New Swiss cannabis legislation since 1. Oct. 2013

Hi to those who'd like to smoke a joint in Switzerland!

FYI: Since October first 2013 a new partial revision of the legislation on narcotics took effect.
What changed? The consumption of cannabis (with possession of no more than 10 grams of weed with over 1% THC on you) is now decriminalised. The fine is fixed at 100.- Swiss Francs (CHF) without anything else to fear.
Case they caught you with less then 10 grams on you but you're not yet smoking it, you may deny consumption (because only consumption but not preparation of consumption is illegal) and nothing will happen (really nothing at all if the police officer is well informed and not some douchebag) and you should be allowed, depending a bit on the canton it seems, even to keep your weed; obviously, you shouldn't be stoned as hell when telling (eventually lying to) the officer that you have never before consumed cannabis and that this bud was maybe for later (or just for its smell, what do I know?)...
Still, possession of over 10 grams and proven private consumption remains illegal and results in a record and a fine from 100 to 1'000 CHF for the first time plus additional fees. Sharing, making a gift, or selling of anything with more than 1% THC content or driving under the influence is considered highly illegal and as soon as it looks like you're making a living from trade, you get at least 1 year behind bars.

'Weed' with less than 1% is commonly called 'hemp' and yes, hemp exists, also in Switzerland ;) . Although, only registred farmers have the right to ask permission for hemp plantation but only of registered cultivars (which is for now exclusively 'Fédora 17').
BTW, the EU limit is at 0.3% (AFAIK). Why the Swiss government set the limit at 1% is traditionally influenced as the fibre hemp grown formerly in Switzerland wasn't subjected to THC limits and hence a lot of the traditional cultivars and varieties contained considrable amounts of THC (and were consumed in a most illicit but pleasant way :D ). To maintain a certain flexibility for farmers to breed new strains (there are at first always a few outliers when doing crosses), the limit was set rather high. Then, some politicians (that is, functionaries well payed for not using their brains properly) decided to circumvent that freedom by introducing the restrictions on cultivable varieties to 'Fédora 17' (no idea why just that, it is neither the best fibre/seed cultivar nor has the lowest in THC content; I honestly suspect Syngenta as the true reason why, it's them who sell Fédora 17 in Switzerland)...

What I'm saying Only is that if they legalize or decriminalize a class of Hemp/Cannabis that isn't fit for consumption then it means very little. Presumably they would test weed they catch people with and all would be guilty of breaking the law.... if I'm reading this correctly.

Naw... hemp is now defined as cannabis with less than 1% THC and hemp was/is principally legal whereas cannabis (i.e. plants with more than 1% THC) was always illegal (just sometimes more, sometimes less) and remains illegal. Only that since Okt. first, minor offences are decriminalised; you still pay a fine but don't get a criminal record for it. Sometimes, you even get away with a shock ;) . The new law is in some regards a bit more tolerant but in most stricter than before and there are a lot less gray zones (apart from the one where you get caught with less than 10 grams on you and are seemingly a non/not yet consumer).

In case they catch you with weed (either smoking or with more than 10 grams), then it is likely that it's cannabis and you end up in the police station; sure, if you insist, they will test THC concentration first and make amends later ;) .
