Can Medical Cannabis Growing be Banned in California?

I am the Guest that has offered to move there and start 99 plants in beer cups and to let them arrest me.
All I ask is that someone there has the property that I would have planted them on sponsor me.

It is a comment on that site.. Seriously wouldn't that be all it takes to make a couple million dollars in suing that City?

We need to get past the Mindset of FEAR!! That's the last tool they have left and when we see this " It's illegal" type of action in areas that will not honor State law and that makes me feel like posting links!

They can't ban growing medical cannabis. Maybe stop people from having a business licence but if someone wants to grow for others they can! It's called a collective and it's LEGAL!

Am I right?!

LAKE ELSINORE - City Council members voted unamimously Tuesday to impose a 45-day moratorium on legal marijuana-growing operations in Lake Elsinore while officials decide how to regulate such activities.

Council members said the time was needed to make sure a moratorium is properly implemented.

"I think our staff needs the time to better digest this," Councilman Robert Magee said.

The vote came after several speakers told the council that the use of marijuana has helped relieve pain caused by cancer and other ailments.

Speaker James Stacy said California voters have authorized the use of marijuana for medical purposes and called the proposed moratorium inappropriate.

But Mayor Melissa Melendez said "we are in compliance with the law."

The proposal for the moratorium was brought before the council in response to a request for a business license to operate a legal marijuana-growing operation in the city. The move gives the city staff 45 days to study how to regulate marijuana-growing activities and to return to the council with more information.

The business license was sought by Robert Riedel, co-founder of Mother Earth's Alternative Healing Cooperative in Fallbrook, who wants to operate the growing facility in an industrial area near Skylark Airport.

Lake Elsinore's municipal codes and general plan do not discuss marijuana manufacturing activities, how they are regulated or where they can be located.

The city prohibits the establishment of medical marijuana dispensaries but allows the possession, use and cultivation of medical marijuana in accordance with state law, according to a staff report.

Here is what maybe a landmark case!

Anaheim may be the battle ground that decides if local governments can stop people from having medical shops because it's a nuisance to those who don't like cannabis.

Funny can we ban churches? I don't like many of them and I feel they are a nuisance.. As an example I say

Please see the L.A. Times site for the full story.

Anaheim case may play key role in regulating medical marijuana

Quote:
A state appeals court appears likely to grapple with the dispute over whether cities and counties can prohibit medical marijuana dispensaries as it reviews a lawsuit challenging Anaheim's ban, a case that could have a major impact on how the drug is distributed throughout California.

On Monday, the day before their decision was due, judges in the Santa Ana-based appellate court asked the lawyers involved in the case for more information on what the Legislature intended when it wrote the 2003 medical marijuana law.

The law was meant to clear up how marijuana could be provided, but it has spawned considerable confusion.

Numerous lawsuits have been filed to try to resolve murky issues, but the Anaheim case is one of the most closely watched because the outcome could inspire more bans or threaten existing ones. About 130 cities and counties have adopted bans that outlaw storefront medical marijuana dispensaries.
I think this is slanted as "could inspire more bans or threaten existing ones" could have been written " Could remove exiting ones and prevent future ones"

Is Mr. & Mrs. Straight-Lace really that up tight that they have to make the world in their image?

I have news Global warming is a bigger threat and then there is that pesky Poverty issue we face in the USA.. Oh how can they be important when some one some where is growing a pot plant..

Who even needs to VOTE on things lets just ORDER it done with out authority!

LOL Democracy may get in the way of many small minded places in California.

Hollister California seems to be another example of Cannabis fright! After 13 years of medical cannabis being legal we are seeing the last mad rush of panic against medical and locals operating outside their own procedures trying to save unknown and unnamed children from the green!

I guess they haven't heard that to find the best cannabis in a town with no medical cannabis shops one has to ask a child because only they know where to find it.

How Hollister thinks that allowing qualified cannabis patients a place to go means that some child is directly effected is beyond me when we all know the kids know where the best weed is already.

The way to save little Johnny and Jane is to put the cannabis in a store where we can control access to it.

So California Cannabis Haters.. You are not understanding because you don't know what is actually true and your leaders are clueless too.

It's legal and to stop the black market that has no age or medical requirements to sell cannabis we need to put it in a shop and control access.

To think that we can stop our youth from popping our pills, drinking booze or other things by banning cannabis for medical people is like saying we can cure global warming by burning more oil.
What we can do is make it more difficult to obtain medical cannabis for those who don't have access by allowing proper places to go.

Hollister council rebuffs change of zoning for pot club
Dec 23, 2009
By Marty Richman

Hollister City Council members in considering a proposal for a medicinal marijuana dispensary here directed staff members - without an official vote - to leave the zoning code as it stands and continue to bar the operations because they conflict with federal law.

Council members received an informational report from City Attorney Stephanie Atigh on Monday, but nobody from the group broaching the idea for a dispensary - Purple Cross Rx - spoke about it at the meeting.

The council was given three possible options: Start the rezoning process, adopt an urgency ordinance or do nothing. They chose the latter, which essentially rejects the idea at this point.
