Yep, I've decided the crop that's drying is going to be set aside for legal fees just in case, AC's can wait another month. Since I don't live at the spot and never have, my only connection to it is my rec hanging on the wall (along with the rest of my patients.) I don't think that a rec is significant enough to get a search warrant over, but LEO is dirty and likes to play dirty.

It's not hard to understand some folks' propensity for booby-trapping things, not that I would do it, just saying I understand it. Whether you've got a legal grow or not, cops treat us all like criminals, and will steal your crop and trash your stuff like a ripper would.

"I had a very similar occurance happen about a year ago. 2:00AM there is a loud knock at the door. 2 officers responding to a "911 hangup" they gps'ed back to my address."

Duckman...had the same thing happen to me..said it was a 911 hang up...less then month later the raid...
It seems this 911 hang up shit happens to a few of us.
And lazy man,,,wish you the best bro.

This exactly how they get evidence for a warrant. The make up and document an excuse to go there, "get the wrong house" or some other bs. If you can't prove they made up all this $hit, there is a chance they can get the warrant to stick. While they are at your house they will "find evidence" or smell marijuana.

As far as challenging a warrant, in CO the decision is up to the Supreme Court, who leans conservative. My lawyer said I'd have a 50/50 shot getting it thrown out. The DA said they'd go for a mandatory minimum 8 year sentence if I tried. I had 2 legal guns, unloaded and locked up, but they were still going to try and charge me with the guns...

IF I am correct you will be served with a warrant in 2-4 weeks or if they couldn't convince the judge they may be back to square 1... but I'd guess they know what's up either way...

Also, I've had a friend raided after a 911 hangup call too.

So the outstanding questions in my mind:

1) If it was a knock and talk, and said deputy illegally entered the property by climbing over a gate, is any evidence he finds usable to procure a warrant?

2) Since I don't live there, and everyone that does has been schooled to "don't talk to the cops a bit" could I bail them out while I hire counsel?

3) Will they come after me or any other patients since our med recs are all hanging on the wall?

I was just on the sheriff site again, it looks like they had a similar call down the road the next day, check welfare/gone on arrival. There seem to be 3-4 such occurences logged daily just in my little zone, one of 7 the sheriff is responsible for. Lots of mj posession arrests (4-5 a day) but rarely a cultivation bust.

Fuck I hate worrying about shit like this, all of the "yep, we got a similar call 1-3 weeks before the raid" has me all worried. I wish I could disappear for a month until this all blows over.

i live in sonoma county also and my neighbors r costantly getting dv calls i mean like twice a month the sheriffs r there sometimes more. they have jumped his fence to get into his house he had at least 25 to 30 good size outdoor plants and they jumped right on them didnt give a shit never asked for a script never raided him or fucked with him this was about two years ago. they even came over and asked me a couple questions and mentioned to me jokeinly that he must of had at least 25 to 30 bushels back there tryin to get me to say something. sheriffs in sonoma county seem to be preety leniant when it comes to medical marijuana as long as you r within ur guidelines. i understand that it is better to be safe then sorry. im just trying to let you sleep a little bit better at night i defeniatly would not want to have more than 99 at any given place. spread it out a little have a couple smaller grows at multiple different places. if possible . i guess that comes with more work more issues to deal with but i would think that it would be a little safer. maybe a couple 6 or 8 light ops two to three diff locations in case one goes down you still have two i dont know just a suggestion.

1) All he needs for a warrant, if he is LEO, is to be able to articulate a reasonable cause for one. Whether or not he entered illegally may not be a factor if a judge can be persuaded, or lied to, to sign off on a warrant request.

2) Yes.

3) Certainly could.

Is it just me or does it seem like many people on this site are suddenly and for no reason finding themselves in the eye of the law man?

If a judge cannot be convinced, then it is possible to get a Grand Jury to indict. This would be a sealed indictment.

I see two options:
1. the cop is stupid. well, he's a cop so he probably is, question is HOW stupid. Might got a wrong address. Did he stay to sniff around or did he realize its the wrong place and went away?
2. He could always use the "I smell marijuana" trick if you already let him in. In that case I'd think he might be after your friends.

I would chop away if I were you. Growing such amounts in my crib is too risky for me and my room-mates even when cops aren't suspiciously knocking at my door, let alone when they do.
I'm about to setup a 1000W rig in the next few weeks and if the cops gonna knock at my door trying to sell me crap (and not asking for direction) I won't open and burn down the grow.

I agree paranoia is better than jail, defintely. I went over last night, made sure there was no dried weed, cash, scales, packaging, guns or other illegal drugs onsite. A couple of my patients scrips have lapsed, so I'm over limit by 23 plants, but one of my patients is bringing over her updated scrip today so I'll be under by 7. I removed a handful of rootballs from outside that were from my first crop, and installed 3 different driveway alarms and motion detectors outside. Nobody will get near that place without alarms going apeshit, even if the stupid dogs are asleep again.

