New SCOTUS ruling on drug dog searches is not good

Today the U.S. Supreme Court unanimously ruled that "a court can presume" an alert by a drug-sniffing dog provides probable cause for a search "if a bona fide organization has certified a dog after testing his reliability in a controlled setting" or "if the dog has recently and successfully completed a training program that evaluated his proficiency in locating drugs."

Ive watched cops tv shows where dogs false alerted on vehicles. As long as one group pays off the other group I guess it's ok.

Predictable for sure. The is ruling we're all waiting for whether or not the cops need probable cause to let a dog sniff around your property...

I think the court, and the plaintiffs, are missing the point. It's not about trusting the abilities of a drug-sniffing dog. Those dogs are good at what they do and, of course, completely honest. The real question is, can the dog's handler be trusted? Handlers can cue their dog, intentionally or unconsciously, to alert. Therein lies the problem. It's not the dog, it's the handler that really determines if there is grounds for a search warrant. They seemed to have missed that entirely, discussing only the dog's qualifications.

if I ever see people on my property unannounced snooping around with dogs and guns, I will assume they a rippers, and I will treat them like any other trespassers, and unfortunately them and their dogs will perish and be buried under the house due to their own mistakes.

that smell

I ve heard a few cases where dog alerted and cops use this as probable cause and when they do the search no drugs are found but maybe some cash that they decided was drug money. Nothing is ever said about the false alert that allowed the search in the first place. Cops do as they please and make the rules up as they go.

It's true that this is very sad and wrong in my mind. Dog's are just a made up excuse to allow for a loophole trampling our civil freedoms.

i see some positive news on this front, SCOTUS affirmed the exclusion of using a drug dog at a residence where an informant's tip led them
