U.S. judge in Calif. considers argument marijuana law unconstitutional
Ruling expected within 30 days. This WILL be appealed, but it would be a huge step in the right direction.

The US govt actually has a patent for using cannabis medicinally. (even though it is a schedule1 drug and has no medicinal value blah)
So this is a good defense strategy i guess. The govt is contradicting itself (as usual). I hope the scales are tipping in "our" favor! |

At the time the apparent crime was commited, the evidence shows that these men were TRESPASSING WITH CRIMINAL INTENT. (There not really any other legal form of trespassing once you realize how the law works.) Their argument for a medical grow is out the door. Id bet they get Fed probation for criminal trespass & illegal cultivation on public lands. Had they been on their own privately held land their case would be significantly bolstered. Also, weapons, in the wilderness, are pretty damn common. They should have zero impact in the decision of the judge. |
