This happened about 3 days ago.

Anyway while on my way to work, I was pulled over for 1 week expired registration (was unaware it had expired on me). Although I am younger I was dressed nicely in a collared shirt with Khaki pants as usual (so clean cut). I knew I had nothing in the vehicle and had never even smoked in the vehicle. The traffic stop went as follows.

Cop walks up to my window and asks for license and registration which I promptly provided. I asked what I had been pulled over for and was informed of the exp. registration. I was glad I wasn’t speeding and it was just a minor thing.

Police officer tells me it’ll be just a moment and walks back to his car.
He comes back hands me a warning and tells me I have 4 weeks to get it up to date and thanks me for my time. He takes a step away then turns around and says.

“I see you have a criminal record from when you were younger (no drug charges). You wouldn’t happen to have any weapons or drugs in the vehicle?”

To which I replied “no officer I do not”

He then says “so when is the last time you smoked dope”

I replied “I don’t appreciate that comment one bit because it implies I have used drugs before which I have not”

He says “I understand, so you don’t mind if I take a quick peek inside your truck”

I reply “no sir not without a warrant”

Cop whips open my door, pulls me out of the truck slams me to the ground and tells me I am being detained until a drug dog comes. 15 minutes pass with me laying in the snow freezing my ass off until he informs me the drug dog is unavailable and I am free to go.

So I know it would a been much easier just to let him search my truck when he asked but that just feels so un-american to not enact my rights.

So long story short what would you of done?

I would have pulled out my cell phone and started filming as soon as he pulled me over, and at this point I would be contacting the ACLU with that as evidence.
 
I am so sorry :(

This is certainly sad since I don't think the framers of our constitution would have thought the paper it was printed on was suppose to end up being illegal.

First I would file a complaint with the local police department. If I had the money, I would talk to a lawyer and see if he can get the dash cam video and see if you can milk any money out of them for the "brutality." That move by him was totally uncalled for and there needs to be some blowback in some form or another, otherwise this prick will do that shit every time he sees you. And there is no telling how many other people he has done this shit too already. Just because someone has a criminal record doesn't mean the cops can treat them like shit whenever they feel like it. Another thing, I know some states have a rule in the law that says you have 30 days from the time your tag expires before a cop can write you a citation for it. So he may have been wrong to pull you over in the first place.

Sounds like you did everything right. However, I personally wouldn't have used the word "warrant" and opted for "probable cause." Even if your clean, never consent to a search, because it gives you practice with denying cops their oppressive tendencies.

Thats what i would like to do, but with alot of that stuff its there judgement ya know to write you a warning or a ticket.

For example you get pulled over for going 11mph over. Your polite and respectfull your likely gunna get off with a warning.

You whip out a cell phone camera you no doubt getting a ticket with the max. fine.

So when interacting with the police i bite my tonge and am polite as possible, once i feel like it has turned into an investigation i remain silent. (Im no pro tho, ive only been arrested twice and that was many years ago.)

I just worry filing a complaint will have the whole police department up my ass, so i am pretty hesitant about doing so. Without a doubt the officer already had something up his ass and was in the wrong.

I just dont like 5-0 attention and feel like a complaint would have them trying to hassle me any chance they get. Some country we live when citizens think like that.

If you are in the US, that cop had a camera rolling on you as soon as he lit you up. All you would have had to do is contact the shift supervisor and he would have viewed the video.
You would have a winnable law$uit.
Your story doesn't wash.

Here is the proper answer to your posted question...
"Any drugs or weapons in the vehicle?"
"No." (Not no sir.)

"Do you mind if I have a look inside your vehicle?"
"What are you looking for?"

No matter what he says he's looking for your answer should be...
"If you have probable cause, you don't need my permission. If you have no probable cause, you may not search my vehicle."

Cop says "Have a nice day" and lets you go.

Its easy to think of what i should of said a few days later but when your in the moment its a lil harder

Im a fucking grower dude, u know how much leo attention i would get if i filed a lawsuit? i would have to up and move states. Plus around here a cop just shot an unarmed man accidentaly and got one month paid leave. Cant imagine what the punishment would be for what happened to me... mabey a apology letter or a knock and talk with the police sergant?

Indeed. I voted that I would ask for the warrant yet that's the option I would like to choose. It's easy to sit here and say that I would school the cop at his own game but I just can't say that will be the case. These people are professionals and interact with the public all day long; how often do we interact with cops?

I would have done the same except, i would have filed a formal complaint against the officer.

I wouldnt appreciate being slammed to the grown after declining a simple search. Just because you have a badge doesnt mean you have super powers.

hell no. good luck with filing a complaint. that very rarely goes well. instead you find a cop up your ass every turn.

I'm with joe, grab his badge number and call my lawyer. If you were calm and polite being treated that way by an officer with no probable cause is grounds for a lawsuit. At the very least file a complaint and get his ass fired.

No, not a chance. different countys, also theres nothing illegal about what happened for the police to become involved. It would be a civil matter, not 5-0

Fuck february, hope things slow down a bit for me lol

it was my first thought when i was getting pulled over that it might be related and shortly after i was allowed to leave, but after thinking it over a few time i realized not a chance.

The way to work takes me thru bumfuck no where, cop prolly had never heard someone exsercise there rights before and it set him the fuck off lol
