Growing in my apartment in CO?

I've never grown my own before, but I've wanted to for a really long time.

I live in an apartment in Colorado. And when I first moved in, I thought I had read in my lease that growing marijuana was specifically prohibited. However, I recently decided to take a closer look at it, and I'm thinking that perhaps it isn't.

Here is the only line in the lease that (maybe) deals with the issue of growing: "You or your occupants or guests may not engage in the following activities: (bunch of unrelated stuff)...manufacturing, delivering, or possessing a controlled substance or drug."

Here's what's tricky about that statement to me, as I am not a lawyer:

Marijuana is considered a controlled substance at the federal level. But since Colorado's state laws differ from federal law, I don't know whether or not marijuana is considered a controlled substance at the state level (or whatever).

At the same time, the line does not say "possessing a controlled substance or drug without a prescription," and Adderall is a controlled substance. So it seems like, under a strict literal interpretation, you're not allowed to have Adderall in my building even if you have a valid prescription.

The short of it is that I don't know, given the way that the lease is written, if growing weed would qualify as a breach of the lease and give my landlord grounds for evicting me.

I'm strongly leaning towards going for it either way.

I've lived here for several months, and the only visits I've gotten from anyone one on the staff have been from maintenance people doing routine stuff in the main area of the apartment.

I would just be growing a few plants in a closet in my bedroom, and they've never asked for access to my bedroom. And honestly if they did, I'd throw a fucking fit about it.

The median age in my building is about 23, the halls regularly reek of weed, and I smoke in my place all the time and have never had any problems from anyone.

And I'd just be growing for personal use, and only the legally allowed number of plants.

So as far as calculated risks go, I think growing here is a pretty good one.

However, if I could be (reasonably) sure that they couldn't legally toss me out on my ass if my grow was discovered somehow, I'd rest easier about it.

Thanks in advance for your input.

Normally, that's meant to say your not allowed to do illegal drugs, etc. (i.e. host crack or rave parties)

If you have a medical exemption your probably safe.

Consult others though.

id like to add if you consult others do it with only those you can absolutely trust. Because i thought i was being smart when i started too, but remember tell one person, theyll tell two and so on and so forth. next thing i knew i had people i made sure not to tell, asking me about growing, so i had to close shop for a lil while and relocate to a new house that i invite no one over to, ever.

before you invest look up some threads about security, if you live in the kind of house that people you dont really know, or have friends come over with acquaintances that you might not want knowing you have a grow going it may not be the right situation for you at the moment. not trying to sound negative, just trying to say something that i wish someone had told me, when i started.

good luck by the way. if you have any questions be sure to look using the search function first, then ask away, the guys around here have been nothing but helpful and generous to me.

I'm in an ILLEGAL state .. only Medical.. and my lease says the same.. its only really to save the ass of the landlord incase u get caught dealing.. and the cops/dea want to try and take the house.. if the landlord knew about it and let it go on they lose the house.. if not.. they usually keep the house!

growing = manufacturing according to the laws
a mmj card won't help allow you to grow, it does not give you rights to grow in your rental.
CO laws are very clear, if it's in your lease, you can't do it.
People have been evicted in CO for those type of grows

I say cross the line...DO IT!

god apartment grows, lmoa

we've all been there...live and learn

have fun

Growing=Manufacturing under the language of the law.
AND
I say do it too...
You can't learn any younger & hands on makes for a quicker learning curve.

In your situation, as long as you can obtain seeds for an affordable price, I would run a small space 12/12 from seed or obtain clones and just flower them out.

Just a side note...
If you are dealing with the FHA (Federal Housing Authority), keep a keen eye out.

Thanks a lot for all your input.

Yeah, I'm totally doing it.

I guess I could get in some shit if my grow was discovered, but the chances seem pretty minimal in my situation.

And one would think that with a dispensary opening on every corner around here, an abundance of product and competition would drive the cost of weed down.

But apparently Capitalism doesn't apply to pot in Colorado. Cheapest dispensary around here that does recreational wants $100 a 1/4 for shit that's just pretty good.

I was paying that for better quality stuff in a state where it's still illegal.

Price fixing among the dispensaries? I don't know, but they can go to hell.

I'm growing my own

Get growing dude

A cabinet is pretty easy to keep discreet, as long as you keep it away from areas where landlords may be. Bedroom closet is good choice. Smell proof, light proof, and a lock are desirable qualities.

And this always bears repeating: Don't Tell Anyone.

Salute!

Until it is reclassified by the US Government its an illegal drug. The next pres could come in and wipe it all away just like that and we could be right back where we were 10 years ago.

Get the smell under control from the start. Apartments waft smells through the vents really easily. Make that #1 priority.
