can happen on probation. (Its hard to hide all of my bongs and such) My question is can they search my house just because he is staying here temporarily? He pays no rent or anything im just doing him a favor for a little while. I just do not want this favor to come back and bite me in the ass. If they can legally search my house is it just his room or is it the entire house? Anybody who has ever been on probation and has or has not experienced random house searches please let me know whats up and if i should stash all my pieces at a buddys house soon. Thank you...

a P.O. can search anytime and anywhere there is a probation or parolee staying.

I don't think you gotta worry about anyone searching your room or your place. Usually the p.o. will just come in and say they had their home visit. Never seen a p.o. search anything or even heard of a p.o. searching anything.

I know of a P.O. search in last couple weeks, and gal is on probation for misdemeanor drug charge, reduced from felony. P.O. entered residence with police because gal had said she could not piss for test when she went for visit... He came that nite only to be met by husband who presented medical MJ certificates for both he and gal... police STILL searched under probation authority... found medical garden, was given copy of state law supporting medical right, plus threatened them with law suit if they "siezed" his plants.... he had about 50 all together.....
more cops showed up...... phone calls went out...... pictures ended up being taken.. cops left.... haven't come back...YET....

Now if you are just "staying" somewhere where you may not have "total" dominion and control. P.O. can ONLY search areas PRIVATE to you and OPEN areas you or ANY GUEST would have access... not other peoples rooms... not the basement, if its not open to you :-) and not the garage if you don't use it..

i cant imagine how a p.o. could justify looking in your closet, in your room.

Sure, you can argue the point that the guy didn't have a right to search the whole house, yada yada - but at that point, you've already been arrested, all your shit is gone, and you're paying for an attorney.

Why go through all that when you can avoid it just by stashing your shit elsewhere?

Something else that you're not thinking about is the fact that probation terms vary from state to state and even case to case. In my state, they can search the whole place, plus cars he uses, whether he owns them or not.

Obviously from the responses here, that's not the case in all states.

But like I said before, why risk it?

Ugh, are you retarded, I'm sorry but people on probation are 'damaged goods', I being one myself. You should never have been a nice guy, now you will have a cop checking up on your place from time to time... and this is in CANADA.

place a dead bolt on your door keep it locked weather your in the bedroom or not even if your in the main part of the home. have the dead bolt locked on your bedroom door the PO cant enter your personal erea if the person on probation has no acess to the erea. as for the rest of the unsecured home well he can but apon entry if everything looks in order clean and neat. the PO will usally just ask the person on probation where his sleeping quarters are at then conduct a search there. 1 thing for sure the PO will more then likely make a visit or 2 if he dose it will be unannounced and at any time he deems to conduct his check up. ive had many friends on paroll and probation what i explained above is excatly what ive seen go down when the PO comes a checkn. just use common sense ya should be ok, oh yes 1 thing because your here @ icmag r/u growing ???? if so throw him to the street buddy srry to say

I have a similar question Im on probation living with stoners, in the room next to me theres pipes,grinders,bongs ect. Im worried my PO could search their room and find everything. Will I get in trouble for this? they know im on probation they kno my PO could search anytime but they dont care. I dont have anywhere else to live either.
