CO MMJ patient loses case

A quadriplegic MMJ patient can not get his job back says the CO supreme court. The patient said he never used MMJ on the job or came to work impaired. The Dish (TV) Network fired him after a "random" drug test came back positive. The Dish Network has a "Zero Tolerance" drug policy. This case might have national importance. I hope CO passes a law as this result seems cold to me. That company is known locally as a poor place to work. The management is VERY repressive and the company has some insane dress codes.

Yeah, that’s really bogus especially since the state has legalized both rec and medical via the vote of the people. The reason the Court ruled was it needed to not violate both state and national laws. Since it violated national law it had to be upheld.

And now Stoners are the 2nd class citizen, or is that third class with the way we are treated. Instead of Jim crow laws it's stoner crow laws!

We need to vote with our dollars. Fuck dish network. I will never use them after I have seen how they treat people with medical problems.

You have to think about this from a business perspective. This business has a very large insurance policy, that most likely has a policy that they will dump coverage if employees have marijuana in their system.

Since there is no good test to say if you smoked an hour ago, or 3 days ago if you are a heavy smoker, they have to error on the side of caution.

Also Dish Network is a Publicly Traded Company. This means they are regulated by the Federal Government. Since Marijuana is still illegal federal, they need to comply with federal rules, or they can get in big trouble from the SEC.

This is also the danger of working for a large company - the person who is making these policies is many times removed from the lower level employees, and has to make the decision that is best for the company on a more abstract level.

Just to add - what I am saying as this case is not as black and white as it seems.

The drug war treats marijuana users like second class citizens, and it is ridiculous that people go to jail and have their lives ruined over a medicinal plant. This is black and white

A business enforcing a policy that is making sure they comply with federal laws that they are bound by.... hard to blame them.

Change the laws on marijuana federally, and these type of events will stop happening.

My god I used to make an extra g every payday off the other installers.

This is just one more example of how the United States is run by, for and about the ultra rich who have bought our entire political system and run it to their benefit, the needs of the common man be damned.

It's time to start calling republican party the fascists that they are- it's a great retort to the 'socialist!' epithet! And, it has the advantage of being factually correct.
 
Colorado is an employment-at-will state. An employer is not even required to give a reason for the separation from employment. They could have fired him anyway, for no reason.
