Federal pot warning sent to Colorado lawmakers

DENVER
Colorado is the latest state to receive marijuana warnings from the federal government as state lawmakers mull regulating the drug.
The top federal prosecutor in Colorado sent a letter Tuesday to Colorado Gov. John Hickenlooper and some lawmakers. The letter says states shouldn't pass bills that appear to authorize the medical marijuana business because the drug is still illegal under federal law.
Other states considering marijuana legislation have faced federal questions. Earlier this month, Washington Gov. Chris Gregoire said she may veto a bill to license marijuana dispensaries after the Justice Department warned it could result in a federal crackdown.
Montana lawmakers passed an outright repeal of medical marijuana in that state after federal raids. The repeal was vetoed, but a bill limiting marijuana dispensaries awaits Democratic Gov. Brian Schweitzer.

DENVER -- Colorado Attorney General John Suthers has warned state leaders that federal prosecutors say state medical marijuana regulators are not immune from federal statutes outlawing pot.On Tuesday, Suthers forwarded to Gov. John Hickenlooper and state lawmakers a letter from Colorado U.S. Attorney John Walsh saying that the Justice Department "does not focus its limited resources on seriously ill individuals who use marijuana as part of a medically recommended treatment regimen in compliance with state law."However, Walsh cautioned that marijuana remains illegal under federal law, and the Justice Department will continue to "vigorously" prosecute individuals or organizations engaged in "unlawful manufacturing and distribution activity involving marijuana, even if such activities are permitted under state law."

Colorado is just the latest state to receive warnings from the federal government as state lawmakers consider legislation to regulate medical marijuana. Federal agents also recently raided state-sanctioned dispensaries in Montana, Michigan and California.Earlier this month, Washington Gov. Chris Gregoire said she wouldn't sign legislation to license marijuana dispensaries after the Justice Department warned it could result in a federal crackdown. The decision came after U.S. attorneys in Washington state wrote Gregoire that "state employees who conducted activities mandated by the Washington legislative proposals would not be immune from liability under the (federal Controlled Substances Act)."Montana lawmakers passed an outright repeal of medical marijuana in that state after federal raids. The repeal was vetoed, but a bill limiting marijuana dispensaries awaits Democratic Gov. Brian Schweitzer. Suthers had sought clarification from Colorado's top federal prosecutor regarding an October 2009 Justice Department memo that said seriously ill patients using medically approved marijuana treatment were not an enforcement priority. Yet, the memo warned that federal law enforcement's "core priority" remained the "prosecution of significant traffickers of illegal drugs, including marijuana, and the disruption of illegal drug manufacturing and trafficking networks."In his Tuesday letter, Walsh told Suthers that he had consulted with U.S. Attorney General Eric Holder about Colorado House Bill 1043, which would authorize state licensing of "medical-marijuana infused product" facilities with up to 500 marijuana plants and possibly grant state waivers to license even larger pot-growing facilities.

Emphasizing that "there is no confusion as to the department's views on such activities," Walsh wrote that federal prosecutors "would consider civil actions and criminal prosecution regarding those who set up marijuana growing facilities and dispensaries, as well as property owners, as they will be acting in violation of federal law."

State Sen. Pat Steadman, D-Denver, a sponsor of the bill, told the Denver Post that Walsh's letter only muddies the federal Justice Department's position on medical marijuana."We have had mixed messages from the federal government on this," Steadman told the newspaper. "I think this casts a big shadow upon this industry in Colorado. It does cause some uncertainty and trepidation."Walsh's letter noted that when the Justice Department issued the 2009 memo regarding 14 states with medical marijuana laws, Colorado's voter-approved Amendment 20 "authorized the possession of only very limited amounts of marijuana for medical purposes" by seriously ill patients and their caregivers.Since then, Suthers reminded Hickenlooper and state lawmakers, Colorado and other states have enacted medical marijuana regulations that "have resulted in the explosive growth in the numbers of persons claiming to be using marijuana for medical purposes." Currently, he said, the Colorado has about 123,000 registered medical marijuana patients.Suthers stressed his "great concern" about letters issued by U.S. attorneys in other states saying that state employees involved in medical marijuana regulation activities could face federal sanctions.

Even with the voice of the people in favor of the changes to the laws regarding mmj the feds just can't leave shit alone. Just goes to prove that the peoples voice don't matter.

I gave Obama the benefit of the doubt longer than almost all of you.

He can now plant his juicy lips on the head of my cock and begin to suck.

Fuck him, and all he stands for. He didn't just tell a half truth. He didn't just act disingenuous.

