This is the meeting to determine setbacks for your garden. It is very important to make sure that setbacks are from a neighbors residence, and if your neighbor does not have a issue that you can set reasonable setbacks. This is a critical meeting, make sure you attend!
I would suggest setbacks for personal gardens go back to distance from nearest residence ...
For commercial Grows the state EIR has recommend a baseline and is unlikely we will get less stringent ...

It’s raining gate notices.
We have had multiple members coming home to that pesky little letter from the Sheriff’s hanging on their gate. Some have received multiple gate notices on different properties. It’s not going to be an easy summer/fall with the Sheriff’s panties in a bunch over the progress the cannabis community is making in Nevada County. So brace yourselves while we continue to influence the process of coming up with a new ordinance. It’s not easy work. IF YOU RECEIVED A GATE NOTICE OR A NOTICE OF ABATEMENT, PLEASE LET US KNOW AND CONTACT AN ATTORNEY IMMEDIATELY!

PARTICIPATE: Your presence and your comments to the CAG (Community Advisory Group) are essential. They cannot give us what they don’t know we want. So speak up and do it now! We are here to make sure the new regulations will allow us to maintain our entrepreneurial spirit!
FILL OUT THE SURVEY: In order to get what we want and need in the new ordinance we must show how many of us there are, on what size parcels are we cultivating, and in what size gardens. The success of our efforts will be measured by how many of us enter the permitting system. This survey will only be out for a limited time. Please fill out this SURVEY and pass it onto your friends and neighbors.

The Community Advisory Group (CAG) will hold its eighth meeting October 24 from 1:30 – 5 pm at Foothill Events Center, 400 Idaho Maryland Road in Grass Valley, CA.
The CAG, was formed by the Board of Supervisors formed to advise the Board on the development of a permanent Cannabis Ordinance for Nevada County that will take into account the input of all community stakeholders.
Nevada County contracted MIG, a consultant and facilitator firm, to mediate the Cannabis Regulation Community Advisory Group and ensure a fair and equitable process while advising and drafting a new cannabis cultivation ordinance.

Meeting objectives: Will be updated


1. Allow 6 plants outdoors for personal / medical
“The Board shall not make any grants to local governments which have banned the cultivation, including personal cultivation under Section 11362.2(b)(3) of the Health and Safety Code [outdoors upon the grounds of a private residence], or retail sale of marijuana or marijuana products.
2. A three-year transition period for farmers to come into compliance.
3. Accessibility and Affordability: making sure permit fees are affordable and that the process of permitting is easy to navigate.
4. Canopy size of at least up to 10,000 square feet.
5. Setbacks: they need to be measured from neighboring outdoor living area.
6. Code Enforcement: Needs to be done by Community Development Agency and NOT law enforcement.
7. We need to allow All License Types: Cultivation, Distribution, Manufacturing, Processing, Packaging, Micro-business.
8. A tax structure and fee structure that encourages participation.
9. Ask for the formation of a Blue Ribbon Committee to continue the work of the CAG.

Cannabis Regulation CAG Adds Final Meeting
The Cannabis Regulation Community Advisory Group (CAG) has met nine (9) times over the last seven (7) months to discuss and develop recommendations for a revised Cannabis Ordinance. At the ninth meeting, MIG presented a summary to the CAG including several areas where a high level of agreement was developed as well as a summary of the CAG's input regarding land use parameters where cultivation and other cannabis businesses could be allowed. This review was the first step of developing the content for the report that MIG is require to provide to the Board of Supervisors per their consulting contract.

Additional CAG Meeting: December 19th

At the ninth meeting, CAG members requested another meeting to review MIG's formatted report prior to its presentation to the Board of Supervisors. In reviewing the specific language in MIG's contract, and listening to the CAG's request, MIG and County staff are recommending a final tenth (10) meeting be scheduled for the CAG to have a second and final review of the report content. Both MIG and the Foothills Events Center are available on December 19th, therefore, a contract amendment will be brought to the Board at the December 12th meeting to add this tenth CAG meeting to MIG's contract.

Timeline Update

As the CAG process wraps up, County staff will move on to drafting the ordinance. Over a year ago, when the Board of Supervisors decided to hire a consultant to begin the community engagement process, the goal for completion was March 2018. As we are just concluding that process now, the ambitious March 2018 goal to have an ordinance in place will not be met. There are several factors and decision points that have, or will, affect the timeline including:
The delay and addition of CAG meetings
The scope of changes to the current ordinance, as recommended by the CAG, and subsequent environmental review (CEQA) requirements. (Depending on the extent the Board of Supervisors directs staff to implement the CAG's recommendations).
Specific near-term milestones include:
December 12 BOS meeting: Bring amendment to MIG's contact for tenth CAG meeting
December 19: Additional CAG meeting (pending BOS approval of contract amendment)
January 9: MIG presentation to the BOS and submission of CAG Recommendations Report
Board Direction

Following MIG's report on January 9th, County staff will request Board direction regarding which recommendations to include in drafting the new ordinance. Factors such as allowing commercial activities, cultivation size, setbacks and zoning will determine the level of environmental review (CEQA) that will be required for the new ordinance. Most likely, a consultant will need to be contracted with in order to complete the environmental review as efficiently as possible. These decision points will determine the timeline for the new ordinance implementation.

Well looks like this is best Nevada County is going to get ... So annoying having to keep the NC Alliance legit ... but Might have been worth my time, stress, and $$$
