POLICE RAID ON GILBERT HOME SPARKS MEDICAL MARIJUANA OUTCRY


A couple hours after a DirecTV worker saw marijuana and hashish inside a bedroom closet of Ross Taylor's Gilbert home during the installation process of a satellite dish, 12 Gilbert police officers wearing masks and toting guns busted into his house and took his pot.

Taylor, 35, is a card-carrying medical marijuana patient under Arizona's new voter-approved law, who said he uses it for a severe loss of appetite and sleep due to post-traumatic stress disorder and anxiety.

But police said Taylor was not in legal possession of about 2 ounces of pot and a small amount of hashish that officers confiscated with some paraphernalia from his Gilbert home in the 7100 block of South Fawn Avenue on June 9.

Whether legitimate medical marijuana patients will become targets of prosecution involving how they obtained marijuana remains to be seen, as no such cases have reached the Maricopa County Attorney's Office, but Taylor said he believes the satellite worker overstepped his bounds by calling police after he showed him his medical marijuana card.

"The worker saw the marijuana in my closet and I told him, 'Don't get weird on me, I'm a medical marijuana patient,' " Taylor said. "He proceeded to tell me he was OK with it, and that he voted for it. I feel the police overreacted."

Arizona voters approved medical marijuana with Proposition 203 in the November general election, and regulations were finalized in April, but police said there still is no legal way marijuana can be obtained as no dispensaries have been opened or licensed to sell it.

Taylor, who also lives in Prescott, was moving into his Gilbert residence at the time he was handcuffed and cited. He told the Tribune on Friday that he received a call from Gilbert police Cmdr. Ken Buckland, who told him on Thursday they were going to try to charge him for possession of a narcotic drug and possession of paraphernalia because he said he bought the marijuana from another person.

Taylor owns Cannabis Patient Screening Centers, a company that refers patients to doctors for medical marijuana purposes.

"People are masking themselves as medical marijuana dispensaries, but no one is licensed to sell it and no dispensaries are open, yet," said Sgt. Bill Balafas, a Gilbert police spokesman. "Gov. Jan Brewer is waiting on a response from the federal government, because although we're following state law, selling and distributing marijuana violates federal laws."

As for the number of officers that responded to Taylor's home, Balafas said, it's not unusual to have that many officers respond. "There were five undercover officers and seven from the criminal apprehension team," he said.

"By law, the Department of Homeland Security, which oversees the cards issued to medical marijuana patients, does not release the names of the patients. We don't know if someone is a medical marijuana patient and possesses a card until we ask them."

Balafas also told the Tribune on Friday that the satellite worker who reported the possession told investigators that Taylor said he was selling the marijuana, which is illegal.

"That's not what I said," Taylor told the Tribune. "I said I got it from someone in Prescott. I freely received it from them."

Taylor said if he is charged he will fight prosecution with the help of an attorney.

Under provisions in the Medical Marijuana Act, there are three ways a medical marijuana patient can legally obtain the drug: through a dispensary, through a caregiver or from another medical marijuana patient.

Legally, medical marijuana patients can possess up to two and a half ounces of marijuana. Buying it from someone else is illegal, according to the state Health Department.

Three workers for the Phoenix-based company All My Sons Moving and Storage, who were moving items into Taylor house at the time officers executed a search warrant, also were handcuffed.

"A couple of the guys were upstairs and heard someone shout, 'Gilbert police!' and they thought somebody was joking," said Kevin Anderson, a manager for All My Sons. "The workers were detained, police confiscated the pot and then our guys finished their job.

"Obviously, there's a lot of red tape involved," Anderson said of the issue.

Meanwhile, the Maricopa County Attorneys Office still is waiting to see if there will be an onslaught of cases involving people who possess marijuana for medical purposes. It isn't known whether the office will receive Taylor's case.

"This is all new to us," said Jerry Cobb, a spokesman in the Maricopa County Attorney's Office. "One of the problems we have with the law is that it's vague, but we have been very careful not to create a road map and create a criteria that would lead to formal charging. So far, no agencies have submitted any cases for formal charging involving marijuana medical card carriers. Either people aren't being caught, or if they are being caught, agencies aren't submitting them to us."
 
It seems a lot of people wear the T-shirts and talk the talk, but not so many snitches end up with stitches at the end of the day. Even fewer end up in ditches.

