Marijuana Tax Stamp ?

:chin: Has anyone ever applied for a marijuana tax stamp? I just realized my state and many others have one. they seem to average $3.50/gram for possession of 42.5 grams or more, KY also has one of $1000.00/per plant for five plants or more. The penalty for non-compliance varies from state to state.If anyone has any more info on this subject and or first hand experience, please share your insight. I guess the states don't go out of their way to inform us about these. Peace. :sasmokin:

there was a small article in high times about this a month or two ago, it was talking about a guy that got busted with mushrooms and they used the tax stamp to fine him quite a bit, but yes they are still used and many are just in stamp collections

Probably great investments with significant historical interest eventually...

These stamps were originally designed decades ago to enable harrassment/ seizure of assets/ jail time for "tax violations"/ violators.
(Think: Al "scarface" Capone, the famous gangster/ bootlegger who back in the "Roaring Twenties" went down eventually for tax evasion after other legal means had failed to put him away..)






These mexican bricks used to be called "The good stuff".

Marijuana Tax Stamp Laws And Penalties


“No taxation without representation” was the rally cry of advocates of American independence in the eighteenth century. Today, tens of thousands of cannabis consumers utter a similar cry over the selective and inappropriate enforcement of illicit drug taxes.

In twenty US states, those who possess cannabis or other illegal drugs are legally required to purchase and affix state-issued stamps onto his or her contraband. The total cost of the tax is generally determined by the quantity of contraband possessed. Unlike typical criminal statutes prohibiting the possession and sale of controlled substances, drug tax stamp laws primarily assess financial penalties on the defendant for noncompliance. On occasion, criminal sanctions may also be imposed.

Although nearly half of all US states have marijuana tax stamp laws on the books, few citizens observe them. Most individuals are unaware that such laws exist in their state; others fear that complying with it will incriminate their behavior. Because of this widespread noncompliance, drug tax stamps – unlike so-called “sin taxes” on alcohol or tobacco – do not collect state tax revenue at the customer’s “point of purchase.” Rather, the legislative intent of drug tax laws is to impose an additional penalty – tax evasion – upon drug offenders after they are arrested and criminally charged with a drug violation.

In some states such as Georgia, failure to comply with the state tax law may result in a nominal misdemeanor penalty. However, in other states such as Minnesota, failure to comply with the state’s drug tax law may result in a defendant facing an additional fine of up to $14,000 and seven years in jail.

Do you guys think one would be safer to purchase these, or would you just be opening yourself up for trouble? If the federal government can supercede state law in medical cases what would stop them on this unless they consent by acceping some of the tax money. I'm just always looking for a way to be a little safer. If you purchase these do they have to honor them? Has anyone heard of anyone getting in trouble with these even though they comply and possess no other illegal substances? NORML should really post more info on this than they do. I wonder if this loophole could keep us personal growers safe. Thanks for the info everyone, now..... get back to that garden! Peace :chin: :joint:

I don't see any reason to buy tax stamps.... seems like a bad idea all around. Besides, doesnt the government get enough of our money in taxes?!

The stamps were not for possession but for resale if a dealer wanted to avoid the double whammy of tax evasion on top of a distribution charge. I dont believe the stamps have any application to the medical world of MJ.
