Medical marijuana advocates in Michigan are crying foul in the wake of recent demands by the federal government that the state health department turn over the records of seven legal medical marijuana patients.
According to the Associated Press, the U.S. attorney's office has asked a judge to order the Department of Community Health to comply with an earlier subpoena for the records of seven people with Michigan user and caregiver cards.
The request was made on behalf of the Drug Enforcement Administration (DEA), which would not comment on the case; there is no additional information available on whose records are being targeted. According to the report, the DEA first asked for the records in June. So far, the health department has declined because of a privacy provision in the Michigan law, according to the AP.
Michigan's medical marijuana law, one of 15 in the U.S. today (Arizona voters were the latest to approve one this past November) has been in effect since 2009. Voters there passed the new law by referendum with 63 percent of the vote in 2008.
This is the second time in a month that the DEA in Michigan has made headlines: earlier, DEA agents raided a warehouse outside Lansing, netting all of 40 plants (keep in mind, while the DEA would not comment Tuesday on the disputed subpoena request, a DEA spokesman said its agents only target "large scale drug trafficking organizations"). One report from Phillip Smith at the Drug War Chronicle said that in order to get at the cache of 40 plants, "heavily armed state and federal lawmen" raided a space caregivers had leased from the owner of Capital City Care Givers on Nov. 30, "breaking windows, throwing smoke grenades, and seizing thousands of dollars worth of equipment."
The proprietor, Ryan Basore, said his operation was completely legitimate, indicating that there were two legal, licensed caregivers operating within the leased facility. In Michigan, each caregiver can grow up to 12 plants for five patients and another 12 plants for themselves if they are a legal patient.
Critics say the state and federal cops went over a local judge's purview and instead got a federal warrant in Grand Rapids to conduct the raid. The DEA did not comment further at the time, citing the "ongoing investigation."
"These tactics and the continued attempts to undermine local and state medical marijuana laws must be stopped," charged Kris Hermes, a spokesman for Americans for Safe Access, in an email to Change.org. "The Obama Administration should stop trying to enforce federal marijuana laws when medical use is clearly evident or, more importantly, President Obama should change federal law to reflect the scientific evidence of marijuana's medical efficacy."
Michigan activists like Charmie Gholson, editor of The Midwest Cultivator, complain that Michigan will someday "be like California," in that local and county prosecutors and law enforcement agencies that do not agree with the state's medical marijuana laws will continue to raid, arrest and prosecute legal users, growers and caregivers, putting the medical marijuana community on the defense.
"We're building coalitions. We're doing what we can, on a local and national level, to say, 'hey, we need help here,'" Gholson told Change.org, insisting that the Obama administration has the last word. It can take marijuana off the list of Schedule I controlled substances, Gholson said; in other words, legalize it federally.
"Who is is going to hold the Obama administration accountable and finally reschedule marijuana on a federal level? That is what we need to do."
Activists often refer to U.S Attorney General Eric Holder's 2009 memo telling federal authorities to stand down on raids and the prosecution of growers and users operating within state law in California. The raids have not stopped, however, nor have the prosecutions. And Obama has not made further pronouncements where medical marijuana is concerned. The attorney general's office did, however, say it would continue to prosecute what it considered illegal use and possession under federal law if California voters had decided to legalize marijuana on the November ballot. The legalization initiative ultimately failed, with 53 percent of Californians voting "no" and 46 percent voting "yes."
Gholson said the two year old Holder memo has no teeth, and until the administration steps in, activists feel as though they are facing a Goliath.
"We're working on educating and informing and gathering up the funds to fight this on a legal level, but it's the DEA for godsakes, why would they listen to us? They answer to the Obama Administration," Gholson said. Ultimately, they take orders from Attorney General Eric Holder.
Meanwhile, Hermes said there were similar raids in Saginaw County around the same time as the disputed subpoenas were issued. "No one has been prosecuted as a result of those raids, but the rationale for the raids was clear: intimidate the patient community and undermine efforts to implement state law."

This is a sad but not unexpected development in the Federal government's continued "War Against People". The Obama regime, through the appointment of Gil Kerlikowske as the Drug Czar, and Michelle Leonhart as the head of the DEA, is attempting to put "the toothpaste back into the tube" (so to speak) regarding his Attorney General Eric Holder's memo "not to prosecute entities in State(s) MMJ programs that are in compliance with State laws."