That should change.

Everybody should take a couple minutes and send a nice polite email to the CEO of DTV.
Be nice and polite, but let him know that we won't pay for their employees to fuck with our privacy in our own homes.

If DTV is rejected from every single MMJ patients home, how many thousands of customers will DTV lose?

I cancelled mine today and politely told em why. The lady tried everything to explain that it was an isolated instance and that "our people" here don't do that sort of thing.
I asked if the guy who made the report in AZ had been fired, she said she didn't know.

This is a HUGE opportunity to send a message to corporations like DTV that we are done taking it laying down. We pay for their services and products, but we aren't paying to have some snoopy, nosy POS search our homes and report back to LEO.

Why isn't this all over the boards and news feeds? We have a big community here, pass this on like a wild fire and let's drive DTV stock into the dirt with patients cancelling their DTV services. Ross Taylor would get a good chuckle out of knowing that 1 snitch cost DTV millions in subscriptions.

dude was dumb for leaving pot out in the open even if he was medical considering its new and still a gray area in the view of the pigs but wow, that DTV guy clearly has never dealt with gang bangers/people with connections/angry people before because if he pulled that shit in the wrong neighborhood, or in LA, or to me, that mother fucker would be getting a knock on the door of his house at 2am.

As I understand things the employee will be looking for another job.

I emailed the head office of DTV and cancelled my subscription and explained my reasons. I know of at least a dozen other people who did the same thing.

I got a phone call from the head of public affairs for DTV and she was quite irate about the newspaper article. It seems that a family member is a legal MMJ patient.

I seriously suggest that everybody who reads this follows the link in my previous post, and politely express your views and concerns about this issue.
It will make the guys night in jail and humiliation worth something more than just bullshit on a pot discussion board.

That's horrible, at the same time I am amazed he just had that stuff out in the open though, I am in ca but still put stuff away when a plumber or electrician or whomever comes by just in case

i aint cancelling my direct tv . one asshole worker dont mean shit. the guys that came to my pad seen my outdoor plants and i smoked 2 joints while watching them do their thing. no way in hell i am switching to dish

I wonder how much this tech actually 'snitched' as opposed to running to his buddies and flapping his gums. "Hey, you'll never believe what I saw!" and it escalated from there.

Im sure his boss, or his bosses boss threatened his job and livelyhood if he didnt snitch. Its like the computer repair guy who stumbles across sick deviant shit on a computer they are working on. He is obligated by law to report that shit. Of course this case is WAY different, but still a leverage that DTV can use apparently to scare their techs into snitching. Either way, I say fuck DTV. (Even though I am thoroughly pissed with my landline cable rapists right now...)

I took targeted ethics for IT. We were forewarned of things we'd discover in homes or on personal computers. If it ain't kiddy porn and/or nothing that constitutes public safety, we were strongly cautioned to stay out of others' business.

IMO, the subject received insult to injury when the tech feigned no problem, only to rat the poor guy out. Even if the tech is required to file a report, his no problem reaction was not unlike cops cuffing you 'for your safety', then doing whatever they want.

It's fluff to keep them from confrontation their sqweeb asses deserve.

Fuck that... Send a message to DTV that the people won't tolerate their employees invading our homes and conducting searches for the government.

The corporate office and DTV's finance department are the place to make the statement heard, because that is the only thing DTV cares about...
Dump your DTV accounts and tell em why. DTV will make a public statement saying that their employees aren't suppose to snoop and report, then they will send out memos to all their sub-offices in legal mmj states telling them to mind their own fuckin business.

Then they will offer all the customers who cancelled, a years service at discounted prices to hook back up again.

Do nothing and accept the fact that your satellite tv is more important that being free and secure in your own home.

If this is DTV-borne policy it's bad enough. If it's leo influenced, count on more home services doing same. I'll even have to screen cleaning services.:(

VTA thank you for posting another current interesting article for us. Obviously AZ is going thru the same growing pains we are here in Ca. "new and vauge law"...sounds familiar, it is good to hear they are being "very careful" in thier arrests and charging people. My guess is this will be dropped and may have done the movement more good than bad in the end. Hopefully the patient has the bucks to sue Direct TV for thier part in it. Cheers..DD
