Florida- need real examples of actual sentences for under 25 plants

I need help.
I know florida law says inder 25 plants is a felony punishable by up to 5 years. It also says possession is the same a felony punishiable by up to 5 years. But i knew several people who got caught with a few ounces and none ever did any time. Usually probation and bs.

So if growing in florida, and not selling, and staying well under 25 plants, WITH KIDS LIVING ON THE SAME PROPERTY BUT NO WEAPONS. What are some actual sentences handed out? Is there a site with examples. I need to show my spouse the real risks we face. Would we just get serious fines and probation or could they take our kids.

tuff call.......cultivation is taken serious here and it seems fl dcf likes to get involved when possible but not speaking from 1st hand exp.

if you have legit medical reasons then at least you could bring up in court that it was for medical necessity........no guarantees but the fl supreme court has ruled in favor of more than 5 people who appealed their cultivation conviction based upon a medical necessity defense.

yeah all i can find is the "felony- up to 5 years" but im really interested in real senteces given out and i cant seem to find them.

I don't know about Florida, but California has went from one extreme to the other due to finances.
Up until a few years ago, some counties were handing out 25-life for a third strike that was possession of a barely detectable amount of a controlled substance. Recently, in some counties, third-strikers with drug cases have been given several shots at Prop-36, in which they have to attend classes. A bit of a sentencing discrepency.
Each case is going to be different and each county will handle things differently. Try calling a defense attorney or the Public Defenders office in your county to get an idea.

we are basicly just trying to figure out if a bust ever happened
would it be more like a or b

A. a real shitty day and year ahead. stiff fine and probation and family court and pissing in a cup for a longtime. Probably just charge the main grower and not spouse

B. end of all life as you know it. Both people facing years in jail, lost kids and house.

That never happens. Regardless of state/locale, they almost always charge EVERYONE at the scene, and use the charges against the spouse et al as bargaining chips when to comes to deal time. IE- we'll let the wife off if you pleased guilty to X,Y and Z.

For the best advice you should consult a lawyer.

Look for arrests. Find the name on the report and begin to do a search by case number. It will tell you all court proceedings and sentencing. There were numerous arrests diring the time I was still there in Port Charlotte. Cape Coral, Sarasota and West Palm Beach. Should be easy to find out what the sentences were from case history.
