The current War on Medical Cannabis in California

I have been seeing an effort to continue the fight on Cannabis in California and that fight is being focused on the Medical people.

I have been unable to focus on one story or article but today i found an article that I believe will kick off a proper thread.

Now that the right to form collectives and coops has been affirmed by our California Supreme court we still have a movement of Hate against the Medical Cannabis community and perhaps the war will be fought from house to house and job to job.

Here is a small article from a town I know very Well. I lived in the Inland Empire and know it well..

Coalition discusses ways to fight marijuana dispensaries

Quote:
ONTARIO - Fighting back against marijuana dispensaries was the topic of discussion at the Coalition for a Drug Free California's daylong planning conference on Friday.

More than 20 community leaders, elected officials and law enforcement officials met at the Ayres Hotel to discuss the reality of shutting down or stopping dispensaries, co-ops, collectives from opening.

Attorney Martin Mayer said it will be a difficult battle because those in favor of medical marijuana always have people in attendance when the issue is being discussed in meetings or in the court.

"I don't think you can organize the way your opposition is organizing, I haven't seen it," said Mayer, who serves as legal counsel to sheriffs and chiefs of police in 70 law enforcement agencies throughout the state.

More than 12 years ago, when the Assembly passed Proposition 215, which allowed possession or cultivation of marijuana for medical purposes, there were a lot of proponents financially backing it up, Mayer said.

In order to fight it, opponents of medical marijuana dispensaries such as the coalition would have to fund a new proposition, which is not financially feasible at this time, he said.

Another battle facing the organization, he said, is the law.

"Many times we wind up in court and we lose," he said.

The city of Claremont, however, was successful in temporarily stopping a dispensary by implementing a moratorium on those businesses, he said.

The court recently upheld the city's decision because Claremont was using zoning laws to implement the moratorium, Mayer said.

California Code 37100 which, Mayer described as the "silver bullet," states that only businesses that are in compliance with state and federal law are permitted.

"Stop fighting the fight, focus on the law. It's illegal and we need to be able to deal with it from that perspective," Mayer said.

The only other way to change the law, he said is if Congress voted to change marijuana into a prescription drug.

"But they won't do it," he said.

Friday's conference was a partnership between the local and statewide group and the Inland Valley Drug Free coalition, said Paul Chabot, director of the statewide group.

The statewide group was formed only four months ago to bring together all anti-drug coalitions to work together to fight back, Paul said.

Their focus is not only on the marijuana dispensaries but also alcohol abuse and illegal prescription use of teens, which is over taking the use of marijuana, he said.

The Inland Valley group was created four years, but this is the first time they are holding a conference, said Brenda Chabot, director of the local organization.

"Our main goal is to help kids get off drugs," Brenda said.

liset.marquez@inlandnewspapers .com,

So these people don't know the difference between Adults and Children. Never mind that coops are legal. they are planning to go after cannabis people anyway they can.

With Claremont they didn't go after the Cannabis they went after the Zoning. That's like requiring a poor person to own property in order to vote.

Most people don't have the room to grow their own so a place to go in the Inland Empire is needed and they know that.

So if you have news from other Areas of California please post them in this thread. I believe we are seeing an organized effort to harm citizens of California and that is a criminal activity.

I hate it when these people lie. Here is section 37100:

Quote:
37100. The legislative body may pass ordinances not in conflict
with the Constitution and laws of the State or the United States.
That's the long and the short of it. (The "legislative body" referred to in 37100 means city councils and other municipal authorities.)

Once again we have an issue of semantics, but, semantics are very important in law as critical language goes to the very heart of legislation and court decisions regarding the enforcement of legislation. Essentially, 37100 limits the power of government, just as our Constitution does. The legislators could have written, "...The legislative body may pass ordinances not in conflict with the Constitution and laws of the State and the United States.", but they didn't, choosing to use the word or instead.

Regardless of the semantics issue, 37100 doesn't even mention the word business and it takes a pretty hefty stretch of the imagination to interpret 37100 as applying to each and every business in the state because it is specifically written to limit the powers of local governments. The drug warriors are getting desperate! Those city councils that try to write these anti-mmj laws need to be brought to task and reminded that they too have to follow the law. I hope that the recent decision allowing communities to be sued for their actions will make the drug warriors posing as public officials to think twice before enacting ill-advised ordinances outlawing mmj facilities.

Looks to me that the distraction has run it's course.

While folks are still hating medical people there is a bigger fish now.. legalization..

So we shall see...

If this is true and their main goal, I would challenge Paul & Brenda Chabot, along with the rest of the Statewide Group to be role models for the kids and forsake drinking Alcohol!!!
