Denver City Council: Don't Re-Criminalize Marijuana


Last fall, voters in Colorado and Washington passed marijuana legalization in a historic move. After years of the “War on Drugs,” with billions of taxpayer dollars wasted and communities of color targeted for imprisonment, this marked a turning of the tides toward smarter policies.

Now the country is watching to see how legalization gets implemented in these two leading states. That’s why it's so shocking to learn that the Denver City Council is trying to pass a rule that would re-criminalize marijuana.

The proposed rule would even punish people for smoking in their own home if the odor wafts through the window – a form of extreme government overreach that could lead to a year in jail or a $999 fine, not to mention law enforcement literally sniffing around our homes.

After taking a huge step forward, this rule would be like taking two giant steps back. The Denver City Council is currently revising the proposal, but we don’t have much time to let the 13 council members know that people in Denver and around the country are urging them to respect the will of the voters. And they're not used to getting inundated from tens of thousands of people all across the country, so we know we can have an impact.

Sign the petition urging the Denver City Council not to re-criminalize marijuana.

To Members of the Denver City Council:
We urge you to rewrite the proposed rules ‘concerning the possession and consumption of marijuana so they:
1. Do not recriminalize marijuana possession (in specified public places, such as the 16th St. Mall);
2. Do not impose criminal sanctions for the use of marijuana in one’s home, even if someone can see or smell marijuana from a public area or a nearby property; and
3. Do not overturn the 2007 initiative passed by voters that set targeting people for low-level marijuana possession as the lowest police priority.

The entire Platte River Valley thru the entire city just reeks of loud skunk weed, same with most of the other warehouse districts. Good luck with this one.

Just don't be the asshole in the residential neighborhood, that doesn't use a carbon scrubber cause it's legal now.

I'm currently evaluating this case. So far, it looks like cannabis on the federal level still strictly applies but is very low-priority, it's totally fine on the state level, and isn't going to face any prohibition on the local level. By all means correct the everloving fuck out of me if I'm wrong as of now.

I signed the petition. Per Jhhnn the council does not appear to be supporting the mayor. Vote that idiot out of office next election. Peace and respect.

Any place that's putting in regs against cannabis is going to do a 180 by this time next year.

They're going to see the revenue leave their area and get pumped into the cannabis non-restricted areas.

Vote with your dollars people! :D

I would think that there are enough straight-thinking (and very possibly stoned) Colorado-ans, to realize that Colorado Med. Mar. laws is a draw for tourists, people going skiing, etc.

Anti-cannabis forces are down, but they apparently don't have the good sense to stay down.

So Denver residents need to email their councilpersons & the 2 councilpersons at at large.

Jeanne Robb is apparently out of her mind, given that her district 10 is pothead central, encompassing half of Capitol Hill & Civic Center Park, where anybody can score.

It's not final, but it probably will be soon. Dunno what the proposed penalties might be. Gotta love the scare tactics & "think of the children!" song & dance from anti- legalization forces-

Christine Walravens, a physician at Children's Hospital Colorado, said she often sees young mothers who say they have been smoking marijuana throughout their pregnancy. She said the council should do anything it can to prevent children from being exposed to marijuana smoking.

Obviously, she didn't offer any evidence showing that cannabis use during pregnancy is harmful to fetuses, because there isn't any, but we should think of the children, anyway. Or something, anything that'll stir an emotional response, equate it with fetal alcohol syndrome & crack babies. All of which has nothing to do with smoking on the front porch or the apartment balcony, but nevermind that.

Denver's police chief, anyway, seems to realize that it's unenforceable other than in a random chance sort of way.

this Summer my neighbor complained about his kids smelling my herb. The fan on the nearest window to his house was blowing out the window so I moved it to blow the air inside and that solved the problem. I also had the DPD stop by after I had smoked a J on my porch but I was already inside and had closed my front door so they didn't even knock...keep in mind the the DPD is understaffed and response time for non-emergency issues can be 2-3 hours.

CR-13-736 is unenforceable and likely unconstitutional, but I'm OK with people showing a little discretion.

Pretty amazing, huh? A64 is a total can of worms for a lot of politicians. My hat's off to the brilliant stoners who created such an incredible mindfuck for them to ponder. What they're having trouble figuring out is that it's impossible to effectively legislate against pot smoking on private property in Colorado, now that it's legal. Private property is some sort of cultural holy grail here.

Oddly enough, the unintended consequence of the new ordnance may be that they've opened the door for outdoor cultivation. It doesn't matter if the neighbors can see it or if it can be seen from the alley, so long as it can't be seen from the street or sidewalk, right? That defines public view. Apply that to growing in a locked enclosed space, like a privacy fenced backyard.

Heh. They're soooo screwed. Running away from one problem just puts them right in the middle of another, and another.

Well, Denver City Council just flipped again, in a good way, although it's not final, It probably will be, though. Toke up as you please on your own property.

Came to their senses, they did, at least a majority. Maybe toking will end up just like drinking beer, which is what the voters said they wanted in the first place.

I suspect that Denver's Chief of Police did a lot of politicking in the background. He made it clear in earlier hearings that his officers don't need to be fussing around with this. Enforcement of anti- toking ordinances wrt private property is very bad for community relations, and he knows it.
