Trading/Selling Clones in CO

Hi. This isn't an advertisement to sell or trade clones. I was simply wondering if anyone knows the laws that govern this process. I know from another post that seeds can be sold. I was wondering how this applies to clones.

CG to patient seems like it should be ok but im not sure....

what im really wondering about is how CG to CG is done...

Well HB 1284 says this.

UNLAWFUL ACTS - ENFORCEMENT
[FONT=TimesNewRomanPSMT,Bold]12-43.3-901. Unlawful acts - exceptions. [/FONT]
(1) EXCEPT AS OTHERWISE PROVIDED IN THIS ARTICLE, IT IS UNLAWFUL FOR A PERSON:

(a) TO CONSUME MEDICAL MARIJUANA IN A LICENSED MEDICAL
MARIJUANA CENTER, AND IT SHALL BE UNLAWFUL FOR A MEDICAL MARIJUANA LICENSEE TO ALLOW MEDICAL MARIJUANA TO BE CONSUMED UPON ITS LICENSED PREMISES; OR​

(b) WITH KNOWLEDGE, TO PERMIT OR FAIL TO PREVENT THE USE OF HIS OR HER REGISTRY IDENTIFICATION BY ANY OTHER PERSON FOR THE UNLAWFUL PURCHASING OF MEDICAL MARIJUANA.

(2) IT IS UNLAWFUL FOR A PERSON TO BUY, SELL,TRANSFER, GIVEAWAY, OR ACQUIRE MEDICAL MARIJUANA EXCEPT AS ALLOWED PURSUANTTO THIS ARTICLE.​

This is yet another area of 1284 being unconstitutional because Amendment 20 specifically addresses this and 1284 takes away from it.

(d) Notwithstanding the foregoing provisions, no person, including a patient or primary care-giver, shall be entitled to the protection of this section for his or her acquisition, possession, manufacture, production, use, sale, distribution, dispensing, or transportation of marijuana for any use other than medical use.

I'd be concerned more about local regulation. In Denver, MMC's are allowed to cultivate plants on site, so they can have clones for sale. I'd also worry about CG 2 CG because of the "no caregiver collusion" stipulation in 1284. You would probably have a good defense under A18S14 but is it worth the money in legal fees?

I hear ya! Almost every single clone or plant the comes into the center either has PM or Mites on it. WTF ?

Either people don't know [yeah right] or they are intentionally trying to implement biological warfare.

Yes, I used to run this sort of thing at the disp. I used to work at. It was ok as long as you worked with reliable growers, but there would always be problems. I.e. pm mites etc. It would be awesome to organize a farmers market of vendors though definitely... just gotta work around some of the issues.

You would have to have an intake program. Screening for clean clones of some sort and "approve" them before being sold to the public.

On that note, can Full Spectrum labs (or any other mmj lab) test live samples for systemic diseases like PM or just dry samples?

Sounds risky, and I've heard of plenty of scam artists on CL! Sounds like a way to get ripped AND get powdery mildew...
