i know this is a duplicate thread, so please delete the old one because there are more people in this forum.
Is it safe for me to drink the night before, and take the breath test at around 5:30-6PM the folling evening? SOme say yes, some say no, some say its a tossup, 50/50 chance. |

further info
i went in for my sentencing, and had drank like half a litre of 40 proof liquor all the way up until like 2 am, i came in at 9:30 and blew a .084, ended up in jail over that, so in theory, had i tested around 6 PM that day, wouldn't i have been OK? I wouldnt risk it. Yoe are just trying to push the envelope a little far wouldnt say.
You are on probation as an alternative to jail. Why risk going to jail over a nights worth of drinking. DONT drink the night before. Its a bad idea unless you want to go to jail. Dont fuck around with your future like that. You have the chance to make things better for yourself and you want to risk that for a night out and probbly a hangover the next day. What could be so worth it to risk jail for a few drinks. There is no guarantee that the alcohol will out of your system completely so dont risk it. |

I guess you already have your answer.
Our LEO often present a demonstration of the breath analyzer at public and private gatherings. As I understand, alcohol is absorbed by the stomach very quickly. After a drink, the concentration in your blood rises when it is absorbed. An average sized person (150 pound male in my case) will see a blood alcohol level rise of 0.02% shortly after taking the drink. Our body has two ways of removing the alcohol. The lungs and liver are the main routes out of the body. That is why the breath test is reliable, it is a direct measure of the ratio of alcohol remaining. It takes time for the alcohol level to drop. When you quit drinking, the organs can start to make progress and reduce the level by 0.01% per hour. If you drink until your level is 0.10% and wait two hours, your still going to score 0.08% and face an impaired driving charge. If you drink 500ml of liquor, 30ml being a typical shot, that is about 15 drinks. That is enough to raise an average male to 0.30% less 0.01% per hour of elapsed time. Quiting at 2:00AM gives you 7.5 hours before the 9:30AM test. 7.5 hours is not nearly enough time to reduce the concentration below the threshold of legally drunk. Body weight does affect how quickly the concentration builds up. A small person will have a much higher concentration then a larger person, but the removal still occures at the same rate. We proved that by comparison drinking and blowing into the test machine. With the same amount of alcohol, three drinks, I was blowing 0.06% and my 200 pound buddy only blew 0.03%. If you have to test, give yourself 24 hours to clean up. At the same closed meeting, LEO lit up a piece of hash and passed it around so we could familiarize ourselves with the distinctive aroma, took me a couple tries to fully appreciate it.

Rinse your mouth with Listerine right before you go in (if your sentence does not forbid the use of mouthwash).

I don't know if this info can help you out but the link below is to a story on MSNBC about how defense lawyers have found a way to beat breathalyzers.
