Schedule 1 Status Being Challenged as Un-constitutional

They're arguing that not only does it have medical properties and is safe to use, their rights to travel are impacted by a continued federal prohibition. The feds have known for decades cannabis should not be schedule one, the only reason it continues is due to money and power.

A small group of cannabis patients and a cannabis rights group are suing the federal govt over the schedule 1 classification of cannabis.

Doubtful it will be changed in the next few years. DEA classified it and and Big Pharma don't want it deschedulized, sad to say. Too, the current political climate is a deterrent as well.

Forget all the medical bs and just legalize it or else they want all this testing and wasting of time and making synthetic crap of what " works" what doesnt and not using the "harmful" parts its so lame.
No ones willing to prove what weed does because anyone can grow it and wheres the billions of profit in that?
Just make it legal and let doctors recommend forget all the FDA approved nonsense they dont need to approve tobacco or alcohol and those are drugs also

Might be the smartest move yet. Every study done by the feds has recommended it be legal and been ignored. Hell, the Nixon tapes clearly have him saying he doesn't care it's not harmful and that he would be making it illegal anyway.

Time will tell.

Very confusing and not least to our cops who really seem like they couldnt give a shit about cannabis except organised crime but we all know they WILL come if some dog drops a dime or loose lips in pubs,,,,,

I'm surprised big pharm isn't pushing to re-classify it as schedule 2. That would put us in the position we are in with opiates where it's only legal from a pharmacy with a prescription.

Just a dumb question, what would it take and is it even possible to get something on the ballot to allow a popular vote to just flat remove any federal regulation from the equation? Only problem is that it would need to be a hands off policy, with the basic right for home growing, not some 1,000 page bunch of BS laws. But I can guess how it would end up, probably 4,000 pages pork...

@OldPhart That's a very good question. Anyone not using a cell for internet access who could look it up? I honestly don't know the citizens' option for introducing anything like that.

Emperor Nixon made damn sure to cement MJ as Schedule 1 in his war on hippies. He did the same with heroin in his war on negros. That way the police could arrest them on easy to prosecute charges of possession. Then he packaged it all as The War on Drugs. Anyone that would not vote for him, he went to war with. His legacy continues. The War on Drugs continues. Until congress is Democrat controlled again, it is not likely to change. The more likely scenario is when 34 states allow for legal or medical MJ, only then will MJ be moved to a schedule II classification. Reason being that is 2/3 of the states, and enough to pass a constitutional amendment for medical MJ.

If Tzar Trump is impeached AND removed from office, Pence is not likely to change the status of any drugs in the DEA list. Seemingly there is never going to be an argument to convince the DEA, the Rep. controlled congress, or a Rep. president regardless of the medical patents applied for cannabis, including by other US government agencies.

A couple of rural Oregon landowners are accusing their neighbors of operating marijuana-growing operations in violation of federal anti-racketeering laws.
The lawsuit filed by Rachel and Erin McCart of Beavercreek, Ore., accuses 43 defendants — including neighboring property owners as well as affiliated marijuana growers and retailers — of violating the Racketeer Influenced and Corrupt Organizations Act.
Because it remains illegal under federal law, Oregon’s “regulatory scheme” for marijuana does not protect the defendants from RICO charges for conspiring to grow, process and sell the controlled substance, according to the plaintiffs.
“Given the strict federal prohibitions against each of those purposes, defendants knew these purposes could only be accomplished via a pattern of racketeering,” the complaint said. “In furtherance of that goal, defendants pooled their resources and achieved enterprise efficiency that no one defendant could have achieved individually.”
Beginning in late 2014, the defendants began installing equipment to produce marijuana on two properties neighboring the McCarts, who own nearly 11 acres of fenced pastures and forestland, the complaint said.
While the neighborhood was once quite and safe, the marijuana operations have drawn unwanted visitors who litter nearby properties, play loud music, ride loud all-terrain vehicles and harass landowners, the plaintiffs claim.

Making it a schedule II drug just puts it fully into the hands of the big pharmaceutical companies..

Cannabis needs to be Un-scheduled....

Aren't booze and tobacco drugs?! Of course they are!

Neither one of them is anywhere on the fuckin' schedule...

i'd be surprised if this is possible with the law as it stands now
congress has no desire to weaken its hold on its power to legislate
what's amazing is some states do allow for it

It's all a corporate takeover scheme. Prohibition in its entirety was a corporate takeover scheme. They ve had all this time to get their ducks in a row. 10 years from now, no one will be legally growing weed at home. Just like no one is making Valium at home. "But Valium legal?" Exactly. Legal to buy from corporations. Not legal to produce and possess without permission.

I hated needing permission as a little kid. And I hate it as an overgrown kid even more.

Were you around when Nixon was in office? Likely not. He personally (YES PERSONALLY!) demanded that the US spray paraquat on marijuana fields in Mexico. I had marijuana that tested positive for paraquat. His own cabinet all advised against it and said that it was a bad idea and it would likely kill people. Nixon told them off and went ahead with the program anyway.

If we are so insignificant, why are you even here? I suggest that the rest of us in the booth add you to their ignore list. Good forking luck with your newbie middle aged organic grow there bucko. And adios.
