And after collecting some decent evidence THEN be able to get one. I would think an anonymous tip would still have to have some other basis for obtaining the warrant. Smell, traffic, garbage, ect.

Cops aren't that stupid, and a judge isnt going to risk issuing the warrant without some concrete evidence to warrant the warrant (pun intended) IMO.

That bust someone mentioned HAD to have something else to it. Those guys had to be watched for some time, or the place reeked, or something else. Maybe the tip led the cops to start watching, digging in garbage, ect. I believe there is NO WAY a search warrant can be issued without some form of evidence warranting the search.

Any evidence that you're growing weed is enough to get a warrant. Finding HPS lights, containers, soil and etc is not enough evidence as you can be growing tomatos, but those coupled with actual weed resin and/or a smell might be enough. Imagine you're a judge and a cop wants a warrant. What would be enough to have you sign a warrant without fear that you're busting an innocent family and ruining your own reputation as a judge?

Illinois is a shitty place to smoke/grow weed as far as I know. You guys have the stupid anti-kush law right? I wouldn't risk it. Scrape your grow and attempt to move out is my best advice. If impractical, at least scrape the grow and frame your neighbor if he's an asshole.

Correct, If they have a warrant, it will be announced immediately and there will be a violent crimes force suited up waiting outside. If this happens, you have no choice, your worst fears have come true.

A knock and talk is their sneaky way of violating your rights via intimidation. I would never answer a knock by LEO, If a warrant isn't announced when knocking, I'm not home and I will continue to not be home until there is a warrant at which point I hope I am really not home..

Police use scare tactics to get an admission of guilt because using the constitution is far too costly and well, it's just too much work for them. They want to bypass reasonable cause if at all possible and get that easy bust followed by a pat on the back resulting in 1 step closer to a promotion so they can violate even more constitutional rights.

If you're empowered enough with knowledge of your rights, and you've got a touch of charisma, you should never have to participate in a knock and talk. A simple "I do not have time for this" or "I assure you officer, there is absolutely nothing of the sort going on here" depending on the situation is all it takes to completely disarm a knock and talk in a reasonable fashion, provided you do it confidently.

There is no, I repeat no, indication of guilt for refusing to talk to the police. At the same time there is very little chance you could actually dissuade interested police from investigating further by talking to them. They will simply cross that off their list and continue to survey you, lol.

Here is all I gotta say about people who want to open the door and talk to the cops when they come to do a knock and talk: Dont do it dumbass! The piggies are trained to be a bunch of lying cocksuckers just trying to get you to do what they want. Personally, the only way I'll talk to the pigs is when they kick my door down. And then the only thing I will say is "I want my lawyer". If the cops come a knocking and you have a grow going on the best bet would be to move into the room as far from the front door as you can get.

dude if you have a small personal grow just tear it down....not worth catching a case for a small grow..

You should NOT open it and you should instruct the office to remove himself from your property; he is an uninvited trespasser.

Also if you are fortunate enough to have a house look into putting a front fence and gate up with a NO TRESPASSING sign. LEO is not allowed to open your gate or enter your fenced property without a warrant.

The other issue is that smell is totally subjective and any trained drug detection officer can simply claim "we smelled marijuana" and then detain you in your house because you opened the door in the first place and they will immediately enter your house on that reasonable cause of smell which has been ruled fully allowable in past court cases on state and federal levels. All based on just saying they smelled it and you having your door open, happens all the time on the side of the road during traffic stops and they find trunks full of bud all the time. I am willing to bet that sometimes they just say they smell it by default and it all really comes down to them just getting you to open up your door and give them an in so they can confirm their hunch. Smell or no smell it does not matter once you open the door because if they are intent on getting in most likely they will find a way.

If they find anything well guess what you are fucked and they are right they did smell it.

If not, they just say you must have recently smoked or had it there recently there is not much recourse for you in that situation. They are always going to be the credible witness.

It all can be simply avoided by just not opening the door because even then if they smell something or at least claim to they are going to be far more hesitant to break down your door with no warrant and if they really did go get one by the time they got back with it you are going to have your shit cleaned up or at least plants gone or chopped down if you can't get rid of them because they are sitting outside your house or something. When I had my knock and talk back in the Northeast years back they did wait out front for a few hours I think they might have been on the phone trying to get a warrant but luckily it never happened. So be aware they could wait to see if you leave with anything so be safe and don't be stupid if you find yourself in that situation just try to stay calm and remember that ultimately you are not some bad eveil person you are growing a wonderful beautiful plant that has been wrongly outlawed and is here by the will of God. If you do get in trouble and have a low number of plants for personal usage it's not the end of the world by any means you likely won't even goto jail for a first offense it's usually probation and drug classes where you can meet more stoners at along with plenty of hot girls usually and they all like to go get a buzz once class is over

I like to add a fourth one and it's Don't ever have over 99 plants. This includes seedlings, clones, males, they all count. So do old harvested plants with roots attached or used rockwool cubes with root bases in them so make sure you get rid of all that shit!

Dumbass, growers in our state can not afford the luxury of burning outside, in cities. It depends on the cop who you talked to, because you did enough wrong to be fucked. Some cops wouldn't give this a second thought, some see a shiny gold star if they investigate. If you have a lot of traffic, I would not be optomistic. It ain't over.
