A 62-year-old woman from the Castlegar, B.C., area says RCMP raided and damaged her property and hauled her to jail even though she has a licence to grow marijuana.

Velma Mullaney said that despite a Health Canada permit that allows her to grow 98 plants, police showed up at her rural home last month, kicked in the doors, cut off her electricity and confiscated her marijuana.

The officer in charge refused to look at her permit or count the plants, the grandmother said.

"He kept saying, 'You are way over in plants,'" Mullaney said. "I said, 'Get those guys to go in and count them and you'll see everything is legal.' And he kept saying, 'You are way over and you are going to jail.'"

Mullaney was taken to jail and later released. No charges have been laid.

Her lawyer, Don Skogstad, said he doubts charges will be forthcoming.

"It is one thing to believe you have grounds for illegal activity," Skogstad said. "But once you get there and you can see how many [plants] there are and know about the licences, why don't you just leave?"

He said Mullaney may sue the RCMP for damages and file an official complaint.

Police would not comment on the case.

What else do you all expect ? I doubt there is a RCMP out there that can count as high as 98 or have the ability to read & understand an official permit .

She needs a proper lawyer that will take this all the way. If she wasn't over her limit and nothing else was fishy she could take them to the cleaners.

*May* sue?

This is a clear cut case of police acting illegally and against the constitution.

Since Skogstad is obviously out of his league, hopefully a lawyer worth their salts will take this on pro bono and sue the RCMP and the officer involved in civil court.

This moron should lose his badge. This is akin to driving down the road in your own car with a valid driver's lisence and having a cop pull you over and take your car for driving without a license. It's insane- the lady is exempt from the CDSA as it pertains to cannabis as long as she is under 98 plants and within her storage limits...... the pigs broke the law straight up and should be held accountable.

I'm going to bring this case to my lawyers attention and see if he will get in touch with her and go forward pro bono, so we c an put an end to this type of thing. I'd be suing for the value of the crop plus damages.

what i want to know is how a 62 yr old grandma gets "suspected" as a grower in the first place... or how it came about that she got "busted" for a med grow. interesting. i guess nobody is safe.

I know of a couple of ladies in their 50's/60's that grow. One grew for her son who had cancer. The doctor suggested he consume oil which worked wonders for pain but because his cancer was spreading they didn't bother to get a license so she grew illegally. Unfortunately he passed away three months ago.

I know another lady in her 50's who grows to support several dogs she owns as she feeds them raw food quite a bit and its quite expensive.

You'd be surprised what kinds of people run a few light illegally to help put with bills.

That it the real issue....Cops think they are the law, therefore they don't have to follow the rules (law) themselves! Politicians, Judges, CEO etc....Sorry ass fuckers

This is when their inflated price of Marijuana will work in our favor.

98 plants x $1000 per plant = $98,000

They owe her big time!

This is beyond shameful- a fine elderly lady having to endure the shock and humiliation is sickening.I guess if they were not psychopaths-they might actually feel some remorse for their actions.Talk about being indoctrinated.

This lady has probably contributed a lifetime of positive things for family and society and to have to deal with this because she needs to reduce pain..so damn wrong.
