Can they get u busted just for your photos?

Suppose you had a few trees growing.

And you made a bunch of photos...

Lets make a step further and say you included yourself with these photos.

Years have passed, you no longer grow. But lets say these photos got into wrong hands.

If you have nothing on you, can they still bust you? Just from your photos? Or its got to be physical evidence, ie physical possession?

For a start I don't think they would bother, too much hassle trying to prove it.
Long as you didn't make any admissions then the ball is in their court to prove you grew those plants beyond a reasonable doubt, and it's always open to you to say in court that it was someone elses grow.
I have heard of one guy though who had records of his various harvests on his computer, and they used that as evidence that he cultivated cannabis.

When my friend got raided the cops went through his photo albums, told him if he finds 1 picture with his kids and any evidence of weed...that he would be charged with Child Endangerment--

I dunno man, like, can you argue the image was created by a friend, on their computer, a long time ago? Or you could argue that the picture is genuine, but the grow was that of a distant friends and you just got a picture with it cos you thought it was cool.

lots of people are posting pics of themselves with weed now, especially in CO. i rountinely see some of the CO med growers posting pics of their 40 light rooms with them clearly visible not even trying to hide their faces.

HOWEVER...you can only be convicted if you are a total idiot and incriminate yourself into cultivation or distribution.

now if you say "yea im a grower legal under state law, that is my garden i work at and im paid this much $$, im legal blah blah blah" have fun in court.

What they can and have done, is to catch you with the grow (Physical Evidence)...then use your pictures to prove multiple seasons of growing-- They have even been able to use it to increase plant count-- Fuggin' Bastards!!

Allthough photos can be used as evidence,You could argue u were in a place where weed is legal, ie holiday in Amsterdam. Also being in such photos is not proof in its self that you were actually growing the plants, could be a freinds ect.If your clean now I would not worry about it

Photos are physical evidence BTW, if a photo is taken of u committing a crime ie CCTV of you shoplifting, assault etc, it is still valid evidence in a court, one of the best actually

ok, this is a true story, someone i know ,had a good grow about 4 tree's give or take,totally sound guy been doing it for years and years with no problem as he was a pig farmer so the smell never was a issue,one day he was out and about and noticed a few strange cars around never thought anything about it. until he returned home and there was one of the cars on his drive with 4 police vans.totally busted and totally did not know how this had happened until he went in front of the judge .who preceded to tell him that his son's school had a special day where by all of the children had to bring in a photo from home which he liked,in the photo was the boys farther stood in front of what was later identified as the biggest cannabis plants in the midlands that the police had ever seen.lol true story
