i stand by my prediction that they will just ban it. there are too many loose ends to allow it. the bos drag it out, make it look like theyre gonna play ball, then just shit on everyone with a ban. theyre looking at lawsuits either way they go and its a damage control scenario at this point. if they ban it they just gotta return some of the folks tax money(which by my guess not many people paid yet) the big boys wanna get in the game but they are cowards that wanna have everything hammered out nice and clean before they invest millions of other peoples money to grow duff. sessions just made his announcement and he gotta do something to show hes not just talk. i expect nothing out of these chump board members anymore but hoping january 10th they make a decision so we can get on with our lives. best wishes to all the folks that ran the gauntlet these last couple years

Were you at the meeting, sounded like a wrestling match in the news.

Property going to available cheap in your county soon.
After the green rushers default on their mortgages and the black market growers get locked in Chino the Cali economy will be hurting bad out in the boonies.

Weed has been feeding lots of families for 35 years out there and that door is slamming shut hard and fast with regulation.

Weed growing will be done by Mexicans again soon, not white stoners, just like strawberries and every other legal crop.

What a shit show with your elected officials though. Got to move to away from the rednecks and republicans if you can afford to.:tiphat:

Calaveras county has voted to ban cannabis. They tried to pass the 100+ acre "ban-lite" law but only the chair Toffaneli wanted it. The other two for regulations said 100+ acres was too stringent, I think they would have suppported 20+ acres or maybe 50+ acres.

So the 3 banners banned it.

Also a 70+ yearold banner from angels camp smacked a local man across the face who supports regulation (NOT a grower used to be against cannabis until he started coming to every single meeting on it now switched sides). he declined to press charges on the lady. The man is last name "falvey", comments ALOT on calaverasenterprise on cannabis. Used to be very against cannabis but switched. He is 60+ years old from Mountain Ranch.

They also voted to put the ban law and the planning commisions more lenient regulations (20+ acre 200' setback) up for vote on the June ballot for the people to decide.

Upwards of 10 different legal strategies will be thrown at the county. The first is from the Lawyer who won against the IRS for harborside. He believes the county is going to need to return the measure C money because they began taxing 1 year too early prior to state regulations which he says is not legal in line with how measure C is written. Thatll be 10+ million they need to return, and they already have a $5-6 million dollar structural deficit according to the county auditor controller..and thats predicted to grow.

Now the cannabis community is fully united in our efforts to win the elections in June, to replace Clapp with the conservative or liberal running against him both supporting regulations, to have a recall on Tofanelli and Mills.

Clapp was sooooo happy they banned it he had a meal of snacks mouth wide open smacking lips for the camera to hear crystal clear as the opposing supervisors got their turn to speak.

APparently clapp was yelling at a citizen at the podium two days ago, the guy he works with in the elderly care group he is apart of who today told Clapp they no longer need your presence on that job.

After they passed the ban vote they opened up general public comments again. A middle aged lady who said she has lived in Calaveras for 40+ years and has been working for the county government for 18 years said she had multiple fellow employees in tears following the vote because people fear for their jobs. Their are 20 county employees and 6 police officers that are up to be fired very shortly because they were 100% funded by the cannabis fee monies that they will no longer have. And with the Sheriff saying that he is losing his employees because they dont pay them a high enough hourly rate to compete with neighboring counties he cant even FILL all the positions he has authority to higher. The 2 main banners are part of a group that is building and influencing other surrounding counties. They want the Sierra nevadas to basically be a retirement community mostly, with extremely limited economic activity of ANY kind because any business will disturb them as they dont require employment so its only a nuisance for them. And they dont care so much about county services or Funding for schools since they have no kids and usually they didnt grow up here so they dont have family with kids either. Their plan is for the state to pay to helping them manage the watersheds and eradicate the illegal growers. And they also believe, the only reason we have any cannabis grows is because they are regulating. And if they would just stop regulating then all then it be easy to eradicate them because if everyone was illegal they falsely believe the sheriff will just hip scotch from property to property chopping plants like theirs no tomorrow......apparently they didnt hear the Sheriff when he said it costs $10k to eradicate one grow and MANY man hours both out of the field for planning and in the field.

Calaveras is poor, but they could form a multi agency task force & team up with the DEA, Thas how they do here in socal. Then there is no suing the county or sherriff because its federal at that point.

Careful up there this year, a couple quick deps might be in the cards, but i think the huge multi acre full seasons are risky.

The dea gives less then 50k a year and only helps on a few operations a year. Their already maxing out that relationship. That lets them shut down grows for about 1 week. Sheriff said nothing else is available from them.

if everyone grew as much as possible and planted tons of gorilla grows everywhere, the county would exhaust resources trying to eradicate it all, fines would go unpaid and again causing a catastrophic toppling of the sheffirs office

You are right Azure. I found this posted showing the penalties for violating HIPAA:

What is the penalty for a HIPAA violation?

  • By Morgan Brown

HIPAA violations are expensive. The penalties for noncompliance are based on the level of negligence and can range from $100 to $50,000 per violation (or per record), with a maximum penalty of $1.5 million per year for violations of an identical provision. Violations can also carry criminal charges that can result in jail time.

