For the record I stand corrected. For us small personal growers it is for all intents and purposes legal - we don't harvest pounds for street sale. For the huge dealer growers the penalties can match your greed.

As I said, in Ohio possession of up to 100 grams (approx. 3.5 ounces for personal use or cultivation) is a civil misdemeanor and $100 fine, with no criminal record generated. In this country that's about as marijuana lenient as you can get. Works for me.

I don't post much, but I do hang out and lurk/read/enjoy quite regularly. I would like to add to this discussion if I may? I know this is off the original topic line, but an interesting discussion has begun and I would like to contribute. 1Toke brings up some excellent points that I agree with, the discussion was nicley followed up by RellikBuzz, who correctly (imo) nails the whole legalization of marijuana issue on the head. I would like to add to his train of thought with this.

As long as there is lots of money to be made by varying groups eg. police departments, local governments, pharmaceutical companies, timber interests, oil companies, plastics manufacturers and lots of other interests that I am sure I have neglected to include, Marijuana Will Be Illegal at the federal level in the US. Money rules the roost, along with money comes the influence and power. I know that is incredibly cynical. But I believe it to be true and I am sure most other americans would as well. We only need to look at the escalation of the money spent on political elections in the US to see that money rules. Look back at the Marijuana Tax Act of 1937. It was all about money. Dupont, Rockefeller and Hearst did not want marijuana and hemp legal. Marijuana and hemp and the products able to be made from them would cut into their empires. They convinced Harry Anslinger to introduce the legislation to make it illegal, The Marijuana Tax Act of 1937 became the cornerstone that led to the criminalization of marijuana.

In my state, it is a misdemeanor to have 5 or fewer plants and less than 28 grams of finished product. Over that it becomes a felony. I, unfortunately like any one else that grows know that we walk a very fine line. The hobby that we love, and I would think would most certainly like to share openly with others of like minds, can not live freely in what is supposed to be a democracy. We are prisoners of our own pleasures. I think that is a horrible way to live but what other choice do we have. I know, I know we could be idealist, I think there is some idealist in all of us. We could try and unite, work the political system, but in order to do that you would need lots of money and there is one other problem. Anyone heavily involved in any outspoken and powerful group lobbying for the legalization of marijuana would most likely have to cease any type of growing operation, because undoubtedly you would run into harrasment by local and federal authorities once your organization's voice began to be heard. Like I said we walk a fine line. We are certainly in a catch 22. Unfortunately, we live in the United States Of Money. Where money rules.

So we have to continue to hide. Which I do not think is very democratic.

Excellent post, my brotha! One thing to point out here is that Hearst, Dupont and their croonies didn't have to do much convincing. Anslinger was appointed by his uncle-in-law, Andrew Mellon, who was the reigning Secretary of the Treasury at the time. Mellon was big buddies with both Hearst and Dupont so it was easy to appoint his newphew-in-law who would instigate the implementation of the first Marijuana laws as the first real Drug Czar of the country. What better way to protect one's own interests than to get someone appointed that you can control like a puppet. Add to this the fact that Anslinger was a racist and hated hispanics, blacks and jazz music whom he all blamed to spreading the scourge of the deadly weed!

Simply rediculous to think that we are still suffering from the affects of this racial hatred in the form of bogus laws meant to keep a substance illegal to protect the profits of big business. Some say that we have progressed so far as a nation over the last 70 years but I say, me thinks differently!

While the situation in Italy is sad to say the least I didnt read as much into it as some sort of technical sting. The website was running a one stop shopping place for hardware and seeds, werent they? Why would you need to do all the tech work of IP's, ISP's, user names and the such when you already had a complete list of customers that ordered hardware and seeds? Names, addresses, credit card info, its all there when you order.

The other thing to note is that Italian law may be so loose they let them operate that way. In the US they still need something called probable cause and without it and some evidence you dont get a warrant. This is the exact reason they arent busting down the doors of all these Emery people getting DEA letters. They dont have enough probable cause until the letter is answered.

