"OUT-OF-STATE: What about patients from outside Oregon?

The Oregon Court of Appeals has recently ruled that there is no residency requirement for patients written into the Oregon Medical Marijuana Act. Thus, the court has ordered the Oregon Medical Marijuana Program to begin accepting patients from out-of-state.

Out-of-state patients will still need to visit an Oregon doctor; however, patient records documenting their condition may come to that Oregon doctor from the patient's primary care physician(s) from any state."

I saw this on a FAQ section of an Oregon MMP dispensary/wellness site advertising here on the mag. I have never heard anything like this, so this just means u could get a card for like vacations in OR? Dispensaries still aren't allowed to ship MMJ over state lines to non-com states, right?

Yeah, sounds like I could make an appt with an Oregon physician, bring my medical records and Cali rec. with me and if the Oregon physician believed I needed medical cannabis he could give me a rec.

hm interesting... might be smart to grab an OR card as my state is about to go medical, just not sure on who exactly all will qualify. who knows, if i already have a OMMP card it may be easier for me to get a card in my state. something to think about for sure.

Okay now I remember. See that's what happens when ya get older and more thoughtful, you get to think so hard sometimes that ya forget what it was you was thinkin of in the first place.

Anyway where was I? Oh that ruling in Oregon. Well as I understood it, it pertained to any qualifying patient under Oregon state law. There are some advantages of have a ticket in more than one state, but Oregon and WA and CA are of those who acknowledge legal patients from out of state. So have a card in any of them pretty much makes you automatically legal in the others. Just simply by the fact that the laws are constructed that way.

So if the legal "medical requirements" are easier in Oregon and you got a card there, then that would make you legal in the other MMJ friendly states.

Are you sure about that? You think I can take my Oregon card and walk into a dispensary in CA? Not what i've read but i've never tried it and it's not the way the law reads. Anyone know for sure?

Well I could be wrong but when WA passed laws protecting out of state patients it pretty much made it legal for them to buy and possess mj in WA.

So that in effect makes em legal in both states and anyplace else that has laws allowing mj.

How could a court in a MMJ state prosecute a patient with Crones Disease for mj if if is a qualifying medical condition under that states laws AND/OR another state has already determined that the person's condition could benefit from MJ?

That's the entire reason that nearly all of the MMJ states have the DOH controlling MMJ regulations. Laws and law makers can't over rule a doctors recommendation without it appearing cruel and inhumane.

just as an aside, most states do not recognise cards from other states.