Yeah I've got a buddy who has a visit from the sheriff once a year, he comes over, knocks, says "we have a marijuana smell complaint" or some such, "do you have a grow here, is it legal, can I see it?" My buddy lets them in, sheriff glances over the paperwork (scrips) counts the plants, says "oh you're a few over eh? No big deal" and leaves. He's had 5 such visits now and has never been arrested.

The house he knocked at is sterile, no weed has ever been in it, the residents don't even smoke or do any drugs, they don't even have BOOZE in their house.

Now it's possible he WAS there for a false alarm/wrong address/whatever, and THEN smelled or saw something that made him suspicious, but there are a million what-if scenarios.

Bail money has been set aside, I'm retaining a lawyer Monday, and my paperwork is legit. Security is being beefed up in numerous ways, and everyone has been given instructions on what to do if the cops show up. If anyone comes near the place all sorts of alarms go off now, motion sensors and inductive loop sensors (for cars) and 4 nightvision cams go in next week too. The cops will be recorded every second they're onsite, and I'm hoping they make one of their typical sloppy mistakes.

Yep I'm noticing more growers getting heat on here too, might be time to give IC a rest for a few months.

Thanks man, I hope so too!

I figured that although my sack of JWH-018 is technically legal, I can't imagine how excited a cop would be to find a bag of white powder during a bust. I can just picture him pissing himself with excitement. It would however be VERY funny if he tasted it thinking it was coke. A wet finger coated in JWH would damn near be a fatal overdose, that cop would be stoned for 2 days! Hahaha

I moved it offsite and hid it, along with everything else. God damn I love my Foodsaver, I could bury a shitload of contraband anywhere and it would be good as new months later. I even saw a guy who vac-sealed cash, $5K in 100's was about as thick as a postcard! Just imagine where you could stash a postcard, inside picture frames, doors, under floorboards, in the attic, etc.

I've got a stash spot nobody in their right mind would put their hand in, but I can't tell you as I don't want to give the secret away! ;)

Hey lazy let me over examine for a sec if thats ok...
New to ic but not new to leo.
You said he asked about the dogs, or dog signs....
That to me is a little fishy..In situations where you may have a breach, dogs and the types of dogs on the property are a huge concern for the barney fifes coming through.

One time i was at a house and somebody did call 911 and hang up....2 leo showed up..
Second time, they said 911 hang up, nobody even came close to fucking calling 911,,2 leo showed up...raid followed a couple weeks later..

On a DV call there should be at least 2 cops...on a 911 hang up there should be 2 cops and with my experience a knock and talk....2 cops...You think if they suspect a grow they would send more than one guy considering the links they like to make with our hobby(guns gangs meth..) For his safety.

Thats why your situation has me baffled.

The fact they listed the call in their reports makes me think its legit...that he did in fact have the wrong house...

The difference between my situations and yours is the "sheriff". Perhaps they have a different way of dealing with calls. Especially if your out in the middle of nowhere...dosent sound like it though if you have 4 or 5 possession arrests a day sounds like these pigs know what their doing..

I heard someone say "if they planned on a raid they wouldnt come and knock on your door blah blah"...They couldnt be more wrong!

I bet some on here will agree, after your door is kicked down you start connecting the dots on the previous week or two..The weird shit thats been happening...the cop that knocked...the big shitty van parked down the street...The person you thought was stealing your mail..and you say shit...I should have known..

I think you have took excellent steps in staying safe since the knock...I would really like to know more about the conversation he had with you...the questions asked..how long he was there,, just for thought...The dog thing though red flag in my book...
Best,
Midgethorse.

Tits man,,if they are dvr type cams make sure that dvr box wont be found...not easy to do..Or go with ip cameras that can be recorded off site.

Oh and hide your gaming counsols...

the cops will surely knock before a raid. I believe for a couple reasons. Alot of people cave and they do not have to get a warrant which could be thrown out because you let them in and gave permission. They may find more information when there or find probable cause like a bong or smell. Lastly, they could eliminate you as a grower if you let them in and they find nothing.

And IME it can happen several days later.

The cop going solo on the DV call is a little weird but we do not have all the details. Plus in a rural area it may be standard.

At least he is preparing for the worst by setting money aside, etc

I hope its all a false alarm.

On the solo cop issue didn't Lazy say sometimes the response time is 30 minutes in the area? Doesn't seem like they'd have the man power for 2 cars with every DV case in this instance. Best of luck to you.

True green, After I thought about it, the "one cop" thing is not too alarming. Especially dv situations of direct danger..like a women screaming on the phone...or such, A leo would approach solo. Anywho

Perhaps but with a warrant they certainly don't need to. Knocking only alerts their intentions.

I'm sorry, none of this makes a bit of sense to me. :(
