Gov. Jack Markell signed legislation today authorizing marijuana growing, distribution and use for limited medical purposes.The General Assembly sent Markell the legislation on Wednesday.
The governor signed the bill this morning without the usual signing ceremony in order to initiate a one-year regulatory and licensing process for three not-for-profit dispensaries that will be authorized to sell marijuana to qualified patients.


Under Senate Bill 17, physicians could recommend marijuana for patients suffering from cancer, HIV/AIDS, multiple sclerosis, amyotrophic lateral sclerosis (ALS), Alzheimer’s disease and post-traumatic stress disorder.


Qualified patients who get a doctors recommendation and a state-issued identification card will be able to purchase up to 6 ounces of marijuana at one of the dispensaries.


“We made clear that this would need to be very limited in scope and actively targeted to only Delawareans with profound and chronic illness like cancer and ALS. It is. This bill needed to be about giving targeted help to the most sick in a way that made medical sense, and it is,” Markell said in a written statemen

Earlier this morning Delaware Governor Jack Markell signed legislation to make the “First State” the sixteenth to approve the physician supervised use of medical marijuana. This measure will allow qualifying patients to possess up to 6 ounces of usable marijuana acquired from any of three state-supervised distribution centers. Qualifying conditions for the program include cancer, HIV/AIDS, multiple sclerosis, amyotrophic lateral sclerosis (ALS), Alzheimer’s disease and post-traumatic stress disorder. NORML would like to thank all of the activists who contacted their State Senators and Representatives in support of this important legislation. The law must now undergo a one year regulatory and licensing process before the state’s three dispensaries begin operation. We will be sure to keep you posted on Delaware’s medical marijuana program as it develops.

Edit: Here is something i found which lists a couple more qualifying diseases if anyone is interested

The law goes into effect on July 1 and will permit people diagnosed with cancer, HIV/AIDS, multiple sclerosis, decompensated cirrhosis, amyotrophic lateral sclerosis (ALS), agitation of Alzheimer's disease, PTSD, intractable nausea, severe seizures, severe and persistent muscle spasms, wasting syndrome, and severe debilitating pain that has not responded to other treatments or for which other treatments produced serious side effects to possess up to six ounces of marijuana without fear of arrest.

The worst part is is that u still are NOT allowed to cultivate in ur house...
The law also allows up to 6 ounces a month i'm pretty sure...

Im assuming not allowing you to grow yourself is their way of trying to control everything.

Yes 6 ounces is correct which is fair i believe, thats 5-6 grams a day, which should be enough to properly medicate throughout the day.

I havent heard anything about concentrates or edibles being available in the dispensarys though?

Since the bill calls for the set up "state-supervised distribution centers" they will probably realize that they are also setting up the state employees at the distro centers, for federal prosecution...I suspect that in the end, patients will get to grow their own, since they won't want to put state workers at risk of prosecution...Seems to be the way things have gone in the other states that originally intended to set up state distro and then were dissuaded by the risk of federal pros.

Regardless, congrats to all of you in DE!!
I hope it will serve as an example to VA...perhaps they will then follow the lead of their neighbors to the north: NJ, DE and DC!! (and MD in a half-assed kinda way.)

What other states have this similar legislation? Im wondering since there is a no home cultivation how are the dispensaries going to get there cannabis and how will the quality and price be

^prob dept of agriculture......or the 3 club's will have to provide enough for their patient's.....and when they cant provide the sufficent ammount for patient's then what?this is a good step none the less..............now only if this was in a public ballot so we can really see the number's.........and who really care's......

The dispensarys or "Compassion Centers" as they like to call them, will grow, cultivate and dispense on site.

I also read about labs being put in place to test all the marijuana before being sold

I really hope you are right, i was thinking the same thing after seeing all these raids everywhere else.

I have been following this bill, and the reps supporting are really for mmj but really against patients growing their own.

If the feds start to crackdown on shit in DE, hopefully they do choose to let people grow their own instead of possibly abolishing the MMJ program

17 of 51 is one third of the states (+DC)! Soon half and then 2/3rds. The Prohibitionists have lost.