Fines will increase with the number of patients and the amount of neglect. Starting with a breach where you didn’t know and, by exercising reasonable diligence, would not have known that you violated a provision. To the other end of the spectrum where a breach is due to negligence and not corrected in 30 days. In legalese, this is known as mens rea (state of mind). So fines increase in severity from no mens rea (didn’t know) to assumed mens rea (willful neglect).
The fines and charges are broken down into 2 major categories: “Reasonable Cause” and “Willful Neglect”. Reasonable Cause ranges from $100 to $50,000 per incident and does not involve any jail time. Willful Neglect ranges from $10,000 to $50,000 for each incident and can result in criminal charges.
HIPAA violation categories and their respective penalty amounts are outlined in the chart below:

<table> <tbody> <tr> <th>Violation</th> <th>Amount per violation</th> <th>Violations of an identical provision in a calendar year</th> </tr> <tr> <td>Did Not Know</td> <td>$100 - $50,000</td> <td>$1,500,000</td> </tr> <tr> <td>Reasonable Cause</td> <td>$1,000 - $50,000</td> <td>$1,500,000</td> </tr> <tr> <td>Willful Neglect — Corrected</td> <td>$10,000 - $50,000</td> <td>$1,500,000</td> </tr> <tr> <td>Willful Neglect — Not Corrected</td> <td>$50,000</td> <td>$1,500,000</td> </tr> </tbody> </table> Source: HHS, Federal.Register.Org

As to each and every grower who was a medical patient, Calaveras County has violated HIPAA with willful neglect and has not corrected itself.

Now, it faces a $50,000 fine for each of those growers whose names and addresses were put out there in public. That's enough money to entice a lawyer to represent them in a lawsuit against Calaveras County. Coupled with the $50,000 available per violation under the Unruh Act for willful violation of civil rights and attorney's fees being available for Section 1983 civil rights lawsuits, any lawyers here want to dance?

Calaveras chronicles # 41= Chester made some interesting points about HIPA violations. The H in HIPA stands for health and the law was originally intended to protect consumers against health care records being released.
The ban vote doubly screws over farmers , first by shutting down future grows that they paid lots of money for permits. Secondly , calaveras farmers cannot apply for a state permit which allows them to sell 2017 crop to dispensaries statewide because it is banned in the county. They are driving the whole thing underground again and this is all before the feds really get fired up.
New lawsuits against the county have the potential to be able to totally bankrupt Calaveras county in the next year. Suits from shutdown growers, suits about tax and fee revenue. What is the point in opening up legal pot farming when you just open up the county to lawsuits , some legitimate and justified and others.........well you know how lawyers work in the peoples republic of California. It could have been done so much smoother but our fearless 5 supervisors have proven their incompetence......again.
Last year a vote was to be held for the general public to decide the cannabis farm issue. A local deep pocket dispensary owner hired a lawyer to find a technicality in the ballot and shut down the vote.(asshole X2) Now that farming has been totally banned the commercial growers are calling for a vote for the general public to try and reinstate grow regulations. I don't think the dispensary owner will try and get this one shut down.
This may have a chance of passing since year 2 (2017) had much less problems than 2016. This being said there are lots of people that really don't dig the scene. One district out of 5 in Calaveras is the primary area for 90% of the farms. I would guesstimate 10% of the people here make money directly or indirectly from commercial cannabis. With the high number of Bay Area retirees who have already made their money and moved up here for the lifestyle many do not want a change .

Calaveras chronicles # 42= The grow ban is in effect and changes are already evident. Winter is a slow time of year for most farmers and with the ban in place many farmers have left the area for greener pastures and a more secure future. Grocery store checkers that were complaining about too many customers last october are now complaining about the lack of business. Calaveras county will have to lay off about 2 dozen marijuana related jobs including sheriffs deputies. The local newspaper ran a story about businesses like building contractors and heavy equipment operators hurting for work , not to mention the dirt and fertilizer stores. There is no problem finding a parking spot at the store now.
Both sides are trying to recall pro and anti grow county supervisors. It doesn't look like there is enough time to get the paperwork done for this to happen in June.
The trend of indoor grow houses continues and the sheriff keeps raiding them. A registered grower with a maximum 200 sq. ft. permit was caught with 900 plants and 26 pounds processed. That's a lot of plants in 200 square feet. Sheriff's pictures show the typical gutted house. I wouldn't want to be the landlord to clean up that mess if it was a rental, lots of black mold on the wall, available soon at your local dispensary. Maybe a new strain( Black death)
What is allowed here is 6 plants indoors. Such a joke when you have perfect growing conditions outside and most residents have a bit of acreage. The main thing is don't piss off your neighbor and cops will leave you be. Also with a low number of plants it is easy to hide them from satellite views. Most personal growers don't worry about the indoor rule and 6 plants may be 6+ a couple of backups.
The Calaveras county marijuana story is not over yet. Time to go fishing

Calaveras grown R.I.P. = This week calaveras county supervisors had the opportunity to allow citizens to vote on the future of regulated cannabis cultivation . The vote could have been held in June. Vote was thumbs down. Another nail in the coffin of big weed up here. Previously registered farmers are being encouraged to sue the county. I have not heard how much of this is going on. There is not a lot of pallets of bagged soil being moved down the road nowadays. The local bulk dirt supplier has not restocked this winter and the business
has been for sale since last year. Growers have until may to pull off one last crop.Calaveras county is a textbook example of how not to bring in regulated cannabis farming. A combination of weak supervisors and a shell shocked citizenry slammed by a influx(invasion) of newcomers that made little attempt to fit in with long time locals.
At least the fishing is good. Red lazerlite goes in the ground in April, something a bit exotic this season if it finishes in time. Make your 6 plants count Calaveras farmers
