Michigan Supreme Court rules medical-marijuana dispensaries not allowed under 2008 law

Lansing — The Michigan Supreme Court has struck down the legality of medical marijuana dispensaries but upheld sales between caregivers and their own patients.

In an opinion released Friday, the high court said dispensaries are illegal because the Michigan Medical Marijuana Act of 2008 only offers protections to registered caregivers and their qualified patients.

The justices also ruled patient-to-patient transfers of medical marijuana are not legal under the voter-approved law, appearing to contradict a Court of Appeals decision last week that concluded there's nothing illegal about a medical marijuana user providing a small amount of pot to another registered user at no cost.

The ruling means the state's 126,000 approved users must grow their own pot or have a state-licensed caregiver grow it for them.

The Supreme Court's 4-2 decision involves a Mount Pleasant dispensary that allowed medical-marijuana users to sell pot to each other. Owners took as much as a 20 percent cut of each sale. Isabella County shut it down as a public nuisance.

Chief Justice Robert Young Jr. and Justices Stephen Markman, Mary Beth Kelly and Brian Zahra signed the majority opinion.

So does this mean that Dispensaries in Michigan will have to shut their doors? Or was this an isolated incident involving once location? To my understanding Michigan has many dispensaries? Seems like with this new information you posted, that Michigan is only allowing the very bare basics when it comes to Medical Marijuana.

Unreal. Overwhelming majority of Michiganders voted for safe access to MMJ, and the so-called 'leaders' have taken the initiative to secure their Moral Stance as the Law. Over the wishes of at least 63% of the people.

That's Balls.

If that same overwhelming majority vote against Pols that are ANTI-MMJ, these Pols will lose their jobs, no..? How Short-sighted of them.

They will be replaced by Younger, more tolerant Pols. Dummmmmm.

How can anyone not like the Grapey-Skunky Smell of God's Gift in the Sun.. Neighbors offended by 420 Odours..? Please...

Personally, I find the Odour, Mrs. Smith, of your Roses to be bothersome. I will go to the Authorities asking for their extermination. If You disagree, I will seek their physical help to eradicate Your Offensive Smelling Roses... AS IF... !

So this is surprising- How? 1st- there was no language written into the origonal law to allow dispensaries or even compassion clubs-- NORML and the other Lawyers on "our side' should have caught that and made them change the language to either allow or ban it so there was no grey area for those asshats to mess with...

2nd- we TRIED to recall Shutte and Schnieder-- couldn't get enough people to get involved or even sign the petitions-- Now see where we are? Those two have passed more laws in 2 years than our last 2 Governors combined- and 78% of those were behind closed doors without public knowledge of the votes, and 32% were done WITHOUT the Democratic representatives even being told about or being present at the votes!

These 2 men are trampling our rights and pissing on the State and Federal Constitution-- SOMEONE needs to get the COJONES to bring up public charges and get an impeachment proceedings started.... But with all the Right-wingers in the Capital- don't know if even THAT would do any good!
