Judge Vows To Put Anyone Growing Cannabis Immediately Behind Bars



SHEFFIELD'S top judge has issued a stark warning to anyone caught growing cannabis in South Yorkshire - immediate prison awaits.

The judge said the number of cases of production of the Class B drug was on the rise, and he was dealing with three or four at court every single day.

Many defendants were unaware they would be jailed immediately, he said - - even if it was their first court appearance, they had no previous convictions, and they were growing the drug for their own use.

Judge Goldsack told one defendant: "Six out of the 14 cases on my list this morning involve producing cannabis on various scales."

And he added a guideline case at the Court of Appeal earlier this year ruled sentences for cannabis-growing "should be higher than they had been", and should "always result in immediate imprisonment unless there are exceptional circumstances".

"The Court of Appeal - putting it in simple language - has said the courts have got to get tougher on this," he said.

"Cannabis is a dangerous drug and those who bring it into existence must be punished."

Among those jailed at Sheffield Crown Court were:

- - Property developer [Name Redacted], aged 43, of Wightwizzle, Bradfield, Sheffield. He was jailed for three years and nine months after UKP 94,000 worth of skunk cannabis was found in the garage loft space of the =A31 million listed barn he was renovating in Cawthorne, Barnsley.

- - [Name Redacted], 43, of Coltfield, Birdwell, Barnsley, who was given three years for producing cannabis, and possessing a Class C drug and cocaine with intent to supply both. His cannabis plants were found in the loft during a police raid on a property in Wisewood.

- - [Name Redacted], 40, of Hay Green Lane, Birdwell, Barnsley, jailed for six months for producing eight cannabis plants with a street value of UKP 39,140. His mother, who is suffering from a tumour in her eye and was accompanied by his elderly father, wept in the public gallery as he was sent down. The court heard Brown had lost his job at Mercedes Benz because of the court proceedings.

- - [Name Redacted], 25, of Wellington Street, Goldthorpe, Barnsley, jailed for six months for cannabis production. Police found growing paraphernalia in the attic of the home he shared with partner [Name Redacted], 35, and seized five plants worth UKP 9,070. [Name Redacted] narrowly escaped custody after admitting allowing her home to be used for the production of cannabis. She was given a 26-week jail term suspended for a year and ordered to carry out 100 hours of unpaid work.

Detective Superintendent Richard Fewkes, in charge of South Yorkshire Police's drugs strategy, said over the last five years officers in the county had seized cannabis with a street value of over UKP 40 million.

He said the rise in production could be linked to the downgrading of cannabis from a Class B to a Class C drug five years ago.

Warning others not to get involved in the drug's production, he said: "A criminal conviction and jail is potentially going to ruin your life.

"It will potentially mean you lose your job and, if you are the breadwinner, that will impact on your family.

"You will find it difficult in future when you come out of prison to find a job because you have got a criminal record, particularly in the current economic climate, and there is a stigma that will remain with you for the rest of your life."

He added: "It's very difficult to hide the fact you are cultivating cannabis, even on a small scale. We undertake targeted operations but we are often alerted by members of the public. Neighbours might smell it or visitors might become suspicious."

How do these idiots get to be judges?? If a person is to 'judge' others, they should at the very least have some intelligence...one would think anyways. This judge doesn't even have a clue. Maybe he should think about his own statement for a while, he may even realize that if it were not for cannabis being illegal, these non-violent offenders would otherwise be upstanding citizens. The real sad part is I believe this judge thinks cannabis is the devil's weed and all the other bs propaganda.

I hope our members over there step up their security!

its a scare story, my sis just got caught with 135plants and got 120hrs community service, nothing for the amount she had there, ive also been caught with over 140 in my home and only got a £175 fine cos they couldnt prove i was selling it, ok the judge says caught for any reason but i bet its not really like that, they're really soft on it in the uk imo, well its a risk i thinks worth it lol

I've heard from a good source that police in the UK ain't interested in busting small home growers. They are after the Asian growers because the profits are leaving the country.

i got a 6month suspeded for a year and a 6 month drug testing order totally stopped my hard drug use did 10 clean test back at court yestrday for a review and judge r moore (maximum bob as we call the ****) threatened to send me back to jail cos my probation officer thinks i have distored views on cannabis and haven't been tested for it, i've done drug courses and am more qualified then probation and idiot judges, and if they try to test me for weed looks like i'll be going to the dam every month till they take my passport

We can grow papaver somniferum....opium poppy ( as long as you don't draw the opium out )...but the government will not allow us to grow cannabis a herb that imo should be now taken out of the misuse of drugs act here in the U.K and around the world.......it is the safest drug to take recreationally or medically.

