Legal grow-op bust could lead to RCMP lawsuit

A Kootenay woman says she plans to sue the RCMP for busting her licenced medical marijuana grow-op, after federal prosecutors confirmed she won't be facing any charges herself.

Velma Mullaney, 62, and her partner have licenses from Health Canada to grow 98 marijuana plants on her property between Nelson and Castlegar.

But she says in March police raided her place with guns drawn, kicked in doors and tore out her plants.

Mullaney told the officers the grow op was licenced but said officers refused to look at her permit or count the plants. Instead she was taken to jail and later released.

RCMP wanted her charged with cultivation, but on Monday the federal Crown prosecutors office said no charges would be laid. The office did not comment on why, but Mullaney says she now plans to sue.

'We're going to do a civil suit for everything they have done everything that has happened to the family. It's been a hard time for everybody," she said.

Mullaney's lawyer Don Skogstad says RCMP should have just counted her plants and walked away.

She is going to court on charges from previous bust of over 1200 plants could be why they had her staked out in first place but had nothing this time. They say she only had 1 plant over the license stated, but cops say they had evidence of recent cropping ...in any case she gets off this charge but she still has to go to court for the other 1.

If your renewal paperwork is slow coming are you allowed to continue growing.I,m just getting started as DG grower for af.He says he/we can grow as long as you got the original liscense.And the neweal was filled out and sent in?

had my license for 3 years alread. it expired in april, got hit june, got my renewal in september. still did not do anything about, lost thousands in equipment

fuck got a shitty lawyer... he's the guy who has been doing some serious federal work,

if i dropped the name you'd be surprised... I got the feeling Mark was looking for some serious cash before he'd really help... f'n lawyers

Sorry to hear about your shit kicking...
Lawyers....I know all about them...they do work against you to get a favor from the prosecution...but whatta you do.Hope you were able recover from the loss.
So....no growing for me while waiting for a renewal.I heard they got quite a few ppl in Halifax,who were waiting for the newmewal.
One young guy had a new truck car bike,lived in a pretty good house,and when the cops asked him where he got all the money to buy the new toys and he just said,well i,ve have my grow card for a couple of years...lol Thats a true storey.Lot o ppl. out there who don,t have a clue about the program
I was talking to a woman who,s Doc gave her a scrip for 3 G./day...she put a 1 in front of the three making it 13G./day.Said she was talking to people who had done similar things,then she wanted me as DG...I asked her if she was crazy....she said well we can make a lot of money before they catch up to us...lol
Hard to believe there are ppl. out who are so gullible.In my situation I,m going by the book

Yep, I'm in my 60's, sent in my MMAR papers about 6 weeks ago and have absolutely no intentions of doing anything that is not upfront. I just hope everything goes well, took quite awhile to get my family GP to sign my papers. People who abuse the system are putting those who actually need their meds in danger of refusal. So, in my opinion to those who cheat the system they get what they deserve when the hammer comes down. The MMAR program is in place for people who suffer medical conditions not to deal in cannabis.

Did anyone see the show on TV called, " In the Mind of Plants " it was on the Oasis channel, I think it is suppose to be on again in the middle of June, I only seen a short piece but it looked quite interesting. The short bit I seen was about plants having a memory.

it is unfortunate that such tendencies combined with government control have clouded what could be a very successful and well working medical program but remember this: the pot being produced by said types is most likely most definitely and most of the time not "Meds" . there will always be a demand for high quality meds and not street weed so rest easy. the beauty of the plant that I've seen in many situations is that it is resilient and with good intentioned people and positivity just cannot be stopped. that goes for all plants not just cannabis. how silly is it to be worried about what people and their egos and institutions can do to nature's gifts. the closet grower producing grade AAA meds will always exist and look now we see big facilities coming online with the goal of producing the same quality on a mass scale. the beasters boys are being pushed out by their own greed and lack of skill .
