im pretty sure the doctor does not check your criminal history when issuing a recommendation that cannabis benefits you under state medical laws...

basically all you need to really grow is a rec, but some states require a state issued ID card which is a whole different ball game. here in cali, we are simply issued a paper that states that we benefit from its use, they want people to get ID cards so they can track you etc...

also some are scared that those who applied for state issued ID cards can no longer purchase firearms...those with recs can still purchase firearms because medical records are not part of the DOJ's background scan...but since you are convicted it doesnt mattter, just a heads up for anyone else reading the thread.

washington state here, no one asked about criminal background, parole, or probation during my visit to the doctor...they do not do any tests on bodily fluids either, and i'm pretty sure they didn't search me for weapons...(j/k). just medical records concerning your claim of illness/injury.
good luck.

I was gonna start a thread on this very topic.

I got busted in a non med state and am on probation. One thing I was ordered for probation is that I cannot be caught with weed in my possession, even though it is decrim in my state.

I was wondering what the possibilities are of moving to Cali to start growing legally.

Is this something that would be possible? I got a felony record for growing. I'd love to go legit.

depends how big you plan to go dubya. if its just for personal use and something small you should have no problem...however there have been lots of busts out here for commercial operations where the people had previous convictions in non med states...one guy in outdoorplot's town moved here from atlanta and had a huge field of 130 large plants, he was raided and in the article it mentioned about his previous arrests....

alot of cali landlords run background checks too, so they would probably see your record and have a good idea you are going to grow on their property....215 friendly properties are not hard to find, but they do charge above market rent...

if you got a wife or gf you could rent in their name and keep things under the radar...its never really "legal" to grow out here unless you are really only doing 6/12 plants.....most of us out here like to think we are legal but we are pushing the limits. my last plant count including clones puts me over 99 which raises the 3am paranioa anxiety bar a little....i might have 4 patient scripts on my door but i know they could still throw out my medical defense argument and then im really fucked.....if you follow the news they are raiding clubs and grows that were following state law and even paying taxes..feds and the DEA dont care about state law its routine in their cases to strip away the medical defense, google "joe grumbine"...his case is perfect example

As long as you are just growing personal amounts, there is no problem, at least in Cali as long as you're probation document makes no mention of being caught growing or in possession. Can't speak to other states.

In some states you can not form a collective or grow on a large scale if you have any prior felonies/convictions.

I personally would be very weary of growing commercially even in a med state if i had a prior drug conviction in another state. And something tells me you aren't thinking of just growing 6 plants when you move out here.

Also, since you are going to be on probation forever, I would very carefully read the terms of the probation and ask your lawyer about the legal ramifications of you growing after being convicted of growing. You might not even be allowed to move out of the state let alone grow somewhere else. I have read cases before where PO's find out about a personal grow and yank that person back and try to charge them. Not fun.

This is what I was referring to above. Sadly, no, you can't grow even in Cali until you are off probation. It's fucked up but unless the terms of your probation say "can't be caught with weed except in places where it is legal" then you are shit out of luck. Now are the odds in you're favor that nobody would ever find out? Yes. But considering you have a felony record, that is the last thing I would personally fuck with if I was in you're situation because if shit did go down, you are going right to jail, and probably for a long time.

yeah headiez think that'l b the case in CO & MI as well... can't recall, but probably NV too... the rules of one's probation will determine it & i don't blieve any of the states allow for medical mj to be used. if u'r a felon, then u gotta fig on the side that they'l fuck u & any rights that u might have left... not help/allow for u to smoke the ganja, ya know? lol

all the states i listed above will let felons enroll, just not if u'v had any drug related convictions... and that assumes they accept the transfer of you from whichever state u'r planning on moving from.

you'd might be ok in cali. You might have stipulations on your probation transfer from where your at, really depends on your current state, they may not even think about it when you try & transfer. I've known & seen people transfer supervised probation and get a 215 and be back to work.

If your on Parole the answer is no. Probation maybe it would depend on what the requirements of your probation are. Probation and Parole are two different things.
