Alright, so hypothetically speaking of course.....
My girlfriend was slinging a small out of marijuana, somehow it got out of hand but she would never sling more then an ounce. She used a prepaid phone to send texts and recently stopped. Now the other day her sister (in high school) got pulled out of class and the school asked her if her sisters number (my girlfriend) was 555-5555 which it was, but that number was her real cellphone number which she never used, not the prepaid. My girlfriends mom went to the school to ask what was going on and apparently the police was asking if my girlfriend went to that school(she had graduated from that school 2 years prior), and said they were doing an investigation on that phone number. Since then we removed all the illicit substances from my girlfriends apartment and she quit slinging a week before all this happened. Now what is weird is how the police got a hold of her real cellphone number that she never used, she literally had it shut off for months. My question is can a simple text message be used as evidence to either take action, acquire a search warrant, or press charges? Can police legally tap into her phone line or look up her text messages without any real evidence? obviously we are taking no chances and have stopped everything but my girlfriend is having anxiety attacks about what they could possibly do. anyone's 2 cents would greatly be appreciated.
oh and p.s. she has her medical card and she is disabled, i don't know if that can play a role or not.