Whats up with Yorkshire?....fucked up shit.

LIBERAL DEMOCRATS: PANEL SHOULD CONSIDER LEGALISING CANNABIS

An independent panel should consider legalising cannabis as part of a wide-ranging review of drug laws, the Liberal Democrats said.

The experts should also consider whether possession of any currently illegal drug should remain a criminal offence.

The motion was passed by the Liberal Democrat conference in Birmingham as a senior lawyer told activists that current drug policy is not working.

Alistair Webster QC, a crown court recorder and chairman of the Lib Dem lawyers association, told the conference: "I have practised in the courts, both as an advocate and judge, for over 30 years and it's plain to anybody who has spent time in that way that the drug policy which we have followed since 1967 is not working."

He acknowledged that "decriminalisation, per se, carries with it its own problems" but said the motion called for an "intelligent reassessment - start again, look again and see where we can get it better".

Ewan Hoyle, from South Glasgow, proposed the policy and told the conference that politicians had not tackled the issue because of "cowardice" in the face of a potentially hostile backlash in the press.

He said: "The war on drugs is not working, but it's essential that we keep fighting. Drugs are harmful, they can take young people to places that are every parent's worst nightmare: insanity, disease, destitution, prostitution, death.

"We have to keep fighting in the best way we can to stop young people from all walks slipping into lives of misery and early graves.

"But we are still fighting a massive 21st century drug problem with 20th century methods."

The motion calls for a panel to review the 1971 Misuse of Drugs Act and consider reforms of the law so that "possession of any controlled drug for personal use would not be a criminal offence".

The experts would consider whether possession would be "prohibited" but "should cause police officers to issue citations" for users to appear before panels who would determine whether health, education or social interventions were necessary.

As an alternative, the panel would also consider "potential frameworks for a strictly controlled and regulated cannabis market".

Mr Hoyle called for cannabis to be sold in chemist shops where it could be regulated.

He said: "The motion calls for models of cannabis regulation to be investigated. I personally favour sale from pharmacies.

"If we want to send a message that cannabis is harmful - and we should - - how better to do so than through a health professional at the point of intended purchase?

"No pharmacist is going to suggest the customer progresses to the use of heroin or crack. And no pharmacist would sell to a child."

Mr Hoyle said in Portugal and Switzerland they had followed expert advice to treat drug use as a medical rather than a moral or criminal issue.

But in the UK there was no political will to change the system, which resulted in a UKP6 billion illegal drug market.

He said: "It isn't taxed and the vast majority of the profits go into the hands of organised criminal gangs. This includes millions of pounds to the Taliban in Afghanistan, with which they can purchase the bombs and bullets that murder our brave soldiers.

"We have to stop enriching our criminals."

The drug trade had created "criminal idols" - drug dealers who are looked up to as role models and employers in deprived areas.

"We could undermine these criminal idols if we removed their control of the drug trade and placed it in to the careful hands of the state", he said.

Activist Adam Corlett accused politicians of double standards over drugs policy.

He said: "Many MPs and even ministers seem to be more averse to drugs policy than to drugs themselves."

Duncan Scott, from the Oxford East Lib Dems said: "There's a hypocrisy in our drug laws. Culturally, our attitude towards drug use just doesn't merit our attitude towards other forms of illegal behaviour."

George Miles told the conference: "Taxation of cannabis could net UKP2 billion a year, says one estimate, which would build hospitals instead of funding terrorists."

He added: "John Lennon and Eric Clapton didn't say legalise heroin or cocaine, but Bob Marley says legalise cannabis."

But Councillor Julian Cooper, from Witney, spoke against the potential legalisation of cannabis.

He said: "I think there's a misconception in this that legalisation would solve a lot of those problems."
