Cultivation by enhanced indoor means NSW and Greenhouse / Poly Tunnels
So i grabbed this off a lawyers website
The meaning of “cultivation by enhanced indoor means” Cultivate by enhanced indoor means cultivation of the plant: That occurs inside a building or structure, and That involves any one or more of the following: The nurture of the plant in nutrient-rich water The application of an artificial source of light or heat Suspending the plant’s roots and spraying them with nutrient solution. Me and my friend were talking about it and were wondering if we went full cali style in a green house , 400 gal smart pots, only 4 or so big ones, would we fall into the enhanced cultivation category. NO lights, no heat , and using dry fertilizers instead of teas to get around the nutrient clauses. Could we go more than 4 or 5 if it doest meet the wording of the above and then just fall into plain old outdoor cultivation. Also the legal definition of structure? Also would cooling and ventilation be classed as "heat" What do you guys think? |

Think that be classified as outdoors since its a greenhouse but fuck knows with cops we got.
I grow indoors n used to grow "trees" for the reason of keeping numbers down till i was told they go by weight aswell, so over 500grams was commercial ( indoor or out) anyways.....thats medium, leaf, roots buds n all, so i was fucked with 1 plant let alone 10. So as they have away to get ya either way ya decide to grow im back to bigger numbers, less turnaround between harvests. Im not a cop or lawer just word of mouth from peeps who have been though it all |

Greenhouse is classed as outdoors and carries no extra fine like indoors does.....so go for it.

Its not just what the law states but how its interpreted in the region that you live in.Keep an eye on your local paper's law and order section and over time you will get an idea how the courts and cops in your local area work! where I am most peeps seem to get a $1000 fine and/or a bond of sorts and that's been for as many as 30/40 plants...if there are guns involved your looked at as commercial and wont get bail ...I would grow em as big as I could under lights then plant them out and piss your lights off

Yeh something that i have seen pop up in some articles is the degree of sophistication NOt so much in NSW but certainly in just this week in VIC where a women had 27 in the backyard and was let off with a $500 fine
Walton pleaded guilty to cultivating and possessing the drug. She escaped without a conviction. Magistrate John Murphy said a conviction could have jeopardised her teaching career. She’ll have to pay a fine of $500. Walton’s lawyer, solicitor Paul Robb, said his client, a regular cannabis user, had grown her own drugs so that she would not have to contact local dealers. He said Walton had cultivated only young plants and had been surprised about how well they had grown. “She basically wanted to be self sufficient,” Mr Robb said. “It doesn’t have the hallmarks of a sophisticated set-up.” |
