ATTORNEY GENERAL BOB FERGUSON HAS FILED A RECALL ON GOVERNOR INSLEE FOR HIS INVOLVEMENT IN I-502.IT WAS FILED NOVEMBER 1st & MUST BE HEARD WITHIN 15 DAYS.

BALLOT SYNOPSIS OF RECALL CHARGE
JAY INSLEE
GOVERNOR OF THE STATE OF WASHINGTON

The charge that Jay Inslee, as Governor of Washington, committed misfeasance, malfeasance and/or violated his oath of office alleges:

1. That Governor Inslee, through his staff, knowingly permitted the Liquor Control Board to violate RCW 43.10.067 by employing a staff attorney to perform duties that by law must be performed by the Attorney General; and that by doing so, Governor Inslee failed to supervise and to see that all offices are filled, all duties are lawfully performed, and state laws are faithfully executed;

2. That Governor Inslee and his staff have communicated with the Legislature about policy matters outside of puplic sessions; and that he has secretly set policy with, or permitted policy to be set by, the Liquor Control Board, the Legislature, and the Seattle City Council, in a way that violates the Open Public Meetings Act and separation of powers principles;

3. That Governor Inslee has allowed agents of the Liquor Control Board to represent that they can secure a veto on certain legislation; and

4. That Governor Inslee has permitted the Liquor Control Board and its staff to act outside of their authority and to grant licenses to produce and sell marijuana in return for political favors.​

On November 1, 2013, the Washington State Attorney General’s office filed a recall petition against Governor Jay Inslee for alleged corruption related to the Washington State Liquor Control Board’s implementation of I-502. “This case involves charges by a citizen that an elected official be recalled from office”.

The petition contains a “ballot synopsis of the charges”. The Attorney General has petitioned the Thurston County Superior Court to make a decision “as to whether the charges are sufficient and for approval of the ballot synopsis”. The AG’s Office advises the court that the hearing must be conducted within 15 days of receipt. Judge Price was currently scheduled to hear this case on November 13th at 3pm, but the complainant, Arthur West, has filed a “Declaration of Recusal for Cause”, asking that Judge Price be recused from hearing the case. This motion for Recusal will be heard by Judge Price on November 12th at noon.

According to the State statue (RCW 29A.56.140) the case must be heard and decided by November 15th. We’ll update the story as the case proceeds.

It’s pretty clear that no matter which party prevails, the losing party will file an expedited appeal with the Washington State Supreme Court. The best information we have is that this could happen within 10 days of the Superior Court Decision, but we’ll get more clarity on this within the next day or two.

If the Supreme Court decides the that the charges are sufficient and the ballot synopsis is correct, signature gathering could begin. At this time we are unclear on the exact number of signatures necessary, but we’ll be posting that information. If enough signatures are gathered, a special Recall Election would be held.

I am not certain that this is a good thing for our community. Punishing bad behavior is definitely warranted but there could be "collateral damage" that could affect the legal situation in an unpredictable manner.

I don't agree with that at all, and IMO, it is far more important to hold these sorry g'damn politicians accountable for their personal greed and corruption.

Not only do I think citizens should recall EVERY g'damn politician that acts like a g'damn mafia boss, but I think they should lock THEM in a g'damn cage for violating the peoples' trust.

I am certain that this is a good thing. How evil and corrupt must this bastard be if a recall petition is filled by the Attorney General?

Next comes the independent prosecutor looking into the governor because it is certain that the AG has a dog in the fight.

If the govenor didn't uphold his oath, he should be tossed. If he didn't uphold his oath, he fell short by committing a huge number of crimes.

These are the same people who want to regulate the activity inside of Washingtonians homes. Their actions should be held up in the light of the day for all to see. Does WA want to be the next IL or LA?

We don't know how this will impact LCB or the path that either Medical or Recreation rules may take. It could be good it could be bad.
