EINDHOVEN – Het Verbond voor Opheffing van het Cannabisverbod (VOC) begroet het vandaag verschenen initiatief wetsontwerp voor regulering van “de achterdeur” met grote instemming. Het wetsontwerp kan een doorbraak betekenen, maar laat twee aspecten onderbelicht: de thuisteelt en de Cannabis Social Club.

Verwacht mag worden dat dit kant en klare ontwerp door D66 zal worden ingebracht bij de volgende kabinetsformatie. Maar ook nu al kan het een belangrijke rol spelen in de opstelling van D66, wanneer de huidige coalitie weer eens om steun voor de instandhouding van het kabinet vraagt. In beide gevallen kan het wetsontwerp een doorbraak betekenen in het verstarde repressieve beleid van minister Opstelten van veiligheid en justitie.

Wel constateert het VOC met teleurstelling dat het wetsontwerp twee belangrijke aspecten onbelicht laat. Het faciliteert weliswaar de achterdeur van de coffeeshops, maar geeft geen basis voor regulering van de teelt in zogeheten Cannabis Social Clubs. Deze niet-commerciële, coöperatieve vorm van teelt, gericht op persoonlijke consumptie van de leden, kan een belangrijke rol spelen in de landelijke gelijkberechtiging van de consumenten. In slechts honderd van de ruim 400 gemeenten van Nederland bevinden zich coffeeshops, totaal niet meer dan 616. Ter vergelijking: het aantal verkooppunten van alcohol wordt geschat op 70.000, van tabak op 60.000. Terwijl het hier toch om aanzienlijk schadelijker drugs gaat dan cannabis.

Ook de tot nu toe gedoogde thuisteelt van een zeer beperkt aantal planten voor persoonlijke consumptie wordt in het wetsontwerp niet gereguleerd. Deze teelt wordt bovendien vanaf 1 maart op bizarre wijze gecriminaliseerd doordat het OM in het kader van de nieuwe “growshopwet” de aanpak van de in deze winkels verkochte spullen -in strijd met het uitgangspunt van de wet- niet wil beperken om de grootschalige commerciële teelt te bestrijden, maar om de growshops zelf de nek om te draaien. Daardoor komt de bonafide thuisteler, met een paar planten op het balkon, in de achtertuin of in een kweektentje, nog verder in de kou te staan.

VOC woordvoerder Derrick Bergman: ’Het VOC heeft bij de voorbereiding van deze initiatiefwet een aantal keren een bijdrage mogen leveren. We hebben steeds gehamerd op regulering van zowel de achterdeur van de coffeeshops, als de thuisteelt, als de Cannabis Social Clubs. Dat blijkt immers ook te kunnen in bijvoorbeeld Colorado, Alaska en Uruguay. Cannabis Social Clubs zijn ook in Europa een bekend verschijnsel. Waarom zou dat in Nederland niet kunnen, bijvoorbeeld in de honderden gemeenten zonder coffeeshop?’

De stichting Verbond voor Opheffing van het Cannabisverbod (VOC) zet zich sinds 2009 in voor een rechtvaardig en rationeel cannabisbeleid en tegen betutteling, symboolpolitiek en repressie.