Consider that Michelle Leonhart was approved by the US Senate with no "nay" votes. Neither Democratic nor Republican politicians can be trusted to be a voice for the people, who in ever increasing numbers across the USA are coming to the conclusion that the "War of Drugs" against cannabis is unjust. The Federal government is losing its long 70+ year battle for the "hearts and minds" of wannabe prohibitionists, which began with such propaganda as the movie "Reefer Madness". If none of our mainstream political parties or the politicians aligned with them are willing to support the will of the people instead of the crony corporations that pay their campaign re-election bills, why should we the people continue to vote for them?

I cannot fathom why anyone would. The USA Green Party has had a plank in their party's policy platform for the re-legalization of cannabis for many years. A few other politicians aligned with either the Tea Party or Libertarians have spoken out in favor of re-legalization as well, albeit their voices have not resonated with the bulk of their political movements. What will it take to make our politicians listen to we the people instead of their "vested interests"? Can their "vested interests" vote? I don't think so, at least not yet. But these private for-profit corporations can and do, thanks to recent US Supreme Court rulings, have the power to buy the elections and the votes of our politicians themselves. Some brave and independent lawyers need to come forward and investigate whether the funds seized by State and Federal LEOs under current asset forfeiture laws are being used to (effectively) subvert the rule of law, by buying or influencing the votes of our politicians. AFAIK, this is fertile ground for investigation, and if proven true should provoke the harshest possible prosecution of all involved under State and Federal RICO statutes.

I only see it getting worse for us all in all legal states. We have never had rights just look at the this crap and it's not the first I have seen. I wish us all luck in the coming future.

And how about Obama? Whoomp Whoomp Whooooomp! FAIL! What a Dick! I hate to admit this, but for a second there, i really thought he was for change....LOL...I know, What the Fuck was i thinking..... I guess the Kool-Aid was good.....

Bottom line, We need to get some people in office that represent US, The Mother Fuckin People! Sick of this shit! Sick of it all.....

I often wonder if the legal med states arn't just making it easy for the FEDS to round up growers just to strut their power. This could make ppl think again about settin' up a (legal?) dispensary or being a (caregiver?)..... I mean really? Looks like an easy way to get on a LIST.

Read the rest of the article bro, it gets worse. Across town, the DEA raided a (allegedly legal) 40 plant operation, complete with high powered rifles, thousands of dollars worth of damage, dogs, and smoke grenades.


If the term "terrorism" is to mean anything in today's vernacular, the Drug Enforcement Agency is the number one terrorist threat to citizens of the United States.

I just get so worked up over this man I can't even contain it. I wish I could just let it pass over but I can't. My parents and my friends and people truly sick have put so much work into the movement. Little by little we see it's basically for nothing. The elite will find ways to bypass majority opinion, laws, and everything else.

My grandpa got robbed in his later days, and used to sit around with a rifle 2 feet from him just waiting. I used to think he was unstable, and needed to move on. I still do think that, but I can certainly see where he's coming from.


I dare these terrorist scumbags to raid my moms house with her legal script...grrrrrrrrr!!!

I always feel like I am such a wet blanket when state run initiatives come up.
People in this country are so used to asking for permission that they don't understand that sometimes asking is the only way others have power over you.
No one can tell you that you can't smoke weed. no one.
When we don't stand up for our rights we simply give these people power they don't have any right to.

I can only speculate that since the patriot act and the war on drugs and terror being homogenized that they have much more power now than ever.
I believe I read that the DEA now operates out of over 63 countries, and the local governments beg for help tapping lines and other information gathering apparatus.

How many people in your family would be safe if the DEA actually decided to focus on doing nothing except gathering information on them?
Not real hard to imagine how a meeting with a DEA opponent would go at that level...
Sounds crazy (not as crazy as them) but I think Ms.Leonhart and her cronies call the shots and is not planning on going anywhere.

I don't think ambition meant any offense he was speaking his opinion.
I also know that most law enforcement are not going to execute a person over a little weed.
As long as one is not physically threatening you can stand firm.
Take a cue from womens self defense courses. If you are a medical user an a police officer has profiled you and refuses to listen to reason, treat them like the a attacker/rapist.
Let them know you are afraid and that they are committing a crime.

Because it is. FUCK OFF! For a regular person to tell a police officer to fuck off it comes down to two situations. They are a smart ass who wants to die. or they are generally terrified and they want the police officer to know they are serious.
It is all about communication and confidence.
And of course being safe and knowing ones own abilities and limitations.

There was nothing in his statement but his opinion. We as a community need to work with ea other. we are already divided and need to come back to the culture we started along time ago.

I dont trust the feds!! I dont trust my government!! I dont trust my politicians. They are not here to help us. We have to do it ourselves. Until we stand up and fight as a whole it will never change and im not talking about violence.
