Ending Federal Marijuana Prohibition Act of 2013 - Directs the Attorney General to issue a final order that removes marijuana in any form from all schedules of controlled substances under the Controlled Substances Act.
Amends such Act to: (1) provide that schedules I, II, III, IV, and V shall consist of the drugs and other substances that are set forth in the respective schedules in part 1308 of title 21 of the Code of Federal Regulations; (2) exempt marijuana from such Act except as provided in this Act; (3) revise the definition of "felony drug offense" to exclude conduct relating to marijuana; and (4) eliminate marijuana from provisions setting forth penalties applicable to prohibited conduct under such Act.
Prohibits shipping or transporting marijuana from any place outside a jurisdiction of the United States into such a jurisdiction in which its possession, use, or sale is prohibited.
Eliminates marijuana as: (1) a controlled substance for purposes of the Controlled Substances Import and Export Act or the National Forest System Drug Control Act of 1986, (2) a dangerous drug for purposes of federal criminal code provisions authorizing interception of communications, and (3) a targeted drug for purposes of provisions of the national youth anti-drug media campaign under the Office of National Drug Control Policy Reauthorization Act of 1998.
Amends the Federal Alcohol Administration Act to set forth procedures for the issuance and revocation by the Secretary of the Treasury of permits for importing, shipping or selling in interstate or foreign commerce, purchasing for resale, producing, packaging, or warehousing marijuana. Prohibits any person from engaging in such conduct without a permit, subject to a $1,000 fine and/or a $500 payment. Sets forth criteria for ineligible applicants and disqualifying offenses.
Subjects marijuana to the provisions that apply to: (1) intoxicating liquors under the Original Packages Act, the Webb-Kenyon Act, and the Victims of Trafficking and Violence Protection Act of 2000; and (2) distilled spirits under the Federal Alcohol Administration Act.
Grants the Food and Drug Administration (FDA) the same authorities with respect to marijuana as it has for alcohol. Transfers functions of the Administrator of the Drug Enforcement Administration (DEA) relating to marijuana enforcement to the Director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). Renames: (1) ATF as the Bureau of Alcohol, Tobacco, Marijuana, Firearms and Explosives; and (2) the Alcohol and Tobacco Tax and Trade Bureau as the Alcohol, Tobacco, and Marijuana Tax and Trade Bureau.
Directs the Comptroller General to review federal laws, regulations, and policies to determine if changes are desirable in light of this Act.




Once this passes, criminal and civil charges need to start piling up against the DEA for illegal raids of Medical Marijuana. LET THE REVOLUTION BEGIN!

This new standard set by the D.C. Circuit creates an appellate split with the First Circuit in Grinspoon v. DEA, 828 F.2d 881 (1st Cir. 1987), which held the Drug Enforcement Administration (DEA) cannot treat a lack of FDA marketing approval as conclusive evidence that a substance has no “currently accepted medical use in treatment in the United States.” The Grinspoon Court also held that for some drugs (like smoked marijuana) “there is no economic or other incentive to seek interstate marketing approval…because [they] cannot be patented and exploited commercially.” The D.C. Circuit’s standard not only conflicts with Grinspoon, however, it also sets such a stringent requirement on proving medical efficacy that future petitions to reschedule — such as those filed in 2011 by the governors of four states (CO, RI, VT, and WA) — will likely face similar uphill battles.
This means the DEA can be sued for damages relating to the improper evaluation and drug-control schedule of medical marijuana.

We all know this ain't happening buddy, at least not until 3/4th or more of the country has pro legislation and things are really getting set into motion. But a noble effort nonetheless!

More specifically though, Obama is a two-faced castrated fuck. He doesn't even have the guts to stand up for us when he knows its right even when he doesn't really have anything to lose. He's already been elected to a second term. The only few important things he has to do (aside from 100 vacations) would happen even if he legalized marijuana, like foreign relations and such.

Basically he just has no balls. Or I suspect he doesn't wish to piss off high powered people that would take care of him after his royal vacation highness ends his second term and has to leave his palace. Our suffering will continue so that he can eat cavier and stick his little pinkie up over a glass of 20,000 wine for the rest of his life.

^we should still pay attention and speak up. The more people that know about this and write letters to their representatives supporting it the better. The more people that tell their representatives that there is more tax revenue to be made in legalization than prohibition the better.

Does anyone really think that the government will do anything to get smaller? This bill has no chance of even getting voted on.

^one step at a time. before a politician will vote for a bill, they want to see overwhelming support from their constituency. Basically people who show up to the voting booth, aka old people, and people who donate money, aka corporations.

I agree with your opinions about Obama, but there's still a chance he could publicly change his mind. We're finally at the point where supporting legalization could be politically beneficial for someone like Obama. There's a chance at least.

It's only a matter of time before the prohibition laws are repealed. It might not happen with this bill, but it will happen at some point.

all these words are intelligent and passionate, it would be a shame to ignore the truth. BTW, Sanjay Gupta's special on CNN was very special. In this nationally aired broadcast, it mentioned how the FDA and DEA have ignored modern science and based class 1 schedule as being ignorant of the truth.

This documentary also produced the advertisement of a product called, "Charlotte`s Web" which is high in CBD. The name of the strain was affectionately giving it's name from a young girl named Charlotte. She was about 5-6 years old and suffered from 500 or so seizures per week down to 1-2 with the special strain named Charlotte (High CBD).
