Michigan Question on Plant Numbers

For those of you who are Michigan patients/caregivers, do you know if unrooted clones count as 1 of the 12 allowed plants?

I feel like if you have your unrooted clones in root plugs or rock wool cubes it would be easy to explain to the police or in court that they are/were not really plants yet. the truth is i dont really know the answer. too me a plant without roots isnt a plant. i would think that any mediocre lawyer could convince the DA or at least a member of the jury, that an unrooted clone isnt a plant, if it even came to that. Im in cali and ive never factored my unrooted clones into my plant numbers.

Yeah, it seems logical that it shouldn't count...but then again it's obvious the people who made these laws don't really know anything about mj... in MI your allowed 12 plants but only 2.5oz? I can't do a recirculating system because of this, I will either be doing soil, coco or DWC (each bucket isolated as individual) and then staggering the harvests - 1 plant every couple weeks or so. This way I will never go over the 2.5oz limit. Kind of ridiculous. If anyones only getting 2.5oz off 12 (or even 6) plants I seriously feel bad for them. Not to mention if your only getting 2.5oz every 2-3 months that wouldn't even be enough medication for some patients.

It will depend on which court you would land in.

A couple of cases have gone in favor of the defendant if the cuttings didn't have roots.

More cases have gone against the defendant.

Safe is to assume that anything that is being attempted to be started will count as a plant.

Not always. If this is about a case that is already taking place, then it is worth a try.

Not advocating taking a chance in your grow. In your grow count the clone as a plant the second you put it into the medium or cloner.

In a court situation where counts are an issue, look for existing examples of where unrooted clones didn't count.

Those cases had experts come in and testify about when a plant becomes a plant. Usually some college professor.

Seems that most of the time an expert testified, the unrooted cutting didn't count.

So .. in your grow always count them. If you got stuck in a raid with a couple over, then sometimes you can get off.

no, they don't.

read the link.

The case of Redden and Clark is about 21 unrooted cuttings in dirt.
Oh .. about an ounce of dried usable.

Both had their doctors letter at the time and have their ID cards now.

They were raided in March of 09. The MDCH started to accept applications in April.

In MI courts clones count, but this has not yet been tested. In MI federal court they need roots.......scrappy

if you cut you plants up when you trim and dry. they will count each of those as a plant.

be mindful. they seem to not let go of this fight. its my feeling if a cop is in your grow, they are not leaving without poppin ya for something.

pretty sure they do, didn't kruchbubble just get popped, they counted his 600 unrooted clones as plants.
