Am I being too paranoid??

I have had a medical license in california for multiple years, and recently from my new doctor I got an sb420 exemption. I was thinking of growing a few more then the county limits because the plant counts are very unreasonable and frankly make no sense. I know of the people vs kelly verdict but I still worry even if I have only 6 plants. I often read feds only seem to be involved in operations over 100 plants. Has there been any recent prosecution for a small personal grow of say 20 plants or less? I recently watched the colombia mi. raid for the first time where the dea shot the dog and I have been worried. I would be devastated if my dog was shot.
Am I being unreasonably paranoid?

Aloha TGS:

I am far from being an attny, and so this is just my understanding not necessarily the truth.

In California the local police can and will still make marijuana cultivation arrests. We have the protection of using a medical necessity defense against prosecution but not against arrest (I think the state card prevents arrest but it puts you on the list). The reality is no matter how many plants you have you will be a potential target for LEO.

I see the plant exemption as a form of cheap insurance against arrest/prosecution, but it may not work to keep you out of the can until the local DA decides whether to file against you. I also believe that once you are on the radar of local LEO no amount of paperwork will stop them from doing what they are trained to do. Once you are in the system the exemption will help your case in front of the judge, but you still have to be there to use it.

That being said, remember rule 1 keep your head down and do what you will.

If the Feds come knocking (knocking....right) your paperwork is useless, it seems that the federal government does not consider marijuana medicine at all and so you will be arrested and prosecuted/convicted if you are growing.

The bottom line is we are still in need of caution and privacy to make our own medicine, regardless of the amount, be safe be stealth and grow what you need.

I hope my perspective helps...

I'm Canadian, so I'm allowed 20 plants(God bless Canada). However, is there a limit to how much you can grow(ounces, lbs, etc), or just the number of plants? Some people that are only allowed a small number of plants grow them big and hammer them with lights(1000 watts per plant I've heard). This gives them a much higher yield per plant(a pound per or so). This may not work for you though if you have space or budgetary restraints(more lights=more money). I'm a newbie though, so this is just second hand info i've been told from an experienced grower.

tgs, you said your doctor gave you a sb420 exemption, how many plants and ounces does it state on it? The regular "guideline amounts" set by sb420 are what was beaten by kelly. It is pretty much in the drive of the enforcing authorities as to where they will draw the line. The more low-key and mellow your grow is, the better IMO. Alot depends on the local LEO point of view. Don't piss 'em off and you will be happier!

not to hijack this thread, but this thread made me look up the CA law for med patients. it states "six mature (or 12 immature) marijuana plants" (according to NORML and every other website.)

does this mean I can have a total of 12 plants with a max of 6 in bloom? like 6 mothers and 6 in flower? or does that mean if you have any in bloom you can only have 6 total?

would suck if it was 6 total. how are you supposed to hang on to good genetics?

The numbers were thrown out in court awhile back, its up to you and your doctor. There is no 6 and 12 anymore in California. My rec says I can have 52 oz.

It doesn't say anywhere on my rec...I remember signing a paper that had the rules on it, I think it said 6 in bloom, 6 in veg...but to be sure i checked NORML. youd think theyd keep that updated...

sb420 guideline is either 6 mature or 12 immature not both, so each mature plant you have takes away 2 immature plants from the total of 12 immature plants. The weight allowed is 8 ounces of dried flowers.
My doc signed off on the 18/36 & 54 oz exception I took in already prepared for his signature at no charge because he said it didn't matter anymore after the People v Kelly decision.
