They saw the video on the phone, found out whose phone it is, found out I have 2 addresses, checked with the local electric company and saw that my bill was higher than the other apartments.

They did have a warrant. I received a copy of it today. Could they have been lying and then had one made up after the fact? Yes I suppose. But in either case, they had reasonable enough suspicion to get a dog if need be. The bottom line is they knew it was there and there was no way out of the situation. At least now they are going to say that I cooperated. I am assuming if there are any loopholes my lawyer will find them.

If you had that many plants you must be ballin like a motherfucka bro, why didnt your personal assistant (should be a half naked bombshell blonde with shaolin training) keep track of it for you? Seriously man that is a fuckload of plants, how big were they?

Vast majority were unrooted clones sitting it water. If you take a look at my recent posts you'll see I was having trouble cloning ever since the temps started dropping. So I compensated by making many more cuts than I needed. Also I had multiple small plants in single containers. Each counted as one. My grow was not very big at all. The DEA guy even said that it was much smaller than they had thought. But if it's got a stem it's considered a plant, so it was just really bad timing on top of really bad luck.

i think according to the definition of a plant by law even, it must have roots. If you cut off a branch of a plant it's still just a branch. That's something your lawyer should be able to work with I think.

People often only give med patients 6 rooted clones since that's how many plants each patient is legal to have but with cuttings I don't think there is a limit they will supply you. May save your ass that they didn't clone after all. I'm pullin for you.

In court and as defined by federal law as far as I know of, the "plant" must be rooted to count towards the total plant count numbers when used for determining mandatory minimum sentences and the like. If you had under 100 rooted plants, and can prove that then by all means your situation just improved drastically. Maybe that's why they claimed to be going easy on you because when it comes down to the sink or swim part of things in court they would have to prove those plants were rooted with the hard physical evidence and pictures if it was contested by your defense lawyer. I think as a result of that you may very well get offered a nice easy plea deal but if at all possible see if you can get around the felony even if you have to please guilty to multiple misdemeanors and do a little time, it's better than the felony which would never really go away. Lawyer up as soon as you possibly can and try to figure out how many plants you actually had rooted, and yes even little root nubs do count. :comfort:

If that's the case then there's no way in hell I had that many plants. I can't think of what on earth else they could have counted in order to get that number. What about the left over root mass and nub of a stem from after harvest? No leaves.

They would probably count any plant whether it's dead or alive that has it's roots intact I believe, it's evidence you grew it. Also by the time it gets to court they will all be dead anyways and dried up so it would likely be hard to prove what was dead or alive when you got raided.

Root balls count as plants, unfortunately I've been there.

By the time the evidence sees the light of day....it's a plant. I'm sure they took pictures, of what looks like a plant. Anybody out there reading, don't think your ace in the hole is trying to convince a judge in a federal courtroom your clones didn't have roots, you'd more likely come across as a smartass and piss them off.

Yeah it's way easier for them to bust you when you leave your phone with grow videos on it in a federal mail facility. Just sayin.

I got the keys back to the apartment and went back there today. Holy shiiite what a mess they left. All of the root balls with were left there, as well as a bunch of other stuff. I'm actually suprised they left what they did. Even a couple torn up branches here and there. Not a great job at taking all the evidence. If I had more balls I'd almost say it was enough to start over again. But, I aint fuckin with shit anymore. I'm prob marked for life.
