Anyone Familiar With UK Law

Cultivation of all varieties of the genus Cannabis can only lawfully occur in the UK under
licence issued in accordance with Regulations 5 and 12 of the Misuse of Drugs
Regulations 2001 (MDR 2001) and the Misuse of Drugs Act 1971 (MDA 1971).

A licence is required to cover both cultivation and possession. The genus Cannabis is a
controlled drug in Class B of the MDA 1971 and Schedule 1 of the MDR 2001. Under
these Regulations, a licence may be issued authorising cultivation in limited
circumstances.

The Misuse of Drugs (Designation) Order 2001 restricts the licit use of cannabis to
possession for research or “other special purposes”. Home Office policy with regard to
“other special purposes” provides that licenses may be issued for the cultivation of
cannabis plants with a low THC (tetrahydrocannabinol) content for the production of hemp
fibre for industrial purposes or the obtaining of seeds which are then pressed for their oil.
For both of these uses, there needs to be a defined commercial end use and the Home
Office only licences plants grown from approved seed types with a THC content not
exceeding 0.2%.

The legislation (MDA 1971 and MDR 2001) does not differentiate between companies or
members of the public who wish to cultivate cannabis. All licence applications received are
fully considered to determine whether they meet the above criteria. The Home Office,
however, does not under any circumstances issue personal licences to cultivate cannabis
for personal use. The unauthorised cultivation of cannabis (in any form) in the UK for
whatever purpose is illegal and would make the person concerned liable to prosecution.

The maximum penalty for growing cannabis is 14 years‟ imprisonment and/or an unlimited
fine.

Turning to your request regarding the number of licences issued between 2002 and 2012,
I believe part of the information you have requested is already reasonably accessible to
you and can be found at https://www.gov.uk/government/publications/17258-cannabis-
cultivation-licences. This link provides the total amount of licences issued between 2000
and 2010. The number of licences issued for the purpose of cannabis cultivation for the
years 2011 and 2012 were 33 and 32 respectively.

You have further requested information regarding the „type‟ of licences issued. All
Controlled Drug domestic licences are issued in respect of the drug Schedule(s),
according to the MDR 2001, to which they relate, and to the specific activities the licence
enables - for example possession, supply. Licences do not specify the „use‟ of a drug.
Specifically, with regards to cannabis, these licences enable the organisations to cultivate
and possess cannabis within certain THC content parameters.

If you are dissatisfied with this response you may request an independent internal review

Don't supply details of your company online. Companies house can quickly be searched for home addresses of directors. If you haven't updated your current Addy with them, that in itself is an offence. Either way, if Leo wants to be a ****, you turn yourself into a target.

True,,,

im wondering if anyone is going to come out of the woodwork and show some interest, I was worried that people might not have taken another account seriously but it seems like there is a general lack of enthusiasm to push this forward

I wanted to do this on my real account first to gauge interest,, i was hoping that at least a couple of people who know me from icmag might think it's worth brainstorming more

I'm Really excited to see things move forward so quickly atm and I'm trying to strike before this iron cools down and I miss the boat on some interesting projects

I think it's really exciting. Keep in touch.

I'm a grower/horticulturalist who enjoys sourcing varieties and doing a bit of experimental breeding. I have agricultural experience and contacts too - I envisage breeding for suitable field scale crops to get the country growing. Farming renaissance!

Growing certified organic is the way to go as well - as recent residue issues in US crops show.

Great work Rick.:tiphat:

UK law relaxing?

UK law relaxing?

Hi Rick,
I share your excitement but it is tempered by a realists cynicism.
It was all over the radio today but they keep releasing little details on how narrow the application process will be. Only specialist doctors will be able to prescribe any future products and only to someone who has run the gamut of questions and examination.

The scuttle-butt is that it will be a range of sprays and oils but I tried the spray a little while ago and I wasn't impressed. It only contained Delta 9 and it was a strange sensation, leaving you wanting, more than relieving you of anything so I hope the future products will be more effective.

I do believe this latest development to be the thin end of the wedge thank goodness and the UK may finally be being dragged (albeit screaming and kicking) into the 21st century regarding MJ.

NOT BEFORE BLOODY TIME!

Peace and happy growing,
Regards,
Iffy :tiphat:
