What's new

if a gate has a latch on it

Huge reason....a "defensible" defense.

So if I drink a beer while mowing my front yard (no fence)--bam, I am technically drinking in "public". But if I there is a low picket fence and we are sitting in chairs on my lawn sucking up a brew--we technically not in "public".

Taking it a step further, what if you are mowing your lawn on a riding mower and drinking a beer? Would you get a DUI for that?

I'd recon to say its higher :)

If one isn't corrupt.. his brothers are.. thus making him now corrupt by allowing it to go on. Its their brotherhood.. they'll all lie for one another at your expense.

As stated above, the no tresspassing sign is key to the issue. Without the sign, a person can enter without technically tresspassing. If they enter and you tell them no tresspassing, they then have to leave or they will be tresspassing. Better to tell them before they get a chance to enter.

I'll take a wild guess at this one......

The one who can provide pictures of said fence & gate?

& ftr, 9 times out of 10 cops play by the rules & won't lie under oath.
Sorry I don't agree with the 9 out of 10 not lieing. From personal experience 9 out of 19 WILL LIE. The answer given to me on several occasions " the ends justify the means" Yea I know that's not the way it's suposed to be, just telling it like I lived it.
