Monterey Club Ordered to Close

MONTEREY, Calif. -- The city of Monterey is bracing for a legal battle after issuing a cease-and-desist order on Tuesday to a medical marijuana clinic that opened without city permission.

A day after Monterey served operators of the My Caregiver medical marijuana dispensary the order, the clinic and the building owner has hired lawyers.

The medical marijuana clinic, meanwhile, continued to operate on Wednesday in the 500 block of Lighthouse Avenue.

Operators said they are non-profit and don't need a permit to operate.

The city, however, said they are violating zoning laws, and never told anyone that they would be distributing marijuana.

"If they had been truthful -- completely truthful -- at the time, my guess is the property owner wouldn't have leased them the land and they certainly wouldn't have gotten business license or permit to operate," City Manager Fred Meurer said.

Jhonrico Carrnshimba, of My Caregiver Inc., said the company didn't hide anything when they applied for a business license.

"Realistically, we didn't leave it out. We covered it under herbal remedies, which is what medicinal marijuana is," Carrnshimba said.

The operator of My Caregiver Inc. sent a letter to city leaders warning them that they will be sued for damages if members are refused the right to medical marijuana.

But in the same letter, operators extended an invitation to City Hall to take a tour of the facility, which has been accepted.

In the next couple of days, Meurer and several managers will tour My Caregiver Inc.

The tour will give city staff a chance to see how business is being conducted, while operators will get a chance to understand the process for trying to change local zoning laws, should they wish to pursue that.

As for enforcing the cease-and-desist order, city leaders will contemplate their next move after receiving input from City Council and the public at next week's council meeting.

I was in Monterey and was disgusted at the prejudice and closed mindedness that rules that peninsula or whatever that area is, Seaside etc. They are totally anti-Cannabis, we need to vote the politicians out of office. Patients in California, specially Monterrey residents need to stand up like this brave person. Many town like Monterey lost the war and now have to eat it. I remember reading and keeping the local paper that featured a huge Cannabis leaf on the front with Christmas tree ornaments and the title "Will Monterey give Medical Marijuana it's place under the tree?"

Monterey is the new San Diego. This dispensary owner knows that, and by suing them right back HE WILL WIN!'

BEST OF LUCK MR. CARNSHIMBA! We need more like you! They are falling right into the game we want them to play, they wanna play, then let's take it to court! They can't win in courts any more in California, fight 'em! It's our right!

I feel like the Monterey area is the conservative reaction to Santa Cruz. They are just across the bay from each other, yet what seems to be polar opposites when it comes to politics.