Theres no judge in the US that will sign a warrant based on the probable cause that the information was obtained via an anonymous entity on an internet forum. In fact the most they can do in the US is file for a subponae of client records after they have proved a crime has been committed. This is why all lawsuits from the RIAA and MPAA are issued to ISP's as JOHN DOE's. Downloading copyrighted material is a crime. Posting pictures of pot is not a crime, not in a magazine, not on the internet.

REZ and I have always recommended you trust your local Gypsy.

For sometime Gypsy and many of us have stuck our necks out for whatever reasons. Our concern wasn't just our profits. We always worried about everyone's security and we were always for legalization.

What bothers me is the vacancy ME leaves in the marijuana movement in Canada and this is a setback as he was identified with marijuana and the Marijuana party. He seems to be becoming a political prisoner actually.

State rights are a good angle but I feel we must form an organized large religion that uses marijuana as its primary sacrament. Medical and religious freedom will become the crux of the matter until the people have their will.

Prohibition can work for a time but not forever. Marijuana prohibition will end eventually but when sanity will come is anyone's guess.

I realized some years ago that for my part I desired to change the world. My way was to show my growing methods and to start breeding and selling seeds. Getting good genetics out world wide seemed a reasonable strategy and Gypsy has the same goals. REZ had super genetics and it was a no brainer for the three of us to have similar goals. Most of you have the same goal.

It is so wrong to lable people criminals for no real reason. We have our homes and our rights to do that which harms no one else. This is the definition of Liberty and many have died for the freedoms we seem to be losing. We died over and over again fighting the same despots all through history and its no better now.

This drama is playing out on this planet now and crisis points have almost been reached in many realms. The govt's are in opposition and soon the UN will turn completely against America. We look as if we are going to pull out of the UN now. China will veto any security resolutions regarding Iran's nukes! This is a real issue now.

Hard to believe pot seeds are really involved in world crime efforts but this is the final culture war to end all wars...

Yeep along the lines of ME sellin Blueberry , 'bout 7 yrs ago or so placed an order for some of DJ's BB and received Prairie Seeds(Reeferman Genetics) . I was totally pissed when I got 'em , but grew em out and got a real treat . Those Reefa seeds Turned out way killa . So fuck Mark E , thanx to Reefa , and hope every1 stays safe , because regarless of ME's situation it affects all of us in 1 way or another !

All i can say is Be all you can be in the WEED ARMY (lol). Keep your heads high all you growers and be proud of who you are and what you do! I mean WTF is really wrong with some good buds? There is no difference than these Dr's getting many, many people hooked on pain killers and others meds, and these meds they are giving are killing people messing their lives up. How many people do you know that has been to a MJ rehab clinic to get off weed?

Back on topic - I still think the money laundering charge will be the most problematical for M.E - and the most difficult to defend - and they've been handing out looooonnngg sentences in the States for that alone.......

Don't have time to read it all right now but I will when I get to my job LOL :D. I would like to say one thing tho. We are all a part of a constant revolving circle that keeps the goverments cash cow flowing freely. We are the enemy that could ultimately interrupt that cash flow and they simply cannot allow that to happen. It will never be legal. Remember our Goverment is the biggest drug dealer on the planet and anyone that threatens that cash flow is going down. Take a moment to think about it. I am always looking for ways to circumvent the system, but I still buy weed from the street because I smoke way to much. Can you imagine the amount of money that flows through drug trade. Now just imagine if that money just stopped moving. Our economy would collapse, hell the world economy would probally collapse. I can't even concieve that amount of money. Markets are based on money moving from one hand to another right. Drug trade has spawned and supported countless business and they will fight like a rabid dog to keep it flowing. So in other words it must stay illeagal for our goverment to survive. Therefore I believe we are fighting a loosing battle. Even if it was legalized for medicinal purposes, it would still be illeagal in the Goverments eyes to produce it yourselfs.

Oh so cynical I am.

The only thing we can do, you are absolutely correct. I know I must sound very cynical here in the US, when new medical initiatives are being developed everyday. I just believe that they are gonna make it as difficult they can for us. I would venture to say that your sales have suffered, Due to the whole Italy and Emery thing. I could be wrong, happens alot.