He lied,
straight up. He told me through his attorney general, in no uncertain terms, that they were not going to go after people following the state law. And now his mid-level hacks are literally threatening politicians in their legislative process.

Fuck Obama. I'll re-elect a Teabagger who hates me and my plants even more who is at least intellectually honest in his stupidity.

I hate liars more than idiots.

This is so fucking ignorant I dont even know where to begin... so lets just lay down some straight up facts.

1.) Under three years with Obama, we have seen far far far less raids then we have seen in a single year of GWB.

2.) Obama has not come out in direct opposition of MJ. The fact that in the last 15 years we have come from "I didn't inhale" to "I inhaled and didn't like it" to "I inhaled and enjoyed it, thats the point", Is such a huge change I dont think you have realized. In fact, it has become so much less of a social stigma that we now have republican candidates running a platform of legalizing marijuana should they become president in 2012.

3.) Obama is the first "black" president. Did any of you really expect for something of this magnitude to be jeopordized by ending the prohibition of marijuana in his first presidential term?

The goal of just about every president is to serve two terms in office, should I refer you to the last governor of california, who publically admitting to smoking marijuana earlier in his career was overtly against its use and production throughout his terms as governor, only to lower its penalty for posession from a misdeamanor to an infraction as his last official act...

I think we will see the same thing with Obama. He knows it's safe. He knows it's wrong that its illegal, but unfortunatly if he legalized or decriminalized marijuana in his first term it would be instant political suicide. Obama is by far one of the most intelligent presidents we have had in decades, give him the benefit of the doubt. If he fucks us over in a second term, then you can all stand on your digital soap boxes and scream "I told you so!!".

4.) You can stand on your princpals all you want, but would you really rather elect a president who thinks we all deserve to be locked up in jail, or would you rather elect a president who knows that marijuana shouldnt be illegal and does the most he can to keep it as friendly as possible without physically walking on stage with a joint in his hand?

I can't honestly believe you would elect a tea bagger who would not only say marijuana is devil weed, but would more than likely devote even more resources to locking all of us up for using it. Because even though the tea baggers like to act all fucking patriotic and keeping the guvamint outta our buznass, I guarantee you they would have no problem releasing the DEA dogs on each and every one of us.

Just my .02 cents. But I have dealt with these tea baggers and even though I side with their core beliefs (less taxes, smaller gov, increased states rights) they only want these things as it applies to THEM, not as it applies to EVERYONE. Sure, are there a few TBers that smoke weed, probably... But if I had to put a number on it, id say more than 99% would lock our asses up with a big ol grin on their smug face for putting another "doper" behind bars.

Keep pushing the obama agenda its just gunna get us in a bigger shit hole. Please tell your president to stand up and protect our borders and stop supplying the cartels with us weapons. I would risk going to prison for growing an smoking weed, to have our country safe again and have legal residents paying taxes so our system quits getting raped. But you would rather have a dumbass run the country so you have softer weed laws.

Honestly, I think a majority of these government agences see the writing on the wall and know that this low hanging fruit is starting to dry out. They are trying to pull out every stop to help justify THEIR salaries. Sure the end of prohibition of cannabis will create a whole new industry and 'lots of jobs'. But it will also force alot of these bloated government agencies to trim the fat. This means jobs lost for somebodys family. (Whether we agree with what they do or not)

Couldn't agree more AG, it's all about money in the end. Although unemployment is already way too high, I wouldn't mind seeing a few thousand DEA added to the official number. Whatever happened to the rush of states and their 10th amendment resolutions??? And if 26 states pass pot laws, doesn't that necessitate a review of federal law? in a "democracy"?

It's is hard to believe that after all that has happened, Obama still has ANY SUPPORT from the MMJ community.

He has DONE NOTHING to stop raids by the feds into states where THE PEOPLE HAVE SPOKEN and voted, legally, to have medicinal marijuana programs, or even the supplement industry where the FDA and DEA raids, swat style, into legitimate businesses and treats Americans JUST LIKE TERRORISTS. Taking bank accounts, shooting animals, and terrorizing legal, legit businesses and all the people working in them.

How can ANYONE defend that???!!!??? Obama gets a Nobel Peace Prize for starting 2 new wars???? What the hell planet do I live on?

Vote these idiots OUT. Never accept compliance, fight for your right to treat yourself and your medical conditions WITHOUT federal government interference. Even if it that government leader has a great speaking ability and is likable if only because he isn't a Bush.

^^^^^^^^ what he said!!!!!! short, sweet and 100% pure truth.

The only time the people's voice is going to mean anything is the day every ameican protest's together. A non violent protest where every single American stayed home from work for 1 day. Then threatned a 2nd day if things did not change.
