2 killed in robbery of California marijuana grow

FRESNO, Calif. (AP) — The robbery of a Central California house with a marijuana-growing operation triggered a fierce gunbattle in which two suspects were killed and a 15-year-old girl was used as a human shield by fleeing robbers, authorities said Thursday.

Two suspects were arrested and three remained at large after the pre-dawn violence south of Fresno, Fresno County Sheriff Margaret Mims said.
"We have several children who were terrorized in their own home," Mims said. "The teenage girl was used as a human shield as the suspects were leaving the residence, and they kidnapped her, putting her in the car."
Seven armed men posed as law enforcement officers and forced their way into the house around 4 a.m., she said. During the home invasion, a man in the house was pistol-whipped and the robbers and victims exchanged gunfire.

Deputies who responded to calls of the robbery saw two cars speed away. They were only able to stop one of the vehicles when it pulled up to a hospital with a wounded man in a ski mask. The deputies gave him CPR, but he died a short time later inside the hospital, Mims said.
Two other men in the vehicle were taken into custody.

Suspects in the other car took the girl hostage and took her a dangerous ride topping 100 mph before dropping her off unharmed near downtown Fresno. Investigators found several shotguns and handguns tossed out of the getaway vehicles, Mims said.

Another robber found near the house later died of gunshot wounds.
The house had three marijuana plots and 150 plants, Mims said.

Investigators were trying to determine whether the homeowner had medical-marijuana permits.

Not over a plant. Over money in the end. Legalize it and it wont be worth as much and people wont have to steal from growers. They can steal from Safeway instead. When you start saying these people died over a plant it makes cannabis out to be the criminal in this crime. Money is the root of this evil. Just my 2cents

Were the home owners / occupants arrested or charged with anything? Is this a clear-cut self defense case, or a real muddy situation? Obviously depends on specific details, going by everything in the article and assuming it's true...

I'm pretty sure there's a law/clause at least in California where at least the robbers will be responsible for the murder of their two accomplices, even if they were not the ones to pull the trigger. Something about involving firearms during a crime and the criminals being responsible for any and all deaths regardless of shooter. Not to mention kidnapping (which is a very serious charge), probably enhanced with additional clauses, among other charges.

In this particular case, they were lucky and doesn't appear they took too big of a "loss". However, by involving guns, this could have just as easily turned out different, with the home occupants dead or seriously injured, all over some plants in August (better be light dep ready for harvest). If the occupants weren't armed, chances were almost certain they would have taken a big crop/financial loss at the least, but further violence seems a lot less likely. Once both parties are armed, things are taken to the next level and you will usually be the one to bear the brunt of the element of surprise and lack of preparation.

In some/many cases, making the choice to arm yourself will be the equivalent to making the choice to take a loss OR almost guarantee someone dies. Could easily be you, if you're caught surprised and outgunned.

150 plants does sound like a nice payday, if you're thinking in the ripoff state of mind
plant sizes not mentioned, but 50k might be close to dispensary value, could be a lot more for trees
was it worth dying over? armed robberies of grow houses seem to go bad for the robbers a lot of the time
but yeah, it's just about the money

I

If you don't have all the details, its not appropriate to call an issue"clear-cut"

The article mentions nothing that indicates self defense. It doesn't mention any details about the shooting. That usually happens when it isnt so clear cut.

It may be self defense. It sounds like a situation where lethal force might be warranted. I tend to er on the side of caution in light of the recent "self-defense" shootings in the news.

Yes, I understand there are always details left out or incorrect in such articles.

However, hypothetically, based on information given:

  • Multiple armed intruders attempt to rob home occupants
  • Intruders attempt to kidnap teenager (and succeed)
  • Shots are fired, 1 intruder dies on scene, another at hospital

Is this considered self-defense where the occupants do not face charges?

Or do we need the middle names and social security numbers of the involved to evaluate this?

guns & grows don't mix.

the victims/occupants will probably not be brought up on any murder or manslaughter charges, they will probably be charged with guns/drugs statutes and if they were precluded by law (felons, parole, probation) from possessing guns they'll get charged w/that too.

any and all suspects caught will very likely be charged with capital murder in the deaths of the 2 other thieves.

someone obviously broke rule #1 to begin with.......

It's an unfortunate situation but the guy is lucky he was able to fight them off somewhat. It could have been him and his family killed instead. You can't trust an armed robber not to kill you, it's really that simple. Now, I would actually prefer a lot of people not have guns unless they get proper training with them because otherwise they are a major liability. And proper firearm storage is key.

The true criminal in this situation is the law itself. The only true dangers and/or harmful side effects of marijuana are all a direct result of the laws against it.

Cop or low life might shoot your ass for it.

HempKat - word, couldn't agree more. What drives the police departments? Money, budgets.

To those of you who states that cannabis growers can't own guns, I direct you to the second amendment of the constitution. Nowhere in there does it state anything about drugs and guns. That is a new law, created by Marxist and Republican powers that profit from people being in jail. Heck, all the cops have to do to enter your house, shoot your dog or family and they just have to say there were drugs inside. Now you say drugs and guns, whew, the American public is trained to say, "they had it coming." Just like now you can't bring a nerf play gun to school without being suspended for caring a weapon. Ingrain this into the minds of the young, destroy the lives of the people that stand against you, and you will have a new generation afraid of guns. They are doing it to guns as they have done to drug users in the past. Wake up people, we need more freedoms, not more regulations.

The people in this story were defending themselves. Now imagine this was a bank robbery gone wrong, and the bank security killed two would be robbers. That man is a hero. However, pot user protecting his business and livelihood, he is an evil bastard!

Probably just lost our common ground Jnnnn, lol. Good to see we stood on common ground for a moment.
