It's coming here in AZ too. Every LEO out there is probably taking a phlebotomy class right now.
They're going to be stabbing needles into every 'suspected' pothead out there once they get the mob enough pitchforks and torches. Having a mmj card will be like asking for a needle poke from Johnny Law. Hopefully they won't do the old "Damn, I just can't find that vein!" routine.
If you refuse, they'll probably take it anyway, and suspend your license. And with the limit set too low for chronic users, your license might as well be suspended anyway, because you will always be looking over your shoulder when you drive, just like you have to now with no mmj.

I knew it...said the same earlier in the thread. You can't convict someone for being under the influence when the test detects presence for weeks. A new test will be developed...

Oh I know things aren't "fair"...but this? Being declared guilty of impaired driving and the only test would show me STILL impaired 2 or 3 weeks later? I'd fight that conviction to the death! I don't think it will make it past the first court case. It's blatantly unconstitutional.
when the cops smelled weed on my buddy in victoria b.c. canada, they made him do a sobriety test, like for drunks, walk the line etc... and then said he failed it

in my state the only way to get convicted of driving high is threw a blood or saliva test. so this pretty much isn't new but the level of 5 does seem kinda low.
She's been an attorney for what, a year or two? Get real. Her husband's the famous one and he's a well documented drunk and sex offender. Welcome to the movement.

have there actually been any legal mmj patients convicted of a dui for pot? the reason I ask is because I just got one on monday. I was pulled over for speeding and the cop said he smelled burnt marijuana in the vehicle (true - I had smoked in my vehicle the previous night, and also had a glass pipe that has been heavily used and obviously smells of burnt marijuana) I also had about a quarter oz and two clones in the car at the time, which the cop gave to my pregnant non-mmj patient girlfriend to take home after throwing me in cuffs. I repetedly told the cop that the smell of burnt marijuana was from the previous night and that I'm forced to smoke in my car due to the fact that I live with a parent that is weary of my status as a patient and will not allow me to smoke in my home. I took all the field sobriety tests once on the side of the road and again after I was taken back to the chp office, I would say I did them all without error. I was also required to submit a blood test approximately 4 hours after the last time I had consumed any pot and am unsure of the results of the blood test. I ended up going to jail for the first time in my life and was released later that evening. I'm in the process of finding an attorney to help me beat the case, although my main concern is keeping my drivers license, I have my first born on the way and really dont want to be phucked and stranded for a year...anyways I just thought I'd share my experience...it's pretty shitty.

Sorry to hear that Whadeez. This law makes no sense at all, a few states will give UA's and the smallest trace of metabolite will constitute a charge. Wear I'm from you can get pulled over weeks after smoking and loose your license. I have seen a study that said we actually drive better after smoking. Peace, pot and karma.

I didn't even feel stoned at all when I got rolled, thats the worst part. I've had cops let me drive off when I was soo shitfaced on alcohol that I was driving with one eye closed to stop the double vision when I was younger...just sucks I would have accepted the consequences of my actions had I really been intoxicated...whatever it blows.
