mandatory minimums

so i was looking at the state by state laws on norml.org the other day (an excellent resource!!) and noticed that here in PA there are mandatory minimums for marijuana offenses; pretty harsh mandatory minimums:

*MMS 2 to 10lbs or 10 to21 plants 1 year; $5,000 (double if subsequent offense)
*MMS 10 to 50 lbs or 21to 51 plants 3 years, $15000 (if subsequent offense, 4 years, $30,000)

it kinda has me stressing out. does anybody know what the deal is with them? if one were to get busted with something for which there is a mandatory minimum sentence could one still plea it down? or is it set in stone and if you get busted you're fucked even if you're a nice jewish boy like myself?

a nice jewish boy with several priors, that is....lol but not here, and no convicted felonies.

i lived in OR, CO, and VT before this so i'm not used to this harshness.

mandatory means exactly that, mandatory....no getting out of it. Move to a medical state if you want to feel the relief of SOME stress

mandatory if they choose to prosecute full charges, you could get a better deal
best to check the local court outcomes, so much depends on your locale

PA is in that small list of states with god awful laws when it comes to bud where you shouldn't be growing unless your making a killing financially, otherwise it isn't worth the risk or long jailtime.

I personally believe it also is part of the reason why you can get such high prices for bud in PA

i think normls list is rarely very accurate

check the sate law directly

As far as I know NORML is almost 100% accurate all the time and is updated as the laws change. That is their goal in life, to educate and push legal efforts regarding marijuana.

Looking up the state law directly is never as easy as it seems.

I'd stick to NORML.

it isnt for my state and never has been

I you find that they are not listing accurate info for your state you should send them an email and let them know. they have a bunch of lawyers working for them. im sure they would fix any incorrect info pretty quickly.

I would assume that you are interpreting the laws wrong then. I find it almost impossible that your states page has never been correct. That is NORML's goal in life and they have multiple lawyers working for/with them.

Did you look up the state laws yourself? If so you probably read it wrong.

There is a huge difference in what State Law says...and what the actual Sentences that are being handed out are--
In Cali for sure...it looks worse than it really is--
We have skated in 2 separate busts of over 700 plants--:tiphat:

I know for a fact that the Colorado laws on the NORML site are inaccurate.

^to be safe you should ask your defense attorney. In the future it may be worth paying a lawyer for an hour of advice.

If you spot an error or have information that should be included in NORML's State Guide to Marijuana Penalties, please inform the NORML Foundation (foundation@norml.org).

If you are all so sure about the inaccuracies then you should do everyone a favor and contact them

i dont want to out my state but a mod of this site has pointed out the innacuraacy in a thread

hash zepplin has the best answer

for those who know how to read their state lawas and constitutions may find this useful

http://www.law.cornell.edu/states/listing.html

if you dont understand how your state lists its laws google up the law state and crime and see if the responces list the section of a, then go back to your state listing and see if they are congruent

understand that there are other laws that may not seem to be related that may also apply thsi is where a local attorney proficient in these laws wouddl be best to consult

if i were you i would simply keep a small growbox for personal use only if leo sees an entire grow room you're in cuffs in 2 seconds. however they might ( 1 in ten million) let a box slide.
i hope you didnt move there to grow.
in layman's terms the man. mins make make the judges inert they have no power in some cases.
